Purpose of meeting s Discussion of rezoning applications of Carl- ton G. and Kenneth E. Niemeyer, &ad Dyas and White- Spunner and Robert Green; public hearing on the first two cases held Feb. 5, 1 1073; best solutmon of Mr. Green's problem short of re -zoning to be sought. Carlton and Kenneth Niemeyer application to rezone from R-1 to R-3 parcel B of Niemeyer tracts purpose of rezoning- resubdividing and building multiple dwellings. Mr. Gates stated that regardless od adjacent B zoning, regardless of any changes or concessions made by Mr. Niemeyer, he was adamantly opposed to R-3 zoning. Mr. Field's position was that this constitutes a logical zoning pat- terns R-3 providing a buffer between B-1 and R-1 zoning, within walking distance of a new shopping center and side walks for pedes- trians to the C.B.D. General discussions on these two view- points ensued. Motion by Mr. Gates, seconded by Mr. Box, that the Commission recom mend to the City Council that the resoning request of Carlton G. and Kenneth Be Niemeyer be denied. Motion carried. Dyas and White-Spunner application to rezone from R-1 and R-2 to B-2 and B-3 with small plot opposite Colonial Acres re"sis$ining R-15 acreage in triangle formed by State hgwy. 104, business route 98 and 4-lane 98. Main discussion centered arounod the comprehensive plan in process of development by the S A R P C. This plan,when completsd�eithsr will indicate the need for additional business area as claimed by the developers or the inappropriateness of this particuaaa rezoning as argued by its opponents. Motion by Mr. Field, seconded by Mr. Box, that the Fairhope Plan- ning and Zoning Commission recommend to the City Council, the denial of the Dyas and White-Spunner rezoning application until such time as the Commission has a comprehensive plan with antiaipatoWy commercial area being delineated, at which time the application may be returned for reconsideration. Motion carried. Robert Green requested rezoning his nursery plot on Greeno Road from residential to whatever zoning necessary for nursery and/or residential. It was agreed that Green's Nursery predated zoning and all but one of his present neighbors; that under his non= conforming use no major repairs nor alterations may be made on existing structures; that Mr. Green for years had tried going through the proper channels of zoning commission and adjustment board to no availi; and that this commission should make every effort to alleviate his condition. Mr. Green is to be asked to bring in plot plan showing exactly what type of -building he wants to erect, exact location of new buildings, parking facilities,etc., all detaled and accurate, so that the Commission will knoK,with- out question, what Mr. Green would like to do. Mr. Nix asked for reconsideration of the Arch T. Keene request to rezone from B-3 to R-2 certain lots on Volanta Avenue. After short discussion it was agreed that this case be placed on the March agenda. There being no further busineds meeting adjourned. 10
