Minutes for Meeting November 3, 1975
The Fairhope Planning and Zoning Commission met in regular
session on Monday, November 3, 1975 at 5:00 P.M., at the City
Administration Building, 387 Fairhope Avenue, Fairhope, Alabama
with Chairman John Parker presiding.
The following members were present: Mayor James P. Nix, Mr.
Harford Field, Mr. Cecil Pitman, Mr. Ray Gibson, Mr. Barney Shull,
Mr. Jack Kirk, and Dr. Pierce Fredrick. Member Chester Billie
was absent from the meeting.
The minutes of the October 6, 1975 meeting were approved as
recorded.
The first item brought up was the resubdividing of one ( 1 )
lot of Mr. Matt Dial in the subdivision at Gayfer and Blue Island,
that being the one ( 1 ) lot at the southwest corner. Mayor Nix
moved to authorize the signing of the resubdividing of the one lot.
Mr. Harford Field seconded the motion. Motion Carried.
The application of Mr. J. Russell Kilgore for a change in
zoning from R-2 Medium Density Singlp Family Residential District
to R-4 High Density Dwelling Residential District for the property
identified as an acreage parcel; located on the west aide of Section
Street at the northwest corner of Section and Pecan Streets was pre-
sented. The applicants proposal was to construct a townhouse type
development having 52 units.
This being the date set for public hearing on Mr. Kilgore's
request for rezoning, several property owners within 300 feet of
Mr. Kilgore's property were present at the meeting.
After Mr. Kilgore explained his tentative plans to the members of
the Planning Commission, the meeting was turned over to the public
for questioning. Several adjacent property owners were concerned as
to whether or not a fence would be erected around this property.
Mr. Kilgore said that a fence would be erected and that the area
would be landscaped in such a way as to enhance the property. After
other questions ranging from the traffic situation to the type of
residents who would occupy the apartments Chairman Parker asked for
a show of hands by all people within 300 feet of Mr. Kilgore's property.
The vote showed that seven ( 7 ) of the property owners within 300 feet
were in favor of granting the change in zoning and five ( 5 ) were op-
posed. Chairman Parker than asked for a show of hands of all people pre-
sent , not just the ones within 300 feet of the property who were in favor
or opposed to Mr. Kilgore's property being rezoned. Again, those in favor
outnumbered those opposed.
Mr. Harford Field asked Mr. Kilgore if there was a possibility that
having his property zoned R-3 instead of R-4 would meet his require-
ments, and at the same time would allow for a less dense development.
Mr. Kilgore said that if there was a possibility that R-4 would not be
approved, that he would be satisfied with a change in zone to R-3.
Mayor James P. Nix moved to deny the request of Mr. J. Russell..Kilgore
for a change in zoning from R-2 to R-4. Mr. Ray Gibson seconded the motion.
Motion Carried.
Mr. Harford Field moved to approve a change in zone for Mr. J. Russell
Kilgore's property From R-2 to R-3. The motion died.for l?ck of a, second.

The continued application of Mr. A.M. Gates for a preliminary
and final plat approval of Fairwood Subdivision No.-18; a subdivision
of acreage into eleven ( 11 ) lots; located at Wilfred Street extended
to an intersect with Kurlane Street was presented.
Mr. Gates Application was continued for the applicant to provide the
following:
1. A preliminary plat of the entire acreage of Fairwood Subdivision
showing all streets and lots.
2. A preliminary plat having contours at five ( 5) feet intervals.
3. A vicinity map showing the proposed•location of the subdivision.
4. A metes and Bounds description of subdivision which incorporates
Section;xownsh£p) and Range.
5. A graphic scale.
6.' Location, Purpose and dimensions of proposed.easements.
7:'Plans of proposed utility easements.
Mayor James P. Nix made a motion to give preliminary approval of the
eleven ( 11 ) lots , with final approval subject to the following:
1. Submitting the appropriate certificates relative to certification
of the approval of water and sewerage systems as indicated by the
subdivision regulations.
2. The applicant posting a performance bond to assure the installation
of street improvements and utilities.
Mr. Barney Shull seconded the motion. Motion Carried.
Mr. Mike Ford was present at the meeting to informally discuss the
dividing of acreage into lots. Due to the absence of some determined plans
the Planning Commission was unable to advise on the division of the
acreage at this time.
The application of Mr. Robert Dade for preliminary and final plat
approval of Oakwood Park Subdivision, Unit Two•; a survey and subdivision
of approximately 1.5 acres into one ( 1 ) lot; located on the south side
of Greenwood Avenue ( Extended approximately 150 feet west of the " T "
intersection of Greenwood Avenue and Myrtle Street, was presented.
Mayor James P. Nix made a motion to approve Mr. Dades application for
preliminary and final plat approval subject to the following:
1. The contour lines and proposed location of the dwelling being
deleted and not appearing on the final plat.
2. The final plat having the appropriate front set back line shown.

