THE FAIRHOPE PLANNING AND ZONING COMMISSION Minutes for meeting May 2, 1977 The Fairhope Planning.and Zoning Commission met in regular session on Monday, May 2, 7977. at 5:00 P.M., at the Clty Administration Building, 387 Fairhope Avenue, Fairhope, Alabama. The following members were present: Chairman John S. Parker; Members: Sam E. Box, Chester Billie, E.J. Kirk, Leona Newman, Mayor James P. Nix, Mr Cecil Pitman and Dr. Pierce Fredricks. Chairman John S. Parker arrived and presided over the remainder of the meeting. The first item brought before the Commission was the subdivision application of zne Fairhope Single Ta,& Corpor-at i or, for Preliminary and Final Plat approval of an acreage parcel into two (2) lots; situated in NW 4 of SW 4 of SW 4 of Section 14 of Township 6 South, Range 2 East; located on the east side of Baldwin Couty Highway 27 approximately 4 miles east of the City of Fairhope. The proposed subdivision is comprised of subdividing an acreage parcel containing 9.5 acres more or less into two (2) relatively yarge lots. Proposed Lot 1 has a single-family dwelling together with three utility buildings. Subsequent to being subdivided this lot will contain approximately 3.5 acres. It is currently served with a septic tank system which adequately functions. Proposed Lot 2 will contain approximately 7.15 acres. At present, the leaseholder (William F. Joseph) has no plans to construct any improvements on this parcel. Moreover, no additional utilities are planned or needed; and according to the engineer the terrain is flat and has no significant drainage problems. Mrs. Rockwell was present to represent the application for the Single Tax Corporation. After discussion Mayor James P. Nix moved to grant Preliminary Apporval subject to clearance of septic tank system. Seconded by E.J. Kirk. Motion carried. Dr Pierce Fredricks was ask to oversee the procurement of County Health septic certificate nrior to si.-nin,g plat. The next item to be brought before the Commission was the application for a Building Permit of Eastern Shore Art Association for an addition to the existing building located at the northeast corner of Section and Oak Streets. The proposed new addition is in violation of Article IV, Section 4.14, Subsection ,4.141 (b) (2): Side Yards: Each Lot shall have a side yard of a minimum of 35 feet on each side.In this instance, the southwest corner of the proposed addition is situated 20 feet from the side property line, while the northwest corner is situated approximately 26 feet from the side property line. After discussion concerning sight distance, possible re-routinig- of traffic; one ingress - one egress and possible re -landscaping of parking lot, Mayor James P, Nix moved to grant the Eastern Shore Art Association the building permit provided they get approval of the Board of Adjustments on the side yard variance. Seconded by Cecil Pitman. Motion carried. IV. V. VI. The building site is composed of three (3) 50 feet frontage lots by 149' depth, located on'the west side of Greeno Road, q lots youth of First National Bank's Branch. Following discussions concerning Road Right -of -Way, Utility easement, creation of service road to alleviate road congestion, reduction of safety hazards of a single ingress and egress instead of multiple,landscaping requirements, and a possible building setback, the Commission proposed to compose a letter explaining the situation and send this to the surrounding property owners ( Montgomery, Coleman, Todd, Mastin, Allegri) and invite interested parties to attend .the Commissions next meeting on June 6, 1977. The next item brought before the Commission was the review and discussion Of amendments to the zoning ordinance proposed by Mr. Hartford Field. Mayor James P. Nix moved to table the review until Don Pruitt and Mr. Field were present. Seconded by Leona Newman. Motion carried. Leona Newman asked if any members of the Commission had been consulted about the migrant housing conditions located behind Gulf Farms. Mayor James P. Nix informed the Commission that he had investigated the situation with T. Brazil and that Gulf Farms were in complete legality with the Zoning Ordinances. Also, that T. Brazil assured him that the living conditions would be kept neat and in order. Mr John Parker offered the Commission's assistance reference a possible Tree Commission of the City of Fairhope.
