The Fairhope Planning and Zoning Commission met in regular session
at the City Administration Building, 387 Fairhope Avenue, Monday,
October 1, 1973 at 5800 P.M. with the following members presents
Chairman John Parker, Mayor James P. Nix, Councilman Sam E. Box,
Mr. Jack Kirk, Dr. Pierce Frederick, Mr. Chester Billie, Mr. Cecil
Pitman and Mr. .day Gibson. Mr. Harford Field being absent.
Minutes of the previous meeting were approved as amended.
I. Commission agreed to hear request of Mr. J. V. Cummings and
Mr. Matt Dial for rezoning since their application was submitted
In time for this meeting but was not advertised and the City Council
Is required to hold public hearing on rezoning application. Mr.
Cummings presented the request to rezone from R-2 to B-2 in order
to convert residence into office and general business. Motion by
Mr. Pitman seconded by Mayor Nix that the Commission recommend to
the City Council the rezoning from R-2 to B-2 the following described
propertyi
Lot 32, Block 1 according to a resurvey of Lot 26,
Block 1 of Volanta, which resurvey is recorded in
Map Book 3, Page 72, Baldwin County, Alabama.
Property is located at 805 N. Section Street.
Dr. Pierce Frederick abstained from voting. Motion carried.
II. Mr, Carlton Niemeyer, as agent for Olympia Corte Dyas, resub-
mitted a revised application for rezoning of the Dyas property
located at the intersection of Highway #104 and Highway #98, Parcel A
to be rezoned A-3 and Parcels B & C to be rezoned B-1 with apartments
and condominiums in Parcel A, Business and Professional Offices in
Parcel B and Retail Shopping Center 1n Parcel C.
Motion by Mr. Kirk seconded by Mr. Gibson that the Commission re-
commend to the City Council that the rezoning of Dyas property be
denied for the following reasonsi
1. This spot zoning request is in conflict with key -parameters
of the present and past development plan and zoning effort for the
City of Fairhope.
2. Commission members felt it unwise to approve such a major
change in the developmental plan of the City without benefit of the
new comprehensive plan presently under study.
3. The effect of the proposed development on the adjacent R-1
Colonial Acres area and the level of opposition by these residents
was a considerable factor in the Commission's consideration.
4. The Applicants should develop the large acreage under their
control adjacent and in the vioinity of the proposed commercial
shopping center in order to sustain a complete neighborhood develop-
ment which would be more supportive of this shopping center on the
northern fringe of the City.
Mr. Kirk emphasized subsequent to his motion the need to expedite
the work on the Comprehensive Plan.
III. Chairman Parker reported on his meeting with Mr. McWilliams
of Mitchell Corp. and Fir. Jim Wilson of the Alabama State Highway
Department regarding rezoning restrictions of the Eastern Shore Shop-
ping Center, Nir. McWilliams had agreed to meet with the Commission

along with excerpts from highway design book.
By telephone poll, it was determined 7 of 9 commission members did
not desire to hold a public hearing for the Dyas rezoning application to
be discussed next Monday. A recommendation will be made at that meeting
unless there is reason to delay.

Re: Controlled Access Highways
Dear Sir:
Further to our telephone conversation on controlling or limiting access on
U. S. 98, Greeno Road, from Alabama 104 to Nichols Street.
Attached is a copy of Chapter VI, Controlled Access Highways, taken from the
latest design book, A Policy on Geometric Design of Rural Highways, published
by the American Association of State Highway Officials and a copy of right-of-
way widths for at grade expressways taken from the companion, urban, AASHO
design book.
The present right-of-way width for the above subject length of highway is
80 feet. As you can see the very minimum recommended width for a four -lane
facility with two frontage roads is 135 feet.
Controlling access by Four -laving and service roads is just one method. The
other methods are explained in detail on the attached sheets; in any case
additional right-of-way will be required.
When you finish reading this attached material and you have any questions,
please call and we can discuss or pursue this further.
