THE FAIRHOPE PLANNING AND ZONING COMMISSION
Minutes lor Meeting Ju y 7
The Fairhope Planning and Zoning Commission met in regular..'.'
session on Monday, July 12, 1976, at 5:00 P.M.,at the City
Administration Building; 387 Fairhope Avenue, Fairhope,•Alabama,
with Chairman John S. Parker presiding.
The following members were present: Mayor James P. Nix,
Mr. Harford Field, Mr. Jack Kirk, Mr. Barney Shull, and Mrs.
Leona Newman
Members Absent: Dr. Pierce Fredrick, Mr. Cecil Pitman ,
and Mr. Chester Billie.
Mrs. Leona Newman moved to approve the minutes of the
June 7, 1976 meeting, seconded by Mr. Jack Kirk. Motion
carried.
The first item brought before the Commission was Mr. R.J.
Potter seeking final plat approval of a portion of Linn -Ridge Subd.
This property is located in Section 12, Township 6,south, range
2 east; and is located on Alabama Highway 104 approximately
three and one half (3k) miles east of the corporate limits.
Mr. Robert Potter and Mr. Ack Moore of Moore Engineering
were present torepresent the application, seeking Final Plat
approval on eleven (11) Lots.
Adjacent property owners present at the meeting, after a
discussion on drainage, stated.that they had no objections.
Mayor James P. Nix moved, seconded by Mr. Barney Shull,.
for Final Plat Approval of the eleven (11) Lots subject to an
acceptable bond posted with the City Council, and with the
waiver of curb and gutter requirements. Motion carried.
The next item brought before the Commission was the
application of Sam Damson, Jr., agent for Alco Land and Timber
Company, Inc., for Preliminary and Final Plat Approval'of the
Alco Land and Timber Company, Inc., subdivision; a subdivision
of 2.36 acres more or less into three (3) Lots; situated in
Section 18,. Twonship 6 south; Range 2 east; located on the
west side`'pf Section Street approximately 233 feet north of the
northwest -corner of Section Street and Magnolia Avenue.
This subdivision consists of dividing one large parcel
into three (3) Lots. Lot one (1) contains approximately 1.68
acres which fronts on Church Street and is to be developed into
an apartment complex. Lots 2 and 3 with frontage on Section Street
are to be held and developed at a later date for use consistent
with B-2 General Business District Zone.
Adjacent property owners present at the meeting, after
reviewing the plans stated that they had no objections.
Provisions were made on the Plat for a fifteen (15) foot
utility easement on the south side of Lot three (3).
James P. Nix moved to grant Preliminary and Final Plat
approval of the subdivision into three (3) Lots, seconded by
Jack Kirk. Motion carried.
The next item brought before the Commission was a discussion
on the proposed State Board of Health Subdivision Regulations.
Chairman Parker urged the Commission members to study the
news articles and related materials distributed to each member in.
order to be informed when developers and citizens of the community
ask about these topics.

South Alabama Regional Planning Consultant, Mr. Don
Pruitt, informed Commission members as to the effect the
proposed regulations by the State Board of Health to
tighten controls over water supply and sewage disposal systems
in future subdivisions will have on the City of Fairhope.
Chairman John Parker moved, seconded by Mayor Nix, to
send a letter to the public hearing to be held in Bay Minette
on July 16, 1976, directing the letter to the authorities
conducting the Public Hearing , stating that the Planning
Commission of the City of Fairhope, feels that the present
regulations applicable to Baldwin County, in the City of
Fairhope, adequately covers sewage needs, and that the
proposed regulations are unnecessary, and will impose r.;4-
unduP economic hardships in the development of our
area. Motion carried.
Planning Consultant Don Pruitt also urged Commi�7sion
members'as City Officials, to take an active part i:• 'i.e
208 'Program.
Mr. Carlton Niemeyer was present at the meeL-in� for a.,
informal discussion with Commission members on a proposal
for Olympia Corte Dyas. Mr. Niemeyer requested consideration
on the proposal from members of the Planning Commission.
Commission members informed Mr. Niemeyer that they would
look over his proposal and give serious consideration to
Mr. Niemeyer's proposal, and report back to him at a later date
There being no further business to come before the
Fairhope Planning Commission, the meeting was adjourned at
6:45 P.M.
