Monday, cecember 2, 1974, at the City Administration Building,

387 Fairhope Avenue, Fairhope, Alabama with the following members
present: Chairman John Parker, Chester Billie, Dr. Pierce Frederick,
Jack Kirk, Cecil Pitman, Harford Field and Councilman Barney Shull.
Mayor Nix and Ray Gibson were absent.
Motion by Councilman Shull, seconded by Harford Field that the
minutes of October 7, 1974 meeting be approved. Motion carried.
Claude Arnold and C. V. Pritchett were present with a preliminary
plat for sud-dividing three lots owned by Mr. Pritchett, located
in the Magnolia Beach addition to Fairhope. The lots are number
11 and 12 in Block 16. Don Pruett of the South'Alabama Regional
Planning Commission recommended to the Commission that they not
approve the application because it did not meet the minimum lot
requirements of 10,500 square feet and 75 feet frontage on the
street. Mr. Pritchett's lots consisted of 70 feet frontage and
120 feet deep. Motion by Dr. Frederick, seconded by Harford Field
that the application be denied. Motion carried.
The Commission discussed the draft of the proposed new.ordinances
recommended by Don Pruett. Cecil Pitman brought up the need for
flexibility'in the new ordinances concerning set backs for trees, etc.
It was decided that Don Pruett would draft provisions for ecological
and esthetic reasons into the new ordinance. Chairman Parker expressed
the need for the Commission members to study the new ordinance and be
ready to discuss in depth at the next regular meeting.

Therefore, the municipal planning commission has jurisdiction over
the subdivision and the subdivision is subject to its regulations.
Even if the County Subdivisions regulations that you mentioned
should be adopted, the jurisdiction of tho municipal planning
commission would not be affected. The Daphne Planning Commission's
five (5) mile extrater.ri•torial jurisdiction pertaining to sub-
divisions will still be applicable as provided by Title 37, Section
814, Code of Alabama 1940, Recompiled 1958.

Title 37, Section 798, Code of Alabama, Ilecompiled 1958,
provides,

"The planning cortunission shall adopt
regulations governing the subdivision
of la.d within izs jurisdiction. ."
Under this provi.sioai, the municipal planning commission

enforce its regulations wit:ni.n the fi.vc� (5) mile area and
should
not confine such enforcement to a sma.i.lur. .�xeu.
