Regular and Public Meeting
Monday, June 5,_ 1972, 5:00 P.M.
City Administration Building
Present: Chairman Parker, members Box, Arnold, Frederick, Gates,
Macon.
Absent: Members Bung, Kirk,Pitman.
Visitors: Mr. Schneider, Mr. and Mrs. Robert Schneider, Mr. and
Mrs. Greene, Mr. and Mrs. O'Neil, Mrs. Barmettler, Mr. Corte, Pope,
Bailey, Ford, Earle, George and Stearns.
Minutes of previous meeting approved as written.
Motion by Mr. Frederick, seconded
Commission accept the updated base
by Robert Bateman and Associates.
Public Hearings:

map and land use map as prepared
Motion carried unanimously.
Application of Peter Young to rezone from R-2 to B-2, the following
described property located on the S/W Corner of Young and Middle
Streets; From the N.E. Corner of N.W.4 of Section 20 Township 6 S.
Range 2 East, run South 935 feet to S.W.Corner of intersection of
Young and Middle Streets for the POB; thence run South 140 feet;
West 120 Feet; East along South side of Middle Street 80 feet to
the point of beginning. 0.318 Acres in Carrie Young Tract in S.E 4
of N.E.4 of N.W.4 of Section 20, Township 6 South; Range 2 East,
Baldwin County, Alabama.
Ernest Bailey, Attorney, explained proposed use,)and character of
neighborhood. No opposition present. Motion by Mr. Fredericks,
seconded by Mr. Gates that the Planning Commission recommend to the
City Council the rezoning requested by Peter Young. Motion carried
unanimously.
Mike Ford, agent for Paul Leatherwood returned to Commission with
request'that only the East 180 feet be rezoned; that this land
would be subdivided into three 60 foot lots with two office buildings
to be constructed on 90 feet each. Mr. Ford was instructed to file
a new application withRappropriate plat plans, etc.
W. A. Troup requested preliminary approval on lots 1- Malcolm
Subdivision and final approval:on lots 1 and 2; his pose of asking
for partial approval being that he planned to post bond for street
paving and had immediate plans only for lots fronting on Mobile
Street. Motion by Mr. Arnold, seconded by Mr. Box that subject to
proper certificates from Health Department and City Superintendent
and to posting bond to cover cost of paving his section of North
Mobile Street ($1,368.25 as per estimate on hand) final approval
of lots 1 and 2, Malcolm Property Subidivision be granted. Voting
Aye: Parker, Box, Arnold, Frederick, Gates. Voting Nay: Macon.

Motion by Mr. Arnold, seconded by Mr. Gates that the application
of Mrs. R. 0. Barmettler to rezone from R-2 to R-3 lots 3 and 4,
block 16, Magnolia Beach Addition be accepted for advertising for
public hearing at the next regular meeting. Motion carried.
Motion by Mr. Arnold; seconded by Mr. Gates, that the application of
B. I. Reynolds to rezone from R-1 to R-3, lots 3,4, and 5, Block 2
Ingleside Highlands be accepted for advertising for the public hear-
ing at hhe next regular meeting. Motion carried unanimously.
Motion by Mr. Macon, seconded by Mr. Gates that the application of
Edwin Warley to rezone from R-1 to R-3 lots 28 and 29 in Block 13
in Volanta be accepted for advertising for public hearing at the
next regular meeting. Motion carried.
Subdivisions:
Coleman -Reynolds Resubdivision of M lots 3,4, and 5, Block 2,
Ingleside Highlands., It was explained that Mr. Reynolds had three
50' lots which he wished to divide into two 75' lots. Motion by
Arnold that -preliminary and final approval be given Coleman -Rey-
nolds Subvision. Motion died for lack of a second. Motion by
Mr. Macon, seconded by Mr. Gates, that approval of Coleman -Rey-
nolds S/D be denied until after public hearing on rezoning of
their property. Motion carried with Mr. Arnold voting no. All
others voting yes.
Joe Schneider and Son, Inc., subdivision of Schneider Leasehold of
Farhope Single Tax Corporation land, the N 706.5 feet of the Ki
yy$�xM West 663.8 feeV of the N.W. 4 of the S.W. 4
of Section 16, Township 6 South Range 2 East, located on S.E. Cor-
ner of Greeno and Fairhope Avenue.
Motion by Mr. Box, seconded by Mr. Gates that the preliminary and
final approval be given the Joe Schneider and Son, Inc., S/D.
Motion carried unanimously.
Final approval was requested on Fairwood 16 SiD. FaWorable com-

Jack Pope, agen Corte -Clarke Realestate requested advice on
plat of Subdivision of Albright property in the police jurisdiction
and received a favorable go-ahead on his plans.

• Pierce Frederick Subidivision of South ;g block 22 and part of/kak 23,
Volanta. Motion by Mr. Macon, seconded by Mr. Gates that Planning
Commission grant preliminary approval to this Subdivision. Motion
carried unanimously.
Mr. Gates seeking approval of lots 2 and 3, Deep Tree Forest, Unit 3
was instructed to file a Subdivision application on same.
Charles Earle, Realtor, inquired as to stattus of zoning on Highway 98
North of Parker Road, Police Jurisdiction and restrictions , if any,
on underground bulk storage. 41

Following general discussion, motionAby Mr. Arnold that the Planning
and Zoning Commission recommend to the City Council the rezoning re-
quested by Charles Earle1with the stipulation that all tanks be under-
ground and that plant be laid out and landscaped as required by the
Commission. The Secretary was instructed to send Mr. Earle written
notification of this action.
There being no further business, meeting adjourned.
