MInutes of previous meeting apptoved as written. Old business Public hearings (1) Application of Robert R. Nahrgang to rezone from R-2 to R-3 the following described property located on the south side of Fairhope Avenue at the intersection of Fairwood Blvd.: Commencing at the point of intersection Charbonne to said East line of the Baron of the East Line of the Baron de Ferriet de Ferriet Grant; thence run Northwardly Grant and the South Margin of Fairhope along said East Line of the Baron de Fer- Avenue as Point of Beginnings Thence run fiert Grant 290 feet, more or less, to Westwardly along said South Margin of Point of Beginning. Said described -pre- Fairhope Avenue 265 feet, more or less, to miles lying in the City of Fairhope, the Center Line of Bayou Charbonne; thenc Baldwin County, Alabama, in Section 37, jrun Southwardly and Southeastwardly alon T6S, R2E and consisting of ONE acre, more the meanders of said Center Line of Bayou or less. Separate peti- tions from land owners within 300 feet and land owners of the vicinity were placed on file protesting rezoning of both Parcel A ,and Parcel C . Mr. Andrews, Bodden, Waters and Mr. and Mrs. Pant- zer were present to protest. Petitions similar to those presented against Parcel A rezoning were placed on file. Mr. Carter, Mr. and Mrs. Pantzer, Mr. and Mrs. Dean, Mr. Waters, Mr. Andrews appeared in person. Mr. Carter as nearby landowner and Mr. Macon as owner in the vicinity spoke against the application. New business ' (1) C. W. Coleman, as agent for Baldwin County Saving and Loan, sought approval of building application. Motion by Mr. Pitman, seconded by Mr. Gates, that building inspector be authorized to issue permit. Motion carried. (2)An amended application for rezoning from R-1 to B-2 and B-3, except for a strip directly opposite remaining R-1, an approx- imately 40 acre parcel of land, triangular in shape, bound by U.S. Hwy. 98, Ala, Hwy 104, and U.S. Hwy, 98 Business Route was presented by White- Spunner and Dyas. Mr, Gleason, Mr. Marston and Mr. White-Spunner exhibited aerial views of the property and plot plan delineating structures, exits, etc. Motion by Mr. Gates, seconded by Mr: Nix, that the above application be accepted for advertising for public hearing at the February meeting. Mo- tion carried unanimously. *1 (3)Kenneth and Carlton Niemeyer applied for rezoning from R-1 to R-3 lot B of Niemeyer Subdivision located on the north side of Fairhope Avenue between Ingleside Avenue and Greeno Road, des- cribed as follows: I SE i of NE,�, of Sec. 17, T6s,R2E, Baldwin County, Alabama, of the lands of Fairhope Single Tax Corporation, in the City of Fairhope,.i Alabama. Motion by Mr. Pitman, seconded by Mr. Nix, that the Niemeyer re- zoning application be accepted for advertising for public hear- ing at the February Meeting. Motion carried unanimously. ( 4 ) Leonard Smart of Soutbern Realty and Byrd Moore of Middle Bay Land Company requested advice on developing two adjoining tracts of land, separ6.tely owned, located north of Pakk Terrace Subdivision and extending to Volanta Avenue. Property is part of Green Subdivision recorded in 1899; developers wish to vacate the original subdivision and re -subdivide, at the same time rezoning land from R-i to R-2. The Commission instructed them to submit rezoning and resubdividing applications at the February meeting. Ddeetsions Motion by Mr. Field, seconded by Mr. Gates that the Commission recommend to the City Council the approval of the rezoning from R-2 to R-3 land on the south side of Fairhope Avenue at Fair- wood Blvd, as requested by Robert R. Nahrgang. Motion carried• (2)Action was deferred on Middle Bay Land Company's applica- tion to rezone Parcel A of Andrews Survey pOnding submittal of plat avoiding the back up of building to property on the north. .Chairman Parker was requested to contact Mr. Moore and convey this requesty;.*2 I (3) Motion by Mr. Nix, seconded by Mr. Gates, that on the ap- plication of Middle Bay Land Co. to rezone from R-1 to R-5 Par eel C of the Andrews,Survey the Commission recommend to the City Council that itinot be approved. Motion carried unani- mously. A special meeting was called for Monday, Jan.29, 1973 at 7s30 P.M. in the Council room. Next regular meeting is on Monday, Feb. 59 1973• Secretary Footnotes *1 The Planning Commission's recommendation that construe-. tion on the B-3 shopping center on the four -lane Hwy. 98 be delayed for a minimum of two years was not elected by the of applicants. *2 Chairman Parker contacted Mr. Moore and Mr. Roberds of the Middle Bay Land Company concerning the R-3 zoning request and they decided to withdraw the applioation.
