Section Street in the Co un cil Chambers. Present: Lee Turner, Ch airperson; George Roberds, V ice-C hair; Bob C lark; Dick Charles; Bernie Fogarty; Jennifer Fid ler; Holli e MacKellar; Jonathan Smith, Planning Director; Nancy Milford, Planner; and Emily Bo ye tt , Sec retary Absent: Counc ilmember Di ana Brewer ; and Tim Kant Chairm an Lee Turner call ed the meeting to order at 5 :01 PM an d announced the meeting is being r eco rded. T he minutes of the February 3, 2014 meeting were consid ered and Dick Charles moved to accept the minutes as written and was 2nd by Bo b Clark. Mo tion carried unanimously. UR 14.01 Request of Southern Light for an 11.S2.11 Utility Review and approval of the proposed installation of approximately 3,0S0 linear feet of aerial and underground fiber optic cable to the existing tower at 20969 Bishop Road, Jennifer Johnson. The project wi ll run along the west side of B ishop Road from Fairhope A venue to the existing tower at 20969 Bishop Road. Jonathan Smith gave the staff report sayin g the project w i ll consist of 2,497 iinear feet of directional boring; 553 linear feet of ae ri al cabl e; and m anual digging to install the underground cable , handholes, and cable pedesta ls . Staff recommendation is to approve co nditi o nal upon the follow in g: 1. The applicant s hall compl y w ith the minimum requirements as stated by the City of Fairhope Bu ilding Official, Code Enforcement Officer, Publi c Works Director, Ga s Superintendent, and Water and Sewer Superintendent in the Staff Report ; and 2 . Any mechanical equipment should be painted munscll g reen. Dick Ch arles made a motio n to accept the s taff recommend ation to approve conditiona l upon the following: 1. The app li cant shall comply with th e minimum requirements as stated by the City of Fairhope Building Official, Code Enforcement Ofticcr, Publi c Works Director, Gas Superintendent, and Water and Sewer Superintendent in t he Staff R eport; and 2. SD 14.02 Public hearing to consider the request of the MS Group, LLC for Preliminary and Final Plat approval of the MS Subdivision, a 2-lot minor division, Dale Marston. The property is located on the east side of Wayn e Johnson Lane, just north of Co unty Road 32. Jonathan Sm ith gave the staff rep ort saying th e property is located in Baldwin County and is unzo ned. The subject propert y is approximately one acre and the applicant is proposing two half acre lots. Staff recommendation is t o approve contingent on the fo ll owing co nditions: 1. The note on the plat regarding setbacks sh all be ei ther corrected to the language from the C it y of Fairhope Subdivision Regulations or deleted; a nd 2. The square footages of the lots need to be t\~vi se d to reflect the corrected square footage for each lot. Dale Marston addressed the Comm ission sayin g the property currently has two hou ses on it and they are re qu esting the s ubdivision to allow t he current renter the ability to purchase one of the houses. Mrs. Fidler referenced t wo l etters of opposition that were received stating the property is not to be subdivided and Mr. Marston responded there are 147 March 10,20 14 Planning Co mmi ssion Minutes no deed restrictions for subdividing. Mr. Marston stated the property was purchased with one house existing and a second house was permitted and constructed 2000. He added Baldwin County has a lre ady approved the subdivision. Mr. Turner opened the public hearing. Having no one present to speak, he closed the public hearing. Dick Charles made a motion to accept the staff recommendation to approve contingent on the following conditions: 1. The note on the plat regarding setbacks shall be either corrected to the language from the City of Fairhope Subdivision Regulations or deleted; and 2. The square footages of the lots need to be revised to reflect the corrected sq uare footage for each lot. Bernie Fogarty 2nd the motion and the motion carried unanimously. UR 14.02 Request of the City of Fairhope for an 11 .52.11 Utility Review and approval of proposed renovations at the Fairhopers Community Park, Clay Adams of WA V Architects. The park is located at the northeast corner of Morphy A venue and Church Street, at 10 5 S. Church Street. Jonathan Smith gave the staff report sayi ng the City has contracted with Walcott Adams Verneuille Architects to prepare a plan for major renovations to the Fairhopers Community Park. The proposed playground/park is ADA accessibl e, whereas the current structures and park is not. The new equipment is updated and is said to be safer than the existing aging structures on the property. Staff recommendation is to approv~ the proposed design and renovations at the Fairhopers Community Park. Clay Adams of WA V Arc hitects addressed the Commission saying the ex ist in g park is 20 years old and is in need of repair and updates. He stated the renovations include replacing the wooden stru ctures with modern playground equipment while salvaging artwork and other pieces to incorporate into the renovated park , adding a sp lash pad where the teen recreation area is today on the park's south sid e on Morphy A venue , introducing a climbing net, and plans to add more gazebos throughout the park, where only on e is available today. The basic layout of the park is expected to remain the same w ith two areas on the north side dedicated to toddlers and preschoolers and another for 5-12 year old s with handicap accessible designs. New additions will include a rope- play area and a roughl y 2,000 square foot sp lash pad on the south side by Morp hy A venue and musical instruments. Mr. Adams stated the y will be keeping the artwork that is at the park including the handprint wall and the dinosaur. He outlin ed the proposed demolition and construction dates and stated they plan to have the new park opened June 1st . Mr. Charles asked what makes this safer for the children and Mr. Adams s tated the play areas will be covered with a rubber surface that is ADA compli ant. Mrs. Fidl er and Mr. C lark questioned the material 's maintenance and warranty. Mr. Adams stated the surface is a spongy material and explained it was designed for thi s type application and is being used a ll over. Dick Charles made a motion to accept the staff recommendation to approve the proposed design and reno vations at the Fairhopers Community Park. Bob Clark 2 nd the motion and the motion carried unanimously. New/ Old Business Comprehensive Plan -Mr. Smith announced there will be a Co mprehen sive P lan Update Committee meeting on Thursday, March 20, 2014 at 5:00 pm in the Delcharnps Room at the City Municipal Co mpl ex . 2 149 March 10 . 201 4 Plannin g Commi ssio n Minut es Having no further business , Jennifer Fidler moved to adjourn and was 2nd by Bob Clark.
