City Administration Building Present: Chmn.Parker, members Macon,Box, Frederick, Gates, Arnold, Pit— man. Absent: Members Kirk, Bung. Visitors: Harmon Stearns, Hobert George and about 90 interested citizens. Minutes of previous meeting approved as written. Public Hearings Application of Edwin Warley to rezone from R-1 to R-3 lots 28 and 29, block 13, Volanta, corner of Gayf er Avenue and Bon Secour. Mr Warley was not present; about 36 residents of the Fairwood area appeared to pro- test. Mr. Stovall first spokesman for the oppositionistated that the majority of the group had, bought property in single family zon+nd would like to have area remain in single family zone. Other opponents reit- erated. his views. Motion by Mr. Macon, seconded by Mr. Gates, that the Planning Commis- sion recommend to the City Council that the rezoning application of Edw. Warley as outlined above not be approved. Motion carried unan- imously. Application of B. I. Reynolds to rezone from R-1 to R-3 lots 3,4,5, block 2, Ingleside Highlands, on Prospect Street. Mrs. Reynolds and son-in-law, Clay Havard appeared to explain purpose of request. Mr. Reynolds, wishing to resubdivid.e 3- 50' lots�nto 2-75' lots with the intent of building one single Family clwellin can each , was advised by Planning Coy iiisoiorz that square footage of new lots required R-3 zoning. About 30 Ingleside residents appeared to protest rezoning. Various persons stated that they objected. to any zoning that permitted multiple dwellings, that they wished to retain the R-1 classification, in Ingleside. Motion by Mr. Box, seconded by Mr. Gates, that the Planning Commission recommend to the City Uouncil that the rezoning application of B.I. Reynolds as outlined above not be approved. VotinS aye: Parker, Macon, Box, Frederick, Gates, Pitman. Voting nay, Arnold.. Motion carried. Application of Mrs. A.O. Barmettler to rezone from R-2 to R-3 lots 3 and. 4, block 16, Magnolia Beach, 118 Pecan Street. Mrs. Barmettler and Mr. and Mrs. Robert O'Neill appeared for this application. Peti- tion containing 33 names of protesters living within four block area was placed on file and about fifteen Magnolia Beach residents appeared in opposition. Mrs Barmettler explained that she wished to build small living quarters for herself, either separate of attached to present house and was advised by the Planning Commission to seek R-3 zoning. Mrs. Abrahamer, spokesman for the opposition stated that the objections were to the R-3 zoning and not to the building plans of Mrs. Barmett" ler. Motion by Mr. Macon, seconded by Mr. Box that the Planning Com- mission recommend. to the City Council that the rezoning application of Mrs. R.O. Barmettler as outlined above.not be approved. Greene to rezone from R-2 to R-3 lots 2 & 7, block 9 and pert of lot D, Volanta Subdivision, 563 N. Mobile Avenue. Mr. Greene explained that during construction of his home; a raised cottage type, it was suggested that the space in lower front be con- verted into an efficiency apartment. He was advised to seek R-3 zoning which would allow an apartment. A protest petition with about 40 names was placed on file, about 12-15 residents from the Volanta area appeared to protest rezoning. Majority said they had no objections to the apart- ment itself. Motion by Mr. Pitman, seconded by Mr. Box that the Planning Commission recommend to the City Council that the rezoning application of Paul T. and Carolyn B. Greene as autlined above not be approved. Motion carried. Wm. A. Troup, having been instructed at the last meeting to post bond of $1,368.25 to assure paving street between lot 1 and 2, Malcolm S/0 re- turned with check in the above amount and resolution requesting the Planning Commission approve the payment of such amount and final ap- proval be given this S/D. Mr. Arnold moved, Mr. Box seconded that the above resolution be accepted. After discussion, Mr. Box withdrew his second motion died from lack of a seconding. Motion by Mr. Box, seconded by Mr. Pitman that the Planning Commission accept the cash payment of $1,368.25 by Wm. A. Troup and adopt the resolution accompanying same,subject to review by the City Engineer. Motion carried. New Business: Application of Matthew P. Dial Jr., to rezone from R-1 to B-2, lots 7, 8, and 9, block 10,Ingleside Highland was received. Motion by Mr. Pitman seconded byMr. Arnold that the Dial application be accepted' for adver- tising for public hearing at the next regular meeting. Motion carried unanimously. Mike Ford, agent for Charles W. and Jane Gable, presented resubidivsion of the NW 4 of SW 4 of SW-4 of Sec. 16, T6S, R2E, Baldwin County on inter- sectionof Morphy Avenue and Greeno Blvd., for preliminary and final approval. Motion by Mr. Macon, seconded by Mr. Gates that preliminary and final approval be given Gable resubdivision as described above. Motion carried unanimously. Amon Gates presented for preliminary and final approval lots 2 and 3, Deep Tree Forest Unit 3, Motion by Mr. Pitihan seconded by Mr. Macon that pre- liminary and final approval be given Gates S/D as described above. Motion carried unanimously. Mr. Forsman, agent, and Mr. Martens, Owner, requested advice from Com- mission onproperty located N. Section St., between Miller and Barclay, proposing rezoning for apartments. Commission pointed out space re- quirements for multi -family units and parking, and advised return with more detailed plot plan. Carlton Niemeyer showed rough sketch of proposed S/D of FSTC land on Fairhope Avenue and received approval of proposed plans. i Motion by Mr. Pitman, seconded by Mr. Box that preliminary and final approval be given to B. I. Reynolds Coleman -Reynolds S/D of lots 3,4,and 5 Block 2,Ingleside Highlands. Motion carried unanimously. Members discussed difficulties caused by rigid standards of zoning ordinance and requested planning consultant to explore feasibility of "Hardship" clause similar to Art. VI, Sec. 601.1 in S/D Regulation for zoning Ordinance. There being no further business meeting adjourned. Eloise T. Wilson
