1974 at 5:00 P.M. at the City Administration Building with the
follovin members present: Ch&Irman John Parker, Sam Box, Chester
Billie, V Pierce Frederick, Harford Field, Ceoll Pitman, Jack
Kirk and Bay Gibson, Absent: Mayor James P. Nix.
Minutes of the previous meeting were approved.
Case No. Z-2-74 - Bequest of Glenn Ingersoll to rezone property
on Greeno Road from Hr-1 to B-1 in order to build Appliance Store
with air conditioning and refrigeration shop in rear. Mr. Ingersoll
stated that he had owned the property for approximately 25 years,
business seemed to be going in that direction and property owners
joining his property had no objections to the change in Zoning. Those
opposing requested that restrictions be put on Greeno Road north of
Fairhope Avenue by not allowing any more b-1 areas and reserve the
area for Residential. They further requested that the Planning Comm-
ission make a Master Development plan and were informed that the
Commission is now in the process of making such plan. Vote in general
showed 9 for and i3 against the rezoning. Mr. Ingersoll then asked
for a vote of those in the immediate vicinity or within 300 feet of
his property. Results of this vote: For: 6, Against: 2.
CASE NO. Z-3-74 - Rezoning of Dyas property which was held for accept-
ing or hearing at previous meeting until the Commission could get a
clarification from the Attorney General on the Ordinance adopted by
l� the City Council requiring a one year waiting period before re -applying.
The Attorney General was of the opinion that the Ordinance was valid
but did not rule on whether the Ordinance was valid only from date of
adoption or retroactive. Motion by Mr. Box seconded by Mr. Field that
Commission further delay entertaining or rejecting application for
rezoning Dyas property until the Commission can get further clarifica-
tion from the Attorney General. Motion carried.
A group of resident tot with thb Commission protesting the cutting
of trees, especially on the Bay Front, and requested that the Comm-
ission consider recommending to the City Council the need for a
Landscape Ordinance to preserve trees and natural beauty of the City.
Motion by Councilman Box seconded by Clr. Field that the Commission
make a study of property to be rezoned, that trees be saved and
property rezoned be landscaped to protect adjacent property owners.
Motion carried.
Motion by Mr. Gibson seconded by Mr. Field that application of Glenn
Ingersoll to rezone property on Greeno Road to B-1 be denied as re-
commended by the Planning Consultant for the following reasons:
1. The change requested would create an isolated district
unrelated to the existing zoning; that is, it would be "spot zoning".
2. It appears that there is considerable amount of land in the
City which is already zoned for business which is vacant or used for
purposes other than business.
3. The change would be contrary to the established land use
pattern which consists of single family development, generally north,
south and west of the area under oonsideration.
Motion carried.
