THE FAIRHOPE PLANNING AND ZONING COMMISSION
The Fairhope Planning and Zoning Commission met in
regular session on Monday, December 6, 1976, at 5:00 P.M.,
at the City Administration Building, 387 Fairhope Avenue,
Fairhope, Alabama with Chairman John S. Parker presiding.
The following members were present: Mayor James P. Nix,
Mr. Cecil Pitman, Leona Newman, Dr. Pierce Fredricks,
Chester Billie, Sam E. Box; and Jack Kirk.
Members Absent: Mr. Harford Field.
Mayor James P. Nix moved, seconded by Mrs. Leona Newman,
to approve the minutes of the November 1, 1976 meeting. Motion
carried.
The first item brought before the Commission was the
application of Mr. Robert M. Green for final Plat approval
of the 4th addition to Deep Tree Forest Subdivision; a sub-
division of 3.2 acres into six (6) lots; situated in Section
8, Township 6 south, Range 2 east; located east of the third
addition to Deep Tree Forest and generally east of Evergreen
Street. Preliminary Plat approval was granted at the April,
1973 meeting of the Planning Commission.
Adjacent property owner, Mr. John Beasley, expressed his
concern over the drainage problem in that area, once the road
is completed. Mr. Beasley was told by the Commission that
Mr. Robert Green's posting of a Performance Bond would insure
that a proper road with proper drainage would be installed.
After a discussion between members of the Commission and
adjacent property owners, Mrs. Leona Newman moved, seconded by
Dr. Pierce Fredricks to grant Final Plat Approval for the
4th Addition to Deep Tree Forest Subdivision subject to the
following:
1. The developer posting bond for the installation of
the required improvements or completing such
improvements prior to the Final Plat being signed
by the Secretary of the Commission.
2. The developer construct the road in such a way that
there would be no problems with drainage or errosion.
3. That an inspection be made by the member of the City
Council in charge of the Street Department..
Motion carried,
The next item brought before the Commission was an in-
formal discussion between Commission members and Mr. Jack
Pope regarding Apartment Development on Fairhope Avenue at
Fairwood Blv'd. Commission members looked over Mr. Pope's plans
and discussed the drainage, parking area and land area vs.the
building area, of Mr. Pope's proposed Apartment Development.

Minutes for De. 6, 1976 meeting
The third item brought before the Commission was a
discussion between Commission members and Dr. Fred Diegmann,
regarding the 150' buffer zone fronting on Morphy Avenue,
and restricted to R-2 Zoning according to action taken at the
April 5th, 1976 meeting of the Planning Commission.
Dr. Diegmann and Lorena Gregorius of Mannich's Realty ,
stated that they felt the 150' strip was restrictive and that
Dr. Diegmann did not desire to develop residential lots along
Morphy Avenue.
After a discussion on what procedures Dr. Diegmann should
follow to accomplish a buffer zone of 35 feet, the Commission
recommended that Dr. Diegmann.apply for rezoning of the 150'
strip from R-2 to B-4, at the January 3, 1976 meeting of the
Commission. And that the following be attached to Dr. Diegmann'
application for rezoning:
1. There will be no ingress or egress of traffic off of
Morphy Avenue.
2. There would be a 35' planning area fronting on Morphy.
3. The set back of buildings would be at the 35' line.
Dr. Pierce Fredricks discussed the plans of the United Methodist
Church for enlarging the parking area at the Church. No action
was taken at this time, pending formal application being made
by the Church.
Mr. Carlton Niemeyer came before the Commission for a
preliminary discussion regarding property located on Parker
Road behind Rosemont Nursing Home, a four and a half (4z) acre
parcel of land, for subdividing. Mr. Niemeyer stated that he
will file a formal application for presentation at the next
meeting of the Commission.
There being no further business to come before the Commiss
the meeting adjourned.
