FAIRHOPE PLANNING AND ZONING COMMISSION
Minutes for Meeting February 7, 1 7
The Fairhope Planning and Zoning Commission met in regular
session on Monday, February 7, 1977, at the City Administration
Building, 387 Fairhope Avenue, Fairhope, Alabama, at 5:00 P.M.,
with Chairman John S. Parker presiding.
The following members were present: Chester Billie, Sam Box,
Dr. Pierce Fredricks, Leona Newman, and Mayor James P. Nix.
Members absent: Iiarford Field and Cecil Pitman.
Mayor James P. Nix moved, seconded by Mrs. Leona Newman, to
approve the minutes of the January 3, 1977 meeting and the
special meeting January 8, 1977. Motion carried.
The first item brought before the Commission was the
rezoning application of Mr. Byrd L. Moore. Mr. Moore requested
a change in zoning from R-1 Low Density Sin le Family Residen-
tial District, to R-3 Limite Multi-Famil Resi ential District,
or the property identii:ie as proposed Rosa Acres Unit II;
a tract of land formerly owned by Rosa Andrews, located on the
north side of Edwards Avenue, approximately 150 feet of the
northeast corner of Greeno Road. The land under consideration
for rezoning consists of an " L " shaped parcel comprising 1.45
acres more or less, which will comply with R-3 requirements
for single family development.
Mr. Byrd Moore was present at the public hearing to
represent his application. There were no adjacent property
owners present at the hearing in opposition to the rezoning.
Mrs. Leona Newman moved, seconded by Mr. Sam E. Box, to
recommend a change in zone from R-1 to R-3 for Rosa Acres
Unit II, subject to duplex or single family development. Motion
carried.
The next item brought before the Commission was the re-
zoning application of Eastern Shore Builders for a change in
zone from R-1 Low Density Single -Family Residential District,
to R-2 Medium Densi�tyy Single -Family Residential District, for
the property i' tified as Rack Acres, two large lots situated
between Blue Island Avenue and Ingleside Avenue; located
approximately 150 feet north of Fairhope Avenue. The subject
property is comprised of two (2) large lots containing approx-
imately 4.5 acres each. Eastern Shore Builders intends to
subdivide these two (2.) lots into twenty-two (22) lots.
Mr. Byrd Moore was present to represent Eastern Shore
Builders application.
This being the date set for public hearing on the rezoning
request, Mr. Byrd Moore explained the proposed intentions of
the developer for the property under consideration to members
of the Commission and to those present at the hearing. Mr.
Moore stated that each -lot was over the size of the zoning
requirements but that they requested rezoning because of four
(4) Lots in the cul-de-sac that the zoning requirements say
at the set -back line will be 100 feet. Mr. Moore said that
this requirment would require the developer to set -back more
than would normally look good coming around the cul-de-sac.

Mr. Moore felt it would be better to apply for rezoning rather
than apply for a variance to the Adjustment Board on each
lot for the set back lines.
Property owners present at the public' hearing were all in
opposition to the rezoning of the property under consideration.
After a discussion between Commission members, property owners,
and the developers, Mr. Byrd Moore withdrew the application
of Eastern Shore Builders for rezoning, and stated that they
would apply for subdividing of the property at a future date
under R-1 requirements.
The third item brought before the Commission was the
application of McLean Realty Corporation for Preliminary Plat
approval of Parker Road Commercial Park; a subdivision of
acreage into eight (8) lots; situated in Section 7, Township
6 south, range 2 east; located outside the corporate limits
on the north side of Parker Road west of U.S. Highway 98.
Mr. Car'Iton Niemeyer was present at the meeting to
represent Mr. McLean. Mr. Niemeyer stated that the developer
intends to create seven (7) large lots.
Property owners present stated that they were opposed to
the intended land use of the property to be subdivided.
Chairman Parker informed property owners present at the hear-
ing that the Fairhope Planning Commission did not have
jurisdiction over zoning or land use, but only subdivision
within a five -mile radius of the corporate limits in order to
insure that the development of public roads, the treatment of
surface drainage and the provisions for water and sewer are
reasonably met.
Mr. Carlton Niemeyer submitted to Commission members a
proposed plan for the subdivision, Parker Road Commercial
Park, which shall become a part of these minutes, showing
Parker Road Commercial Park covenants, restrictions, and
limitations, as proposed by McLean Realty.
South Alabama Regional Planning Consultant Mr. Don Pruitt
statetl that lie would like to establish some link of coordina-
tion between the State Highway Department and the developer
to the Planning Commission with regard to reviewing drainage
plans. Mr. Pruitt said the .Commission should get a letter
from the llighway Department indicating that they have review-
ed the proposed surface drainage plans and that it either
meets or does not meet their requirements.
Mr. Chester Billie moved, seconded by Dr. Pierce Fredrick:
to grant Preliminary Plat Approval to McLean Realty subdivisioi
application subject to approval by the State Highway Depart-
ment, the County Commission and the State Health Department,
prior to final approval by the Fairhope Planning Commission.
Upon being put to vote the following vote was recorded:
AYES: James P. Nix, Sam E. Box, Chester Billie, Dr. Pierce
Fredricks.
NAYES: None.
ABSTAIN: Mrs. Leona Newman.
Motion carried.

The final item brought before the Commission was the
application for a building permit by the Baldwin County
Board of Education for the purpose of building a library
addition on to the High School.
Mayor ,James P. Nix moved, seconded by Mrs. Leona Newman,
to authorize the Building Inspector to issue a building permit
to the Baldwin County Board of Education for the purpose of
constructing a library addition to the High School. Motion
carried.
On a motion duly made, seconded and carried, the meeting
adjourned at 7:15 P. M.
