Minutes for special meeting January 8, 1977
On Saturday, January 8, 1977, at 9:00 AM, a special meeting of the
Fairhope Planning and Zoning Commission was held at the request of
Mayor Nix for the purpose of considering two (2) building permit
applications which were not submitted in time for review and consider-
ation at the regular January 3 meeting. Present were Chairman Parker,
Mr. Field, Mr. Pitman, Mr. Billie, Mrs. Newman, Mayor Nix, Councilman
Box and Mr. Kirk. Also present was Building Inspector, Mr. Stearns.
Absent was Dr. Fredericka
I. A building Permit for a commercial building to operate a heating and
air conditioning service company was requested by Lloyd Vick. An
alternate plan was presented which complies with City of Fairhope Zoning
Ordinance parking provisions. Upon a motion by Mayor Nix to grant a
building permit subject to development as shown on the "Alternate"
drawing in compliance with requirements that no parking spaces allow
backing onto the road right-of-way and maintenance of a 10' minimum
landscaped area between the road right-of-way and paved parking areas,
Mr. Pitman seconded and the motion passed unanimously.
II. Next, Mr. Byrd Moore, Jr. presented a request for two (2) building permits
for office/warehouse structures on two (2) "separate lots at the southeast
and southwest corners of Nichols Avenue and Commercial Park Dr. After
considerable debate regarding parking and landscaping requirements in
the existing Zoning Ordinance, a revised parking plan was agreed upon
which allows the prescribed number of parking spaces and some land-
scaping. Upon a motion by Mayor Nix seconded by Mr. Field that the
building permits be granted with provision for truck unloading, two (2)
parking spaces, and landscaping per each office/warehouse unit (3 units
per building) as drawn by Mr. Field on the drawing, the motion passed
with AYES by Nix, Field, Pitman and Kirk; NAYES by Newman, Box, and
Parker.
The meeting was adjuourned at 11:15 AM with an -appeal by Chairman
Parker that building permit requests submitted after the cut-off date
be considered at regular meetings only, and that the provisions of the
Zoning Ordinance be strictly adhered to until they are amended by due
process and City Council action.
