Regular and Public Meeting Monday, Deoe 4, 1972

Present: Chmn, Parker, Members Box, Bi111e,Frederiok9 Field, Gates,
Nis, Kirk.
Absents Member Pitman.
Minutes of last regular meeting approved as written.
Item I. Report on scheduled hearing on triangle off the north edge
of Colonial Acres was given by Chmn. Parker. Consensus of the Plan-
ning Commission special meeting on Nov. 27, 1972 was to encourage
temporary withdrawal of zoning application in view of recently ex-
panded commercial zoning and apparent Colonial Acres resident"s�
Opposition. The developers plan to amend their application to seek
rezoning of the shopping center site committed to delayed construction
of two or more years. Multi- family and business zoning on the front
age on Hwy. 98 business route will be sought at the January meeting.
Item 2. Public hearing of Arch T. Keene to rezone from B-3 to R-2
lots 8-189 block 1; lots 1-79 block 69 block,;B and F, Volanta S/D.*
Mr. Keene spoke pro rezonings protects residential property from
commercial usage. Mr. Wolfe and Mr. Holder, pro: same as Mr. Keene.
Subsequent discussion revealed all property owners involved not not-
ified or party to the application and therefore the application can-
not be considered. Mr. Keene should be.notifted that letters stat-
ing accordance with(the application should be obtained from each
involved land owner andisubmitted with the application; an alterna-
tive is to have each involved property owner co-signer of the re-
zoning application. Application should involve only those areas
which are property of the named applicants.
Item 3. Robert R. Nahrgang Rezone from A-2 to R-3 south side of Fair -
hope Avenue at the intersection of Fairwood Blvd., a triangular form,
approximately one acre of land, for multi- family zoning. Mr. Nahr-
gangfro: Fairhope Avenue -will become commerolai, to protect Fair -
wood S/D a multi family dwelling would be far better than a gas sta-
tion or the like., Proposed building to be L- shape , two story.{ro)
Mr. Jackson, opposite land owner, came and stated he was in appm�al
Motion to hold application until neat meeting to determine if all `
property owners within 300 feet have been properly notified and, if
not, those to be invited to be heard at next meeting byj personal
letteiligmade by Mr. Nix, seconded by Mr. Gates. Motion carried.
Item 4. Mr. Arnold presented replat of block 159 div. 1 andblock 30,
div. 20 lands of the F.S.T.C., located on the west side of Church St,
between the elementary school and Fels Avenue. Plat noted encroach-
ments: (1) an agreement with Beasley Nursing Home with 30 ft, en-
croachment on Morphy Avenue B.O.W. states that existing structure
will be subject to normal maintenance only until it comes down and
encroachment will become part of the street B.O.W; (2)the electric
substation built on wesb side of Churoh Street at Morphy within the
street B.O.W. will be removed as it becomes obsolete'or is modified
to free entire B.O.W. lotion by Mr. Frederick, seconded by Mr. Box

that this replat be given final approval. Motion carried.
Item 5- Byrd Moore and George Roberds, d/b/a Middle Bay Land Co-,
applied for rezoning fromR-1 to R-5 for approximately 16 acres,
2/3rd of which is outside of the city limits on Edwards(or Andrews)
Lane, parcel"C" of the Rosa Andrews survey. Land is presently a
pecan orchard adjacent to farm land; proposed to turn into a 115
pad mobile home village. Motion by Mr. Box, seconded by Mr. Frederick,
that application be accepted for advertising for public hearing at
the next regular meeting; carried unanimously.
Item6. Byrd Moore and George Roberds, d/b/s Middle Bay Land Co.,
to rezone from R-1 to R-3 parcel "A" of Rosa Andrews survey, pro-
posed use to be row of town houses to be discussed more fully at
next meeting. It was pointed out that additional R.O.W for Greeno
Road at west end. of parcel "A" should be condidered- Mr. Boa moved,
Mr. Gates seconded,that application be accepted for advertising
for public hearing at neat regular meeting; motion carried.
Item 7. Martha Johnson appeared seeking advice on remodeling con-
cession stand on beach and reopening building as dress shop. Mrs.
Johnson said she thought she could provide one or two off street
parking spaces and. was told that public parking was avallabibe.
Commission advice was to satisfy the building inspector.
Item 8.- Carlton Niemeyer stated he would bring a plat and request
for rezoning to R-3 for land on the north side of Fairhope Avenue
on the continuation of Srsssm Grand Blvd. in Ingleside; use to be
for apartment buildings and for duplex facing proposed continuation.

Item 9 Considerable discussion dealt with the question of Planning
Commission recommendations and securing of proposals for planning
consultant's services after Chmn- Parker reported council's agree-
ment to reconsider their decision on terminating R.S. Batemen's
contract and utilizing SARP Commission. It was decided that no
studies on amount of outside comprehensive plan, studies or enlist-
ment of proposals from several consulting sources would be carried
out and that the council should be informed not to expect such re-
ports from the commission and to proceed with any agreements planned
with Mr- Pruitt and the SARPC. Chmn- Parker agreed to report this
to the council but encouraged the commission to involve itself in
future activities so impo#rtant to good planning,