3. Either installing the required improvements or posting of bond for
the installation of same.
Further the applicant should realize that before considering the sub-
dividing of additional lots as they relate to the master plan, he will be
required to submit a preliminary plat in compliance with the Subdivision
Regulations for the Commission's review and approval.
Mr. Cecil Pitman seconded the motion. All'.members-.voted in favor of approval
except Mr. Harford Field who was opposed. Motion Carried.

VI The application of Ack Moore,encyineering agent for 1•Ir., run-,
for Preliminary and Final. plat approval of a subdivision of acreage
into two lots, located on the north side of North Street at the
intersection of Summit Street,was presented. Mr. Parford Field
made a motion to grant preliminary and final. plat approval of. Mr..
Bung's application for re -subdivision of land, and also authorizing
the Building Inspector to grant a building permit if the lots and
building positions are situated the way it is stated in Mr. Bunry's
application. Mr. Barney Shull seconded the motion. Motion Carried.
VII 11r. Jack Younkers was present at the meeting to discuss his
contention of an urgent need for housing for the elderly in the
Fairhope area. Mr. Fred hood, Architect, was also present. 'Mr.
Younkers said that he had looked for several locations in the Fair -
hope area for this project, and at present had three sites under
consideration. Mr. Younkers said that the project would be designed
after the Twin Towers in Mobile, with Mr. Wood, the Architect
who designed the Tiro Towers, to do the designing for this project
as well. Mr. Younkers stated that the program would be very
comprehensive, allowing for recreation, transportation and a food
program. lie. further stated that he had the support of Saint James
Church as far as providing counseling, visitation, and volunteer
work.
Mr. Earford Field asked 1Ir. Younkers if he had considered an area
on Greeno Road which would be close to shopping centers and the
medical clinic, a.11_owino for the Maximum convenience for the elderly.
Mr. Younkers said that he would check further into possible loca-
tions for this project which would hive maximum convenience to the
elderly. It was the general consensus of: the Planning Commission
that a need for housing for the elderly did exist in the Fa_irhoi')e
area, but should not be located in the proposed Bon Secour-Rosa.
Avenue area presently R--2. A requested endorsement by Mr. Younkers
of the need for government subsidized housing for the elderly was
not felt justified by the Commission.
VIII 1-Ir. Carlton b?iemeyer presented several. plans for subdivision
applications for iilfornal. discussion. _4r. Niemeyer said that there
was an acreage on. the north cast corner of Oherf: and `�Iosely Road on
which he would file preliminary application before the next Planning
Commission meeting, for subdivision. His planwas contested as to
public right -of -,Tay r.equi.renients.
;Ir. 'Jietneyer also said that there was an acreage of three and
a half acres near the e-it of Grand and Ingleside which had been
previously approved. TT.ovever, the new zoning ordinance has altered
the requirements of r--3 making his previous plans not in accordance
with the new zoning ordinance. fir. Niemeyer said that lie would sub-
mit an application on this acr.ea`e for the next Comi;ii.ss:ion meeting,
whereby, tie would try to resubdivide in order to meet the new
zoning; requirements, or that he ,,iould seek nermission to proceed with
the e:;:isti.n subdivision lot sizes from the Board of 9.oni_nR Adjnsti:ients.
Ir. i ietre,Ter. also said that the })Vas property would be presented agni.n

There being no further business to come before the Planning Commission,
the meeting was adjourned.
