HomeMy WebLinkAbout04-01-1974 Regular Meetingy The Fairhope Planning and Zoning Commission met in regular session on Monday, April 1, 1974 at 5:00 P.M. at the City Administration Building, 387 Fairhope Avenue, with the following members present: Chairman John Parker, Mayor James P. Nix, Councilman Sam E. Box, Dr. Pierce Frederick, Mr. Chester Billie, Mr. Cecil Pitman, Mr. Jack Kirk and Mr. Richard Pruitt, Planning Consultant. Absent : - 1N1r. darford Field and Mr. iiay Gibson. Minutes of the previous regular meeting were approved. CASE NO. 5-3-74 - Application of Eastern Shore Builders, Inc. for Preliminary and Final approval of Rosa Acres located on Greeno load north of Edwards Avenue. Motion by Mr. Pitman seconded by Mr. Box that Commission grant preliminary approval of Rosa Acres and Final approval subject to Planning Consultants seven stipulations being met prior to ,Secretary's signature on Final Plat. Motion carried. The seven stipulations recommended by the Planning; Consultant are: 1. Section 509.6.4 - Graphic scale 2. Section 509. - The blocks in the proposed subdivision being assigned a block number. 3. Section 509.6'.7.- A 30 feet building set back .line in conformity with the Zoning Ordinance. 4. Section 509.6.10 - A Ti feet easement for drainage and utilities and, other purposes being provided along the rear of all lot lines. 5. Section 509.6,13 - Certificate showing that the applicant is the legal owner of the land, and lie formally dedicates all streets, rights -of -way and any other sites for public use. 6. Applicant posting bond to insure the installation of the required improvements; or 7. Constructing the required improvements prior to the Secretary signing the final plat. CASE NO. S-4-74 - Application of Foreman and Schuster, !no. for Preliminary and Final Plat approval of the East of the Sun Sub- division located on the East side of Greeno Road, South of Nichols Street, outside the City Limits of Fairhope. Motion by Mr. Pitman seconded by Mayor Nix that the Commission grant Preliminary approval of East of the Sun Subdivision and re- commend Final approval upon compliance of five recommendations of the Planning Consultant plus a letter from the Subdivider requesting annexation into the City. Motion carried. The five recommendations of the Planning Consultant are as follows: 1. Reference to zoning designated for the various lots,being removed from the Final Plat 2. The following being shown on the Final Plat: a. Section 509.6.4 - Graphic scale b. Section 509.6.6 - Block numbers where applicable o. Section 509.6.10 - Location dimensions and purpose of all easements; a 71 feet easement being indicated along the rear of all lot lines. d. Section 509.6.13 - Certificate showing that the applicant is if L1 owners of the land, and that he _J formally dedicates all streets, rights -of -way, and any other site for public use. 3. Applicant posting bond to insure the installation of the required improvements; or, 4. Constructing the required improvements prior to the Secretary signing the Final Plat. 5. Dedicate 40' right-of-way along Lots 15, 179 18 & 19 for future widening of Greeno Road. Chairman Parker reported that Mr. Carlton Niemeyer had withdrawn his application for rezoning the Dyas property since the Attorney General has ruled that Ordinance #517 is valid. Ordinance # 517 prohibits a person, whose application for rezoning certain premises has been denied from reapplying for rezoning of the same premises until after the expiration of one year from date of denial. Mr. Pruitt, Planning Consultant, reported that a Current Lend Use Map would be mailed to each Commission member for study before the next meeting of the Commission. Chairman John Parker proposed a study meeting on Monday, April 15, 1974 at 5:00 P.M. at the City Administration Building. Shoreham Development was discussed but no action taken at this time.
