June 1, 2009, at 5:00 PM at the City Municipal Complex, 161 N. Section
Street in the Council Chambers
Present: Jean Wilson, Chairman; Members: Bob Clark, Fran Slade, Jennifer
Fidler, Dick Charles, Gary Moore, Lee Turner, members. Jonathan Smith,
City Planner, Nancy Milford, Planning Staff, Chris Gill, Attorney. Betty
Rivenbark, Secretary. Absent: Tim Kant, Dan Stankoski.
The minutes of the May 4, 2009, meeting were considered and approved
with amendments noted on motion by Dick Charles, 2nd by Jennifer Fidler
and carried with an abstention by Gary Moore and Lee Turner.
Chairman Wilson announced that ZC09.02 Klumpp application had been
withdrawn if anyone was present for that case.
SD09.06 Final Plat approval for Summer Oaks Stables, Double āCā
Investments Properties, a four lot division. The property is located at the
end of Summer Oaks Place on the south side of County Road 44.
Nancy Milford gave the staff interpretation saying the total acreage is 13.88
acres and 4 lots are proposed. The property is unzoned in Baldwin County.
Preliminary Plat approval was given as a village subdivision August 6, 2007.
Lots range from 1.42 acres to 2.75 acres. Each lot has a reserved one acre
pasture area and stable space within the subdivision. Approximately six
acres of common area is proposed and 2.95 acres of the site are wetlands.
Staff recommendation was to approve conditional upon the following:
Wetland buffer signs being placed along the buffer boundary as specified in
the City Subdivision Regulations in Article V, Section F, Stormwater
Standards. As-built drawings shall be revised removing the sign location on
the lot line and placing the signs in accordance with City Sub Regulations.
The engineer of record shall provide a signed and sealed statement of
conformance on the plat and the as-built drawings. The statement should
match the working as presented in Article IV, Section D, Final Plat, of the
City Subdivision regulations.
David Shumer, engineer, and Danny Calhoun, developer, were present
representing the application. Mr. Shumer said no changes had been made
from what originally presented.
Chairman Wilson asked if anyone wished to speak on this and no one did.
Dick Charles commented that he and Bob Clark had surveyed the property
and it is very creative with four beautiful lots and one acre pastures, he said
this is characteristic of what we need in this area. Danny Calhoun said he

has put nine signs across the 500 ft. area, will put additional signs. Lee
Turner moved to approve with staff recommendation as set out above. Dick
Charles 2nd the motion and it carried unanimously.
Jonathan Smith mentioned he is still working on the ADU ordinance and
hospital overlay committee. Dick Charles asked if he had contacted Phil
Cusa and Dan Stankoski and he said yes.
There being no further business, meeting was duly adjourned.
