HomeMy WebLinkAbout08-06-1973 Regular MeetingM �I I II FAIRHOPE PLANNING AND ZONING COMMISSION MEETING August 6, 1973 The City of Fairhope Planning and Zoning Commission met in regular session at the City Administration Building, 387 Fairhope Avenue, Monday, August 6, 1973 at 5:00 P.M. with all members present. I. Chairman Parker welcomed Mr. Ray Gibson who was appointed to the Commission by the Mayor to fill the unexpired term of Mr. Amon Gates who has resigned. Mr. Gibson's term will expire May 25, 1976. II. Mr. Mike Ford, representing Mrs. Frances West, presented application for change of Zoning from R-1 to R-3, Lots 10 & 11 located at 211 South Section Street, in order to build duplex apartments. Motion by Mr. Box seconded by Mr. Frederick that the Commission accept application for public hearing to be held at the regular meeting of September 10, 197.3. Motion carried. III. The Fairhope Single Tax Corporation presented subdivision of the Eastern 1/2 of Block 47 of Magnolia Beach Addition, for final plat approval. Motion by Mr. Pitman seconded by Mr. Field that the Fairhope Single Tax Corporation be granted final plat approval on commitmdnt the Fairhope Single Tax Corporation clear and grade Chestnut Street right-of-way and install sanitary sewer and pay their share of paving street. It was further agreed that the Commission waive Performance Bond on unimproved street due to past performance of the Corporation. Motion carried. IV. Mr. Cecil Pitman requested building permit to build office building on corner of South Section and Belangee. Request met requirements as to zoning, off street parking, etc. Motion by Mayor Nix seconded .by Mr. Gibson that permit be granted. 6lotion carried. V. Mr. R. A. Boykin, Jr. presented Master Plan East and Master Plan West for Point Clear Villa, Inc. for subdivision approval. Property is located approximately 3/4 miles South of the City Limits of Fairhope on Highway 98. Motion by Mayor Nix seconded by Mr. Gibson that the Commission grant preliminary approval of Point Clear Villa West and amenities on Point Clear East with the provision that construction can prgceed but final approval withheld until requirements in compliance with State Law have been met by the Developer. Motion carried. VI. Mr. Ack Moore requested final approval on resubdivision of Lot 3, Parcel B of Green's Subdivision. Motion by Mr. Field seconded by Mr. Frederick that final approval be granted subject to owner posting Performance Bond and variance granted not requiring front set back line on Lot 1 to be shown on plat. No subdivision or rezoning applications accepted after ten (10) days prior to meeting date of Commission. 2. An application for rezoning is not in order until the Executive Secretary of the Comm ss on has been supplied the following by the applicant: a. 5 copies of a completed "Application for Rezoning" form. b. 5 copies of a drawing showing the configuration of the land area to be rezoned, its present zoning, adjacent land parcels with their -zoning, and a vicinity map. c. A listing of all present property owners within 300 feet of the edges of land parcel considered for rezoning. d. The prescribed application fee. J� An application for subdivision approval (preliminary or final) is not in order until the Executive Secretary of the Commission has been supplied the following by the applicant as outlined in Article V of the Subdivision Regulations: a.. Five (5) copies of a completed "Application for Subdivision Plat Approval". b. Five (5) copies of the proposed subdivision plat complete with all information stipulated in paragraphs of 507.1 c. A list of adjacent property owners. d. The prescribed filing fee stated in paragraph 506. 1. Copies of applications, along with agenda, to be mailed to Mr. Pruitt, Planning Consultant, immediately after 10 day cut off by Executive Secretary of Commission. 4. Recommendations from Planning Consultant are to be mailed to each Commission member, along with Agenda list supplied by Executive Secretary, by the fourth day prior to meeting date. 5. A Case No. 1s to be assigned to each Subdivision or Zoning Application by Executive Secretary. 6. ggzoning applications are to be automatically advertised -far -public off date_and__notices mailed to property owners within_90_f_eet. 4 --Y R August 6, 1973 Page Three 7. Adjacent property owners are to be notified on Subdivision applications by Executive Secretary. 8. Each rezoning application recommendation of the Planning Commission shall be passed on to the City Council accompanied by a statement explaining and supporting the action recommended. 9. Subdivision developers are to be requested to notify City as to Book Number and Page Number when subdivision is recorded. City to provide post paid card for return of information. Motion passed. VIII. Motion by Mr. Frederick seconded by Mr. Pitman that Par. 506 of Subdivision regulations be amended by fixing filing fee at $1.00 per unit on multi- family dwellings. Paragraph 506 to read as follows: 506. - Filin9 Fee. In order to defray the cost of notification, field and spe- cial. studies and recording on the city's base map, there shall be paid to the City Clerk at the time of submission of the preliminary plat either i) for single family dwellings, a fee of five dollars ($5) per lot for the first ten (10) lots; two dollars ($2) per lot for the next ten (10) lots, and one dollar ($1) per lot for each additional lot, or ii) for multi -family dwelling sites a fee of $1.00 per dwelling unit.... This amendment to be advertised for public notice as required for two weeks. Motion passed. IX. Motion by Mr. Pitman, seconded by Mr. Gibson, that Chairman of the Planning Commission be authorized to sign agreement with the Alabama Development Office naming South Alabama Regional Planning Commission to serve in consultant capacity in development of the first phase of .Fairhope's Comprehensive Development Plan which includes the following items: 1. Land Use Analysis and Land Use Plan. 2. Community Facilities Plan. 3. Update Major Street Plan. Cost applicable to this first phase of the Comprehensive Development Plan amounts to a total of $4,500.00. Of this amount, $3,000.00 to aid in defraying cost of work specified above will be paid by the Federal Government. The remaining $1,500.00 will be paid by the City of Fairhope. Motion passed. Mr. Pruitt was questioned regarding the reasons the entire Comprehensive Plan was not being contracted for in this agreement since it has previously been indicated that the entire plan would be developed in the period July 1, 1973 through June 30, 1974. Mr. Pruitt responded that the Alabama Development Office would not approve funds to cover the entire Comprehensive Plan in this fiscal year and he further felt now that the entire job required more than a year to do properly in view of his experience in attempting to complete the Foley plan in one year. It is now understood by the Commission that the additional segments of the plan will be contracted for S� �i 1 I - i August 6, 1973 Page Four and completed in the 1974-75 year including an updated Zoning Ordinance Map. Mr. Pruitt emphasized the active on -going role the Commission members must play in the development of this plan for it to be of value. Chairman Parker presented for informal discussion a contemplated plan - for abandoning right-of-way of the undeveloped portion of Bellangee Avenue between Young Street and Berglin Street at Bayou Cahrbon and the resubdividing plan to establish a cul-de-sac on each side of this natural drainage area. The proposal was endorsed by the Commission members as enhancing the residential neighborhood and preserving a ' drainage - park area. `_' It was proposed by Chairman Parker that a study meeting be held on Monday, August 20th at 5:00 P.M. for the purpose of discussing with Mr. Pruitt the steps and procedures for accomplishing phase one of the Comprehensive Plan. The meeting was agreed to with a request that each member present at this meeting his completed questionnaire supplied by Mr. Pruitt. . Meeting adjourned at 6:55 P.M.
