HomeMy WebLinkAbout10-13-1973 Special Called Meetingr7 ,kI- S rATE OF ALABAMA CITY OF FAIRIiOPE The FRIrhope Planning and Zoning- Commission met in special called session, Saturday, October 13, 1973 at 9:00 A.M. at the City Adm- inistration Building, with hr. Cecil Pitman, Kr. Chester Billie, "ex. Sam Box, i,s. Jack Kirk, Mr. James Nix and AIr. John Parker present. I. BUILDING PSRi,14IT ; ¢ In reference to the 21 apartments to be built at 208 Fairhope Avenue, a motion was made and carried to grant a building permit subject to the following: a. A screening fence and planted shrubbery will be required along the rear lot line (south ling) as a buffer between the abutting 3_2 Zone. b. It is strongly suggested that the apartment structure be moved ten (10) feet to the North to enable an additional AI five to ten parking spaces on the South end of the lot. It is Aelt that the present parking provisions are inadequate to meet the needs for 21 units( 1i spaces per unit). f II. In reference to the commercial convenience food structure on the Southeast corner of Greeno Road and Morphy Avenue: It was moved and carried to grant building to the plans submitted with the entrance s apermit subject p feet of additional right-of-way marked inred tonthefDioteplan. The Commission members present then discussed with the City Council members present (Barney Shull, Ed Bishop, 011ie Deese) the eastern Shore Shopping Center expansion and rezoning of Ifa reported that 1n the opinion of the City Attorney t9 hecondit,ions a'tt_ ached to the rezoning were not legally enforceable. The Commission members present generally agreed that we would have to accent whatever the City Council eould'secure from the Developer among the conditions outlined in the rezoning recommendation. It was a new Zoning Ordinance should be thoroughly studiednerally alonli witheed otherat Possible procedures which would allow the City to secure on a uniform basis, those development features which the Planning Commission felt were essential Community needs. Fir. Pitman suggested that we should not rely solely on the legal opinion of'the City Attorney in this specialized field but should also seek a written opinion from the City's' Planning Consultsnt and those legal authorities at his access. It was agreed that the Chairman pursue this question but that the City T be free to proceed in the Community's interest on the immediate matterl Of the Eastern Shore Shopping Center.
