City Adminsistration Building Present:Chairman Parker and all members of the Commission Visitors: fir. Pruitt, Mr. Stearns, all applicants on the agenda, and approximately sixty interested citizens The minutes of the previous regular meeting were approved as written. Public Heatings Application of Carlton G. and Konneth R.Niemeyer to rezone from R-1 to R-3 parcel B. Niemeyer S/D on the north side of Fairhop e Avenue between Ingleside and Greeno. C. Niemeyer explained rea- soning behind the rezoning request was to provide a buffer zone between the business and residential zones and exhibited plot JI plan showing setbacks, parking areas, planting areas as well as location of apartments on extension of Grand Blvd. Spectators mainly the method of financing which Mr. Niemeyer stated would be from private funds. Application of Dyas and White-Spunner to rezone from R-1 and R-2 to B-2 and B-3 a triangle of land bound: by Hwy. 98 4-laco., Hwy. 98 business route and Ala. 104. Mr, White- Spunner presented case for the developers, Ack Moore as engineer and C. W. Coleman as appraiser, for the developer. Among residents of Colonial Acres and vicinity, as opponents of the rezoning, who questionod these gentlemen were Mr. Kilborn, Lacey, Moody, Kutack,Baugh, and Mrs. Lacey. Mr. Corte favored the application, stating that he had _ purchased recently the undeveloped lots of Colonial Acres and did not feel that the rezoning to business0would endanger his investment. Mr. White-Spunner requested that the decision of the Commission, whether negative or affirmative, be forwarded to the City Council for their action. To be accepted for advertising. Application of Robert Green to rezone from R-1 to whatever B zone is required for nursery business and residence, approxi- mately 5 acres on the west sade of Greeno from Live Oak St. north. Action was delayed to allow time to study the problem and to decide on the most likely solution. Allieation of Byrd Moore, d/b/a Middle Bay Land Co. to rezone from R-1 �0 8-2 land in the old Green S/D on the east and west sides of proposed extension of Ingleside Avenue north of Park Terrace. Motion by Mr. Pitman, seconded by Mr. Box, that the Middle Bay Land Co. rezoning application be accepted for adver- tising for public hearing at the•next regular meeting. Motion carried, J I'.2 2/5/73 Subdivisions' A'• Deep Tree Forest Unit 4 presented for preliminary approval by ` Robert Green. Planning consultant latter pointed out several oulmissions on plat of features required by subdivision regu- lations; ,r. green, given copy of the letter and of regula- tions,was instruoted,to have his engineer correct plat accord- ingly• Mike Ford, Agent for resubdividing of lots 10911,12, F-airladd Heights, reported he lacked letter from county health depart- ment so no action taken. Claude Arnold presenting plat of Fredericks D/D accompanied by all required forms including bond for improvembnts,.requested final approval of subdivision. ,(Motion by Mr. Fiold, seconded by Mr. Gates, that final approval be given Fredericks Subdivi- sion subject to approval by the City Council of the security bond as presented. Motion carried. Building Permits Motion by Mr. Pitmang. seconded by Mr. Box, that the building application of Dalrhbpe Welding and Machine Works, Wesley i Stapleton builder, be approved subject to all appropriate set back requirements. Motion carried. Motion by Mr. Pitman, seconded by Mr. Box, that the building application of Play Land Skating Rink, Wesley Stapleton build- _ er,- riith set --bank subject to required state right of wry plus ;• forty foot additional for a service road. Motion carried. Brnest Bailey and representatives of Shorham Development Co. requested approval of building permit for condominiums 10- cated on the west side of Mobile avenue south on former Tom Brown property. Motion by Mr. Gates, seconded by Mr. Pitman that Permit he granted subject to all flood control and building code regulations. Motion carried. .Ed Gudnundssen requested building permit for Fair Harbor Ma_ rina located on Fly Creek property of Reynolds Boat Work-. Motion by Mr. Box, seconded by Mr. Pitman, that approval of building permit for FairHarbor Marina be given subject to all requirements of building code and Flood control regulations. Motion carried. Due to the lateness of the hour it was agreed to hold special mooting on Friday, Feb 99 1973 at 5:30 P.M.; purpose of meet- ing to reach decisions on the Niemeyer, Dyas and White -Spun - nor and Green rezoning applications,., Meeting adjourned. Byrd Moore explained that there to suffioiOnt ,space for up to 115 "pads" of which 92 will be single s1zo.r401x1001- and 23 double size- 50'x 100'; all city utilities,­inoluding sewer., will be pro v1ded4 and a chain link fence with buffer planting aoies will en- circle the the property,. Only 5.56 Bores of the 15.943 application is with,the city limits. Petitions similar to those• presented against parcel A. rezoning were placed on file. Air. Carter, ter. and Mrs. Pantzer, Mr. and Mrso Dean, Fir, Waters, Mr. Andrews appeared in person. Mr. Carter a6 nearby landowner and Mr. Macon as owner in the vicinity spore against the application, Now business (1) C. W. Coleman, as agent for Baldwin County Saving and Loan, sought approval of building; application. Motion by Mr. Pitman, seconded by Mr. Gates, that building inspeotor�be authorized to issue permit. motion carried. (2 )An amended application for rezoning from R-1 to B-2 and B-39 except for a strip dirootly opposite remaining R-w10 an approx- imately 40 sore parcel of land, triangular in shapes bound by U.S. awy. 98, Ala, Huy 104, and U.B. Hwy. 98 Business Route was presented by White- Spunner and Dyas. Mr, Gleason, Mr. Marston and. Mr. White-Spunner exhibited aerial views of the property and plot plan delineating structures, exits, etc. Motion by Mr. Gates, seconded by Mr. Nix, that the above application be accepted for advertising dor public hearing at the February meeting. Mo- tion carried unanimously, *1 (3)Konneth and Carlton Niemeyer applied for rezoning from R-1 to 11-3 lot B of Niemeyer Subdivision located on the north side of Fairhope Avenue between Ingleside Avenue and Greeno Road, des- cribed as follower SR 4 of NEJ Of Sao, 179 T6s,R2R, Baldwin County, Alabaman of the lanIs of Fairhope Single Tax Corpora•tilon, in the City of Fairhope,4C Alabama. Motion by Mr. Pitman, seconded by Mr. Nixv that the Niemeyer re- zoning application be accepted for advertising for public hear- ing at the February Meeting. Motion carried unanimously. ( 4 ) Leonard Smart of Soutbern Realty and Byrd Moore of Middle Bay Land Company requested advice on developing two adjoining tracts of land, separately owned, located north of Pabk Torinloo Subdivision and extending to Volanta Avenue. Property is part of Green Subdivision recorded in 1899; developers wish to vacate the origizial subdivision and re -subdivide, at the same time rezoning land from R-1 to R-2. The Commission instructed them to submit rezoning and resubdividing applications at the February meeting. 1 Ddeoisions Motion by Mr. Field, s000nded by,Mr. Gates that the Commission recommend to the Cirq Council the approval of the rezoning from (�.
