The Fairhope Planning and Zoning Commission met in regular
and Public session on Monday, May 1, 1972 at 5:00 P.M,., at
the City Administration Building in Fairhope, Alabama.
Present: Chairman Parker, members Gates, Fredericks, Arnold
and Kirk.
Absent: Pitman, Macon, Bung, Box.
Visitors: Mr. Bateman, Stearns, Ford, C. Niemeyer, A. Moore,
B. Moore, Stapleton, Troup, Robert and approximately fifteen
interested property owners.
Minutes of previous meeting approved as written.
Old business:
Public hearings on application of Jack Stapleton to rezone
from R-1 &, R-2 to R-2 tract of land bounded inpart by
Kirkman Lane and Boone Lane. Chairman explained the dif-
ferences between R-1 and R-2 Zoning; that the south end of
tract already is zoned R-2 as is Ridgewood Estates so that
the Commission had advised Mr. Stapleton to seek R-2 Zoning
for entire fflact. Mr. Stapleton stated that his preliminary
subdivision plans includes four lots with 95' more or less
frontage on Boone Lane and one lot on the southeast corner
facing Kirkman Lane with 110' more or less frontage. After
hearing these explanations, the interested persons attending,
when queried by the Chairman, voiced no opposition.
Mike Ford represented Paul Leatherwood in his application to
rezone from R-1, R-2, and B-1 to B-3, F. S. T. C. land descri-
bed as follows:
Begin on north side of Fairhope Avenue 645 feet
east of southwest corner of S.E.-4- of N.E.--4, Sec.
17, Division 4 of the lands of the lessor in the
City of Fairhope, Alabama as per its plat there-
of filed for record Sept. 13, 1911; thence run
north 300.5 feet; thence run east 333 feet, South
300.25 feet, to Fairhope Avenue and West 332.75
feet to the point of beginning; land on the north
side of Fairhope Avenue adjacent and west of the
Busy Bee Service Station.
Mr. Ford explained that present plan is to divide into five
parcels for individual offices fronting on the approximately
332.75 feet on Fairhope Avenue. Mrs. Horne and Hill ques-
tioned the effects of additional Commercial Zoning in this
area on bicycle trail to the Middle School; suggested limi-
ted ingress and egress to property in question. C. Niemeyer
nearby property owner had no objections.
Application of Mrs. R. 0. Barmettler to resdbdividVO
ots
3 & 4, block 16, Magnolia Beach, resulting in lots' and
50' frontage. Planning Consultant advised Commission that
it cannot approve a subdivision which violates the Zoning
Ordinance. Discussion of alternatives led to decision to
advise MrS. Barmettler to apply for R-3 Zoning.
W. Alan Troup returned to Planning Commission with letter from
Adjustment Board requesting consideration by Commission of a
30' width to thgone block new extension of Gayfer Court.
Motion by Mr. Arnold seconded by Mr. Kirk, that the Planning
Commission recommend to the City Council that Zoning Ordinance
#295 be waived as to minimum lot size and street frontage on
lot 4 in Malcolm property subdivision on Gayfer Covert asshown
on map dated March 1, 1972, and grant preliminary subdivision
approval of said lot 4, Motion carried unanimously.
Application of George Roberds actdng for Eastern Shore Builders
to resubdivide lot 7 & 8, block 11, Magnolia Beach,
received too late for review by Planning Consultant, was dis-
cussed. Motion by Mr.'Arnold, seconded by Mr. Frederick, that
subject to submittal of property application and increase of
R/O/W, from 20' to 25' on Orange and Kumquat Streets preliminary
and final approval be granted this resubdivision. Motion carried
unanimously.
Application of Byrd Moore for resubdivisinn of Lot 5, Green's SJD
F.S.T.C. Land fronting on Blue Island Street, submitted too late
for review by Planning Consultant,examined. Motion by Mr. Arnold,
seconded by Mr. Frederick, that prelirm_nary and final approval be
given this subdivision subject to approval of plat by planning
Consultant. Motion carried unaimoasly.
Motion byMr. Frederick, seconded byMr. Gates that final approval
be given Moore's Rock `Creek Subdivision subject to receipt of
letter of approval from Baldwin County Health Department and
Daphne,Water Board. Motion carried unanimously.
Application of Peter Young to rezone from R-2 to B-2 the Carrie?
Young tract on S/%/Corner of Young and Middle Streets. Motion,� ►
Mr. Gates that the Planning Commission aceept the above re-
zoning application for public hearing at next regular meeting.
Motion carried unanimously.
Mrs. Hill and Mrs. Horne discussed foot paths and bicycle trails.
Secretary was instructed to order copies of Oregon State High-
way Division booklet on the above subject. Chairman agreed to
contact Mayor in regards to setting up official committee for
this project.
Carlton Niemeyer, Pierce Frederick and Amon Gates sought advice
on subdivisions each was developing.
Discussion in Public Hearing cases:
Motion by Mr. Arnold,seconded byMr. Frederick, that the Planning
Commission recommend to the City Council the rezoning to R-2 that
part of Jack D. Stapleton's property described below which is
now wax zoned R-1:
2.8 acres 180 W. pf Section Street and bounded on West by Boone
Lane and on south by Kirkman Lane. Motion carried unanimously•.
Motion by Mr. Arnold, seconded by Mr. Gates that action be
deferred on Paul J,am_,,� eatherwood rezmning application until
plans for th� o bs "development, including drawings for the
full parcel of land showing off-street parking, points of egress
and ingress and style of buildings, are submitted. Motion carried
unanimously.
There being no further business, upon motion, seconded and carried,
meeting adjourned.
