Parker presiding. ;i The following members were present: Mayor James P. Nix, Mr. :arford Fielii, i.r. Chester Billie, Dr. Pierce Fredrick, and Mr. Cecil Pitman. 2.embers absent: Mr. Braney Shull, Mr. Jack Kirk, and Mrs . Leona Newman. Also present +at the meeting was Souch Alabama Regional Planning Consultant Mr. R.D. Pruitt, The minutes of the February 2, 1976 meeting were approved with the following addition: Item # 3- The ,motion was seconded by Mr. jack Kirk. i Lotion carried. The first item on the agenda was the review and discussion of the Parking Lot Plans for the First Baptist Church. The Reverend H.B. Shepherd was present to represent the First Baptist Church. j The Reverend•Shepherd presented the revised Parking Lot Plan, i - which had been revised with the hel-p of Commission Member Mr. Harford Field who met with the Parking Lot Committee members of the First Baptist Church. jl Mr. Field recommended allowing applicant excentions as follows: ( 1. ) PLAYGROUNDS: The Fairhope Planning Coin '-S on should allow for Churches, Schools, that land- i� scaped areas within the parking area where more tha fifty ( 50 ) spaces are provided shall not be required in addition to the perimeter landscaping so that playground areas may duplicate for 1i Parking Facilities; Therefore such establishments should not have i to put center islands in their parsing areas in order to allow for j playgrounds. 2. ) DRAI\AGE: Providing Diagonal parking off of the street. �i Paving could be done in such a way as to allow a shallow butter arrangement to run off the-ma-irt water from thstreet. � ( 3. ) 'NU^ME R OF PARKING SPACES P.EQUIRED: Allow- ance for an exception. from One ( 1 ) Space for every four ( 4 ) pew seats to Cae ( l ) Space for every six ( 6 ) pew seats, i Member Cecil Pitman moved that if the Parking Lot Plans met the needs of The First Baptist Church 'then they had the approval of the Fairhope P lannin- Commission. Mayor James P. :Nix seconded the motion. Motion carried. Ti. The next item on the agenda was the application of i�.r, and Vrs. Melvin Wa ner for preliminary plat approval of a rest ubdivl::i.on of Bloci. 48, iIagaolia Beach Addition to Fairhope; located on the east side of Chestnut Stract betweci1 Fig -nd Pecan Stre ts. Mr. Wau ner's application was to resubdivide one ( 1 ) Lot into three t, 3 ) Lots. Property presently being zoned R--2 Single. :District. Mayor James P. Nix moved for preliminary and final l„t approval, of the Wagner's appllcaLion provldir." th i:. the Engineer meets the plat requirements of the Fairhope Planning Commission. PAGE # 2 Mr. Matt Dial was present for an informal discussion, with Planning Commission members on plans for resubdivision on Nichols Street. Mr. Dial said that the area under discussion was zoned ti1-1 Industrial. Mr. Dial stated that he waited to sell business sites and that it would be comimercial rather than industrial. After a discussion of Mr. Dial's proposed plans, Commission Members told Mr. Dial that they could see no reason why he could ;not go ahead and apply for subdivision of this property. A discu§sion of the subdivision requirements and plat recordings of the five ( 5 ) mile zone around the City and the subdivision regulation jurisdiction. Chairman Parker cited the case of McQuillan and Smith where the Planning Commission waivered the development requirements, a-nd waivered this providing that the applicants did not further subdivide the property. Chairman. Parker stated that the applicants after receiving this v aiver from the Planning Comr,rissiora have now further subdivided their property, breaking the trust with the Planning Co -.-mission. Chairman Parser warned Commission members on the future problems which could arise if the Commission did not require the develop- ment of improvements on property located five ( 5 ) miles around the City, and the recording of such plats. Mayor Nix asked if a property owner could legally subdivide property by a metes and bounds discription. Planning Consultant Mr. Don Pruitt said that the matter should be referred to the Attorney General for an opinion. Mr. Pruitt stated that the Drainage Plans should accompany an application for subdividing by the developer, and that drainage plans should be fixed in the application -for subdividing. Chairman Parker asked Con,nission Members to think about this policy and come back at the next meeting of the Planning Commrission, with their ideas on the matter. Mayor James P. Nix made a motion that the Planning Comu-niscion not hear any more subdivision or zoning applications on Colony j Land except such application be presented by the Fairhope Single t Tax Corporation and a representative thereof be present to represent said request . Mr. Harford Field seconded the motion. Motion carried. i,Ir. Field asked Co:snissioa members to look over. the Proposed Amendment to the Zoning Ordinance to be discussed and acted t i upon at the April 5, 1976 meetin of the Planning Commission. k f j Chairman Parker asked Planning Commission members to keep t on reading as much as possible on the Coastal Board Zoning, since ! j approximately 70 % of the total defined as Coastal Zone will be i in Baldwin County.
