Minutes for Meeting April 5, 1976
The Fairhope Planning and Zoning Commission met in
regular session p Monday, April 5, 1976 at 5:00 P.M.,
at the City Administration Building, 387 Fairhope Avenue,
Fairhope, Alabama with Chairman John S. Parker presiding.
The following members were present: Mr. Harford Field,
Mr. Chester Billie, Mr. Jack Kirk, Mayor.James P. Nix, and
Mrs. Leona Newman. Mr. Cecil Pitman, Dr. Pierce Fredrick,
and Barney Shull were absent form the meeting.
The minutes of the March 1, 1976 meeting were approved
wi.th the following additions and corrections:
1. Strike apartment complexes from Item # I un,der
Playgrounds.
2. Under drainage reword to run off the water from the
main street.
Mr. Harford Field moved to approve the minutes of the
March 1, 1976 meeting with the above corrections and additions
Mrs. Leonai Newman seconded the motion. Motion carried.
The first item brought before the Planning Commission
was the application of Mannich's Real Estate agent for Fred F.
Diegman, M.D. , for a change in zoning from R-2 Medium Density
Single Family District, to B-4 Business and Professional District
for the property identified as a subdivision of Carrie Young
Property in Lot 7, Section 17, Townsh.ip 6, south,
Range 2 East. The property located at the southwest corner of
Morphy Avenue and Ingleside.
Mrs. Lorena Gregorius of.Mannich's Real Estate and Dr. Fred
F. Diegman presented the application to the Commission.
Adjacent property owners attending the meeting said that
they would have no objections to the rezoning providing that
there would be no ingress or egress of traffic off. of Morphy
Avenue.
Mayor James P. Nix moved to refer the rezoning application
of Dr. Fred F. Diegman to the City Council with iuxception

of a 150 foot strip fronting on Morphy Avenutgn�n� that there
will be no ingress or egress of traffic off of Morphy Avenue.
Mr. Jack Kirk seconded the motion. After being put to vote the
following vote was recorded: AYES: Mayor James P. Nix, Mr. Jack
Kirk, Mr. Chester Billie, Mr. Harford Field. Nay: Mrs. Leona
Newman. The rezoning application was approved for referral to
City Council.
The next item brought before the Planning Commission was
the application of James C. Mitchell, Leaseholder, for a Final
Plat approval of subdivision of one ( 1 ) lot into two ( 2 )
parcels' situated in Section 22, Township 6 South, Range 2 East;
located on the north side of Twin Beech Road ( Baldwin County
Highway 44 ) approximately 657 Feet east of the intersection of
Hall -Thompson Road. Mr. John -Powers was present to represent
Mr. Mitchell. Fairhope Single Tax Corporation representative
Ruth Rockwell presented Mr. Mitchell's application.
Mayor James P. Nix moved that the subdivision application be
approved subject to recommendations of the Planning Commission,
w1hich includes a certificate from the Health Department, and
further plats not be presented with improvements shown on plat.
Mr. Harford Field seconded the motion. Motion carried.

The next item brought before the Commission was the applicati
for a building permit by Greer's located on South Section Street.
The application was presented by Mr. B.T. Greer, of Greer's Store,
in hopes of building an addition to the present structure.
Mr. Greer stated that all of the incomplete items which were on
the original plans had been corrected to meet the approval of
the South Alabama Regional Planning Consultant,.Mr. Don Pruitt.
After a discussion on the ingress and egress patterns of traffic
and the parking lot patterns, Mr. Harford Field moved to give
approval of issuing a Building Permit subject to final plans being
approved by Harmon Stearns, Building Inspector. Mr. Jack Kirk
seconded the motion. Motion carried.
The next item brought before the Planning Commission was
a sketch plan on a possible subdivision by Mr. Robert J. Potter,
and Mr. Bob Lundsford of Moore Engineering. The property is
located one and one half miles east of Belforest Road, on the
south side of Highway 104, approximately four ( 4 ) and a half
miles east outside of Fairhope. Mr. Potter proposed tosubdivide
his tract of land into 42 to 43 lots. An informal discussion
followed on the county health department considerations and
water questions, relative to the lot area. Mr. Lundsford stated
that the minimum lot size will be about one ( 1 ) acre each.
After a discussion the Planning'Commission offered comments
of guidance on Mr. Potter's proposed subdivision. Mr. Potter
was told that he. should be sure to review the subdivision regula-
tions, and get his preliminary plat in order with all the
requested items.
The next item brought to the Commission's attention was
a subdivision application of Mr. Rudy Rezner. Mr. Rezner's inten-
tion is to subdivide his property into two lots, in order to
give land to his son to build a house. The property is described
as the northwest corner of'Gayfer Extension and Belforest Road.
Mr. Rezner said that all of the county health requirments had
been met, and that they had the Health Department's approval, with
a copy of the certificate to be brought to th.e City for the files.
The Fairhope Single Tax Corporation has already approved the
subdividing of the Rezner property.
Mr. Jack Kirk moved to grant approval of the subdivision
application, seconded by Mr. Harford Field. Motion carried.
In other business the Secretary of the Planning Commission
was instructed to write a letter to the Fairhope Single Tax
Corporation on the procedure adopted at the March 1, 1976
meeting of the Commission stating that the Planning Commissio
will not hear any more subdivision or rezoning applications.

The next matter brought up for discussion was the
review and action on the proposed amendments to Article
VI, Special Provisions, Sections, 6.93 and 6.94 , to the
Zoning Ordinance.
Mr. Harford Field requested that this matter lay over
until the Commission can incorporate the proposed amendment
with enough other material to justify a public hearing.,
A discussion on the study of subdivision requirements
and plat recordings of the five -mile zone around the City,
and subdivision regulation jurisdiction was the next
matter brought to the Commission's attention.
Mr. Don Pruitt, Planning Consultant, gave a letter
from the Attorney General to the City of Daphne giving
an opinion of the Attorney General's office on zoning in that
Mr. Pruitt said that he will draft a letter for the Mayor to
send to the Attorney General for an opinion. Mr. Pruitt
will work up recommendations and report back to the Commission
a later date.

Mr. Carlton Niemeyer was present to informally discuss
with the Planning Commission on a subdivision of one ( 1 ) lot
into four ( 4') lots on Parker Road between Parker Road and Highwi
98. Mr. Niemeyer was advised to get his application in order
and apply with the City.
There being no further business to come before the Fairhope
Planning and Zoning Commission, the meeting was adjourned.

First, the plat plan is not drawn to scale, nor are adequate deminsions furnished;
therefore, the staff cannot adequately evaluate whether the proposed addition to
the existin Q building or the parking facilities shown comply with the zoning regu-

Second, the parking spaces detailed which have ingress and egress from the side
of the existing building and proposed addition facing Section Street are in
violation of Section 6.941 of the Zoning Ordinance.
Third, it does not appear that the space provided f
the parking area is adequate r maneuvering of vehicles in

Fourth, the off-street parking layout does not meet he requirements of Sections
6.943 and 6.944 of the Zoning Ordinance.
Finally, Section 60.1 Off-street Loading/Unloading Space - Such space is not
indicated on the plan.
Observation - The structural details reflected in the framing and footing
schematic appear to be insufficient to properly evaluate these plans. This is
_ merely mentioned because the liability the City may assume in the event of struc-
tural defects.
In conclusion, as presented, the plans are inadequate for the staff to properly
ascertain if the proposed addition including the off-street parking facilities
meet minimum zoning requirements. Accordingly, the staff recommends that the
Commission not appove the issuance of a building permit until revised plans
correcting the deficiencies noted here are received and evaluated.
