HomeMy WebLinkAbout07-05-2006 Planning Commission MinutesThe Planning & Zoning Commission of the City of Fairhope met Wednesday, July 5, 2006 at 5:00 PM in the Delchamps Room of the Fairhope Municipal Complex Present: Richard Charles, Chairman; Tim Kant, Dan McCrory, Bob Clark, Gary Moore, Ed Brinson, Cecil Christenberry. Gregg Mims, Planning Director, Jonathan Smith, Planner and Betty Rivenbark, Secretary. Absent: Lee Turner, Jean Wilson Chairman Charles announced that Ordinance No 1304 was adopted by the Fairhope City Council at its meeting on June 26, 2006, and that it was placing a moratorium on the filing of subdivision applications for a six month period until December 31, 2006 and in support of that ordinance the Planning Commission was signing a Resolution with the same terms as the ordinance (Copy attached) and exemptions would be family subdivisions, and replats, for the same period, until December 31, 2006. He asked for a motion to ratify and confirm that we were in agreement with City Council action. Gary Moore moved to sign Resolution, Ed Brinson 2nd the motion and it carried unanimously. Chris Gill of Hand Arendall was here and spoke saying that this action will stop all new subdivisions for a period of six months but anything already submitted will not be affected to include: request for informal review; application for preliminary plat approval; or application for final plat approval, also, family subdivisions, and replats providing such subdivisions do not materially impact the issues sought to be addressed during the moratorium. Gregg Mims introduced Jonathan Smith, one of two new planners that has been hired, and said they will be working hard the next six months. He said a special meeting has been planned for July 17th at 1:00 PM and Glen LeRoy will be here to discuss changes to the comprehensive plan. The minutes of the June 5, 2006 meeting were duly adopted on motion by Bob Clark, 2nd by Ed Brinson and unanimously carried. SD06.30 Request of Arnold & Associates for Approval of Point Place Subdivision, a minor subdivision generally located on the north side of Battles Road east of Point Clear Court. Gregg said the property is located outside the City and is not zoned. It contains 5.21 acres and a 4 lot subdivision is planned and they have petitioned the city for annexation. A waiver of the drainage calculations has been requested. Staff recommendation was to approve with the alternate drainage plan based on the soil conditions and the hydraulic study submitted. Steve Dunnam of Arnold & Associates represented the owner and explained the proposed hydraulic detention/retention system where runoff would be retained on each lot underground and said they contracted with an outside engineer on Planning & Zoning Commission July 5, 2006 - Page Two this project. All questions answered satisfactorily, a motion was made by Ed Brinson to approve, Dan McCrory 2nd the motion and it carried unanimously. SD06.32 Preliminary Plat Approval of Magnolia Commons Subdivision request of Hutchinson, Moore & Rauch(Generally located on the east side of County Road 13 between County Road 48 and County Road 30) Gregg reported that the property is not located in the city and is not zoned. It contains 19.39 acres and 54 lots are proposed with a village subdivision plan. Site plan was given at the May 2006 meeting. Staff recommendation was to approve. In discussion Dan McCrory questioned Scott Hutchinson about where proposed detention ponds were located and told him that it looked like they were encroaching on at least where three city wells are located and asked him to relocate not be in northeast corner. Scott said he would do whatever is necessary. Further discussion led to a motion by Dan McCrory to approve subject to the city signing off on placement of pond and geologist report on the plat. Ed Brinson 2nd the motion and it carried with one abstention by Gary Moore. SD06.37 Preliminary Plat approval for Fairhope Falls Subdivision Phase 1A, 1B and Two Request of EDS Olsen & Assoc.(Generally located on the southeast corner of Highway 104 and Langford Road) Gregg in his report said that this property is not located in the City and is not zoned. The phases proposed contain approximately 120.54 acres and 150 lots. A village subdivision is proposed. He said the overall site plan contains 295 acres and 538 lots. Staff recommendation was to table until the flow model issue has been resolved. Dan McCrory said he had a two hour meeting today with Rusty Lomax and still has issues with the sewer/water pressure. He said he got ideas today on how to get water to them and keep the pressure up and get sewer to the treatment plant. He made a motion to table for 30 days to work all this out. Ed Brinson 2nd the motion and it carried unanimously. A lengthy discussion was also held on planned traffic pattern for this and Rusty Lomax told of traffic study they have already done and other measures they have taken to have first rate development. He