HomeMy WebLinkAbout09-04-2012 Planning Commission MinutesSeptember 4. 2012 Planning Commission Minutes The Planning Commission met Monday, September 4th , 2012 at 5:00 PM at the City Administration Building, 161 N. Section Street in the Council Chambers. Present: Lee Turner, Chairperson; Tim Kant; Bob Clark; Dick Charles; Debbie Quinn; Jonathan Smith, Planning and Building Director; Emily Boyett, Secretary; and Nancy Milford, Planner Absent: George Roberds, Vice-Chair; Gary Moore; Jean Wilson; and Jennifer Fidler Chairperson Lee Turner ealled the meeting to order at 5 :07 PM and announced the meeting is being recorded. The minutes of the August 6th , 2012 meeting were considered and Dick Charles moved to accept the minutes as written and was 2nd by Bob Clark. Motion carried with two abstentions by Tim Kant and Debbie Quinn. Mr. Turner stated the Commission was waiting on the arrival of an additional member; therefore, case UR 12.08 will be heard first. UR 12.08 Request of Mediacom for an 11.52.11 utility review and approval of the proposed underground installation of approximately 2,848 linear feet of cable along Royal Lane in ldlewild Subdivision, William Huggins. The project will run along the north and south sides of Royal Lane in Idlewild Subdivision. Jonathan Smith gave the staff report saying the project will consist of directional boring, trenching, and the placement of cable pedestals. Staff recommendation is to approve conditional upon the following: 1) The applicant shall comply with the minimum requirements as stated by the City of Fairhope Building Offieial, City Horticulturist and Code Enforcement Officer in the staff report. 2) Any mechanical equipment should be painted Munsell green. Mr. Turner opened the floor to public comments. Jonas Lyborg, President of Idlewild POA, stated this subdivision was developed in 2002-2003 and there are problems with access of internet service. He said potential home buyers expect to be able to have internet, cable, TV, and telephone service available and he believes that Fairhope is lacking in this area. He said there have been five new homeowners in Idlewild this year and three of them work from home and the lack of availability for internet service has been an issue. Mr. Lyborg stated he fully supports this request and he hopes the City will work to make sure these services are available and adequate for Fairhope. Mr. Clark recommended Mr. Lyborg contact the Alabama Public Service Commission and express his concerns to them because they regulate these issues. Dick Charles moved to accept the staff recommendation to approve eonditional upon the following: 1) The applicant shall comply with the minimum requirements as stated by the City of Fairhope Building Official, City Horticulturist and Code Enforcement Officer in the staff report. 2) Any mechanical equipment should be painted Munsell green. Tim Kant 2nd the motion and the motion carried unanimously. There was discussion regarding the lack of a quorum to hear a subdivision. Staff stated a special meeting vvill be scheduled to hear case 12.05 Battles Trace at the Colony as soon as possible. All advertisement requirements \Vill be met and staff will notify the Commissioners and the applicant once a date has been set.
