THE FAIRHOPE PLANNING AND ZONING COMMISSION
Minutes for Meeting October 6, 1975
The Fairhope Planning and Zoning Commission met in regular
session on Monday, October 6, 1975, at 5:00 P.M. at the City
Administration Building, 387 Fairhope Avenue, Fairhope, Alabama
with Mr. Harford Field presiding in the absence of Chairman John
Parker.
The Following members were present: Mr. Chester Billie, Mr.
Jack Kirk, Mr, Cecil Pitman, Dr. Pierce Fredrick and Mr. Ray
Gibson.
Mayor James P. Nix and Mr. Barney Shull were absent from the
meeting.
The minutes of the September 8, 1975 meeting were approved as
recorded.
The application of Mrs. Alice Lawrence, with Mr. Eugene Bosby
acting as the Lawrence's agent, for a change in zone from R-2
Medium Density Single Family District to R•5 Mobile Home Park District
was presented. This property is identified as an acreage parcel
situated in Section 20, Township 6S, Range 2E; located on the south
side of East Middle Avenue approximately 325 feet east of the southeast
corner of Middle Avenue and Young Street.
Mr. Lawrence was present at the meeting to represent this application.
The Planning Commission told Mr. Lawrence that before they could act upon
the application that the application would have to be in compliance with
the applicable provisions of the Fairhope Zoning Ordinance. One of these
provisions requires that all mobile homes are located in a Mobile Home
Park as defined by the ordinance. It was recommended to Mr. Lawrence
that a Mobile Home Park Plan, along with a plan to assure adequate
water and sewerage which would meet the approval of the Fairhope Planning
Commission and the Health Department, be prepared and submitted as an
ammendment to the present application.
In a review of Mr. Alley's agreement to restrict ingress and egress
to Section Street on his lots on Pensaoola Avenue prior to recommending
rezoning to the City Council from R-2 to B-1, a copy of the Warranty
Deed, which will be included in the minutes of this meeting, was given
to the Fairhope Planning Commission stating that the Grantee hereby
agrees that there will be no ingress or egress of traffic off of Section
Street, and that no commercial structure will be erected on Lots 19 and
20 providing a covenant running -with the land.
The application of Mr. A.M. Gates for Preliminary Plat Approval
of Fairwood Subdivision No. 18, a subdivision of acreage into 11 Lots;
located on Wilfred Street extended to an intersect with Kurlane Street,
was brought up for discussion. Mr. Ray Gibson moved that before any
consideration of Mr. Gates application for preliminary plat approval

could be given, the following requirements recommended by the Planning
Consultant Mro Don Pruitt be provided as follows:
1. A preliminary plat of the entire acreage of
Fairwood Subdivision showing all lots and streets.
2. A preliminary plat having contours at five ( 5 )
foot intervals.
3. A vicinity map showing proposed location of subdivision.
4. A meets and Bounds description of subdivision which
incorporates section; township and range.
5. A graphic scale.
6. Location; purpose and dimension of proposed
easements.
7. Plans of proposed utility layouts.
also, that a letter be sent to the applicant by the Planning Board Secretary
stating these requirements. Mr. Chester Billie seconded the motion.
Motion Carried.
The application of the City of Fairhope for a change in zoning from
B-2 General Business District to B-1 Local Shopping District, for the
north tier of lots situated on the south side of Morphy Avenue between
Summit and Church Streets was brought up for discussion. Mr. Cecil Pitman
moved that the Planning Commission recommend to the City Council that the
area identified be rezoned from B-2 to B-1. Dr. Pierce Fredrick seconded the
motion. Motion Carrded.
A review of the Capital Improvements Program and Capital Budget followed.
After several of the Commission members voiced their feelings on various
items in the Capital Improvements Program and Budget, it was decided that the
Fairhope Planning Commission would like to have a study session in order to
evaluate this plan and come up with a schedule of revised priorities to
recommend for this program. The Commission set Thursday, October 30, 1975
as the date for the special study session, with time and place of meeting to
be decided at a later date.
There being no further business to come before the Planning Commission,
the meeting was adjourned.
