THE FAIRHOPE PLANNING ;AND ZONING COMMISSION Minutes for '_`Meeting September 13, 19776 The Fairhope Planning and Zoning Commission met in regular session on Monday, September 13, 1976, at 5:00 P.M., at the City Administration Building, 387 Fairhope Avenue, Fairhope, Alabama, with Chairman John S. Parker presiding. The following members were present: Mayor James P. Nix, Mr. Harford Field, Mr. Chester Billie, Dr. Pierce Fredricks, Mr. Cecil Pitman, Mr. Jack ICirk, and Mrs. Leona Newman. Members absent: Mr. Barney L. Shull. Mr. Harford Field moved, seconded by Dr. Fredricks, to approve the minutes of the July 12, 1976 meeting as submitted. Motion carried. No meeting was held in August of 1976. The first item brought before the Commission was the Subdivision Application of Mr. and Mrs. G.E. McKenzie,. represented by Mr. John Marshall of Mannich's Real Estate, for Preliminary Plat Approval of Glowood Subdivision, a re- survey and subdivision of one (1) Parcel into five (5) Lots. This property is situated in Section 37, Township 6 south, Range 2 east, located on the east side of Bon Secour Avenue, north of the northeast corner of Volanta and Bon Secour Avenues. After a discussion pertaining to surface drainage, the needed easements, and the County's reply in regards to the sanitary sewer requirements, Mayor James P. Nix moved, seconded by Mr. Cecil Pitman to grant Preliminary Plat approval subject to the following conditions: 1. The applicant furnish the City with a certificate from the State Health Department saying that the Lots will perk. 2. The applicant will post a bond with the City stating he will be responsible for paving assessments, if and when the road is paved. 3. The applicant will install water lines, or post a bond with the City for the installation of Water Lines. 4. The applicants plat will be brought into compliance with the requirements as stated in the City of Fairhope's subdivision regulations. Mr. Cecil Pitman seconded the motion. Motion carried. The next item brought before the Commission was the Application of Claude A. and Evelyn Jansen for Preliminary Plat Approval for a resurvey 6: subdivision of High Ridge Estates into ten (10) Lots. This property is situated in Section 5, Township 6 south, Range 2 east, located at the northwest corner of Parker and High Ridge Roads. After a lengthy discussion among Commission Members, Mr. Jansen and adjacent property owners regarding various discrepencies in the application, Mr. Cecil Pitman moved, seconded by Harford Field to defer the application until resubmitted in order. Motion carried. Page No. 2 Fairhope Planning and Zoning Commission Minutes for meeting, September 13, 1976 Mr. Ed Beard came before the Commission to discuss the annexation of land on the east side of Highway 98, into the Citv of Fairhope. Mr. Beard stated that he desired annexation into the City with a B-3B zone- Mr. Charlie Earle was also present at the meeting and stated thst he was also interested in annexation into the City as B-3B zone.** After an informal discussion, Mr. Cecil Pitman moved, seconded by Mr. Chester Billie, that the Planning Commission recommend to the City Council annexation of Mr. Ed Beards property and Mr. Charlie Earles property into the City of Fairhope on a B-3B basis. Motion carried. Mr. Charlie Earle acting as a representative of Mr. Carlton Niemeyer came before the Commission to discuss the proposal of Olympia Corte Dyas , as stated in a letter to the Commission dated July 12, 1976. Chairman Parker informed Mr. Earle of the Commissions response to the proposal. Chairman Parker stated that the Commission concluded that annexation into the City was agreeable under R-1 zoning, and that the City could not agree to providing the total expense of installation of the water system. However, the City would waiver Ad -Valorem Tax until such time as the land is developed. Mr. Parker stated that the City was agreeable to annexation under R-1 zoning. There being no further business to come before the Commission, the meeting was adjourned. 'fr. Earl's property is the site of the Junior Food Store on the east side of HNry. 98 south of and adjacent to fhe Pappagallo's site.
