HomeMy WebLinkAbout12-08-1975 Regular Meetingy t THE FAIRHOPE PLANNING AND ZONING COMMISSION Minutes for Meeting December 8, 1975 The Fairhope Planning and Zoning Commission held its regular monthly meeting (a quorum was not achieved at the scheduled meeting date of December 1) on Monday, December 8, 1975, at 5:00 P.M., at the City Admin- istration Building, 387 Fairhope Avenue, Fairhope, Alabama, with Chairman John Parker presiding. The following members were present: Mayor James P. Nix, Mr. Harford Field, Mr. Chester Billie, Dr. Pierce Fredrick and Mr. Jack.Kirk. Members Ray Gibson, Cecil Pitman and Barney Shull were absent from the meeting. The minutes of the November 3, 1975, meeting were approved as recorded. I, The application of Mr. Alan Bradford for a building permit was pre- sented regarding property located east of Highway 98 and south of Paddock Estates just outside the southern corporate limits. Mr. Bradford's request was for the addition of two (2) more duplex units within his present -� complex. Mr. Bradford was also requesting that the Fairhope Planning Commis- sion recommend to the Fairhope City Council in their consideration of annex- \ ation, that this property be zoned R-4, with all R-3 requirements to be met / with the exception of the number of dwelling units per structure. Mayor James P. Nix made a motion that the Fairhope Planning Commission recommend to the Fairhope City Council that the Bradford property be zoned as R-4, stipulating all requirements of R-3 be met with the exception of the number of dwelling units per structure, in the City Council's consideration of the annexation of the Bradford property. Mr. Harford Field seconded the motion. Motion carried. II. The next item brought before the Fairhope Planning Commission was the application of Mr. 14. 0. Haas for a building permit. Mr. Haas request was for a third storage building on the property located at the northeast corner of Fairhope Avenue and Brown Street. This area is zoned M-1, Light Industrial. Mr. Chester Billie moved approval for the City Building Inspector to proceed with issuing a building permit to Mr. Haas. Mr. Jack Kirk seconded the motion. Motion carried. ZII. Four (4) applications by Olmpia Corte Dyas for rezoning of property bounded by Hwy. 98 downtown connector, four lane Hwy 98, and State Hwy. 104, along with land fronting on the northwest side of Hwy. 98 downtown connector, were presented with Mr. Carlton Niemeyer acting as the Dyas agent. This application was essentially the same as that presented one year prior and the appeal for rezoning the same land for which a considerable time as well as a special study session were conducted by the Commission in July,1975, in conjunction with the new Zoning Ordinance and District Map Public Hearing. The Comnissionlon these prior occasions,plus two prior applications in 1972 and 1973,has recommended to the Fairhope City Council denial of the rezoning LegUGSt3 .I^. this application the land area is divided into four contiguous parcels with different desired land use as follows: The first application presented was for rezoning from R-1 to B-4 that portion of the property facing on the north side of Highway 104, in order to construct a business and professional office complex. The second application was for rezoning of property from R-3 and R-1 to B-4, for property located on the northwest side of Hwy. 98 downtown connector, in order to construct Business and Professional Offices. -2- The third application was for a change in zoning from R-1 to B-1 for property located on the west side of Hwy. IW four lane, in order to construct a shopping center. if The fourth application was for rezoning of property from R-1 to R-3 in order to construct - Multi --Family Residences at the west end of the approximate 40 acre triangular parcel. Mr. Niemeyer discussed the four (4) applications with the members of the Fairhope Planning Commission, and acting as the Dyas agent presented a letter to the Planning Commission stating that the authority was hereby granted to Mr. Carlton Miemeyer to act as the Dyas agent with regard to the current proposed rezoning of Dyas property at the intersection of Highway 98 Business Route and Alabama Highway 104. Mr. Niemeyer discussed at length the proposed changes of the Olmpia Corte Dyas rezoning applications, and requested a public meeting on the rezoning of this property. Mr. Niemeyer was assured that there would be a joint public meeting of the City Council and Planning and Zoning Commission with regards to the rezoning of the Olmpia Corte Dyas property. Mr. Harford Field made a motion that the Planning Commission recommend to the City Council denial of all four (4) applications of Olmpia Corte Dyas for rezoning for the following reasons: 1. The commercial development such as another shopping center would jeopardize the economic health of our now progressive downtown shopping district. 2. The commercial development such as another shopping center would require that this extremely high and rolling and wooded property would have to be denuded and bulldozed down to near level with the highway, and thus at the primary entrance to our City create a varitable eyesore and detri- ment to the quiet residential character of the community. 3. Any development other than low density residential would hurt the property value of the high grade residential community, Colonial Acres, immediately across Highway./ot/, 4. The property, with its wooded and rolling topography lends itself admirably, in my opinion, to the very kind of resi- dential development with access to lots by way of interior drives, that the applicant has laid out for her property on U.S. 98, just north of the City limits. 5. The rezoning application is a drastic departure from the recently developed comprehensive plan for Fairhope's land use and would nullify several of the major tenets of this Plan. 6. This commercial development would create strip commercial zoning on the two major through traffic ways serving Fairhope, thus jeopardizing the function of the roadways. Mayor Nix seconded the motion. Motion carried. There being no further business to come before the Planning Commission the meeting was adjourned.