emphasized that this would be done in phases, take seven to ten years. SD06.39 Final Plat approval of The Magnolias Subdivision, HMR. (Generally located north of Gayfer Ave. Ext., across the street from Whitegrove) Gregg reported that the property is located in the city and is zoned R-1 and contains 20.31 acres and 36 lots. He said a final inspection has been done and all punch list items have been addressed. He recommended approval. All questions answered satisfactorily Ed Brinson moved to accept staff recommendation. Dan McCrory 2nd the motion and it carried with one abstention by Gary Moore. Planning & Zoning Commission July 5, 2006 – Page Three SD06.40 Site Plan approval Berrington Place/ Moore Surveying(Generally located on the west side of Langford Road, south of Highway 104) Gregg in his report said this subdivision contains 90 acres and 225 lots are proposed. A village subdivision is proposed. Seth Moore addressed the commission and said they plan three phases, three different size lots. As before traffic was talked about as an issue, Seth said they plan a decel lane and will have 2 ½ residences per acre with restrictive covenants. Mayor Kant brought up that double frontage lots are shown and they need to go back and redesign, redraw have more landscaping, expand the space between the roads. The issues are the same with this subdivision as Fairhope Falls, water and sewer. Gary Moore said he meant no offense but all this and Fairhope Falls means to him is sprawl and too much density , look at the size and number of lots. Further discussion led to a motion by Ed Brinson to table for 30 days, Cecil Christenberry 2nd the motion and it carried unanimously. SD06.41 Site plan and Preliminary approval of Bay Pointe Subdivision by Moore Surveying( Generally located on the east side of Scenic Highway 98, immediately south of Paddock Estates) Gregg reported that the property is located in the City and is zoned R-1 and contains 2.1 acres and 12 units are planned which is a reduction from original plan. A private drive will serve the units and maintained by the property owners. Staff recommendation was to approve. When this was looked at before drainage was talked about and Seth had provided drainage calculations and said actually they would be taking water in their retention pond from other areas and they plan to put in a 24” pipe where before it was a 12”. There have been drainage problems in this area in the past but mostly due to the county not maintaining the ditches in the area. All questions answered satisfactorily, Bob Clark moved to give approval. Ed Brinson 2nd the motion and it carried unanimously. SD06.42 Minor Subdivision – Cedar Tree Estates, Moore Surveying (Generally located on the north side of Morphy Avenue east of Pecan Trace) Gregg said the property is located in the city and is zoned R-2. It contains 3.78 acres and a 3 lot subdivision is planned. There is an existing house on one of the lots and the other two will be accessed by a common driveway. Staff recommendation was to approve. Seth said this property drains to the north to an existing ditch. Discussion followed with resident Ben Raines saying he was not notified and it being determined that the county records have not been updated although there is a sign on the property regarding the zoning issue and the owners contacted him. He Planning & Zoning Commission July 5, 2006 – Page four asked what the zoning ordinance was on the setbacks required and was so informed. Ed Brinson moved to accept staff recommendation, Bob Clark 2nd the motion and it carried unanimously. 06.43 Review of Fairhope Public Utilities, 11.52.11 a proposed sewer line on Main Street to Veterans Blvd. Dan McCrory said they plan to install a 1200 linear feet of pipe for the Montrose sewer project and he moved to approve. Ed Brinson 2nd the motion and it carried unanimously. IR06.09 Informal Review - ES Design/Rester & Coleman Engineers of a proposed village subdivision The Plantation at Point Clear located at the northwest corner of County Road 32 and County Road 13. In staff interpretation Gregg said this contains 240 residential lots in 114 acres with 28.5 acres designated as open space and a commercial village, two detention ponds are planned. It is in the airport restrictive zone which they are aware of and the plans shows it will be built in three phases. Troy Strong represented the development. It was suggested putting the walkway through the development not around as shown on the drawing. A decel lane and traffic study were asked for and entrance/exit to the commercial area was talked about with a suggestion that they do a one way in and one way out on Hwy 32 with an entrance to the subdivision in the rear. Once again double frontage lots were shown and they were asked to take them out. Bob Clark asked that it be stated on the plat that this is a restrictive zone so there will be no question when the lots are sold. Gary Moore said once again he thinks it is too dense and sprawl.
