ti Regular and Public Meeting, Monday,.October 4, 1971, 5:00 P.M.,
City Hall, Fairhope, Alabama.
Present: Chairman Parker, members Arnold, Bung, Gates, Pitman,
Macon, Kirk and Box.
Absent: Member Frederick.
Visitors: Mr. Bateman, Dyson, Moore, Roberd, Rockarby, Niemeyer,
Forsman, Mrs. Thomas, Doyle, Curlee, McNeil, Goodman.
Minutes of previous meeting approved as read.
Public hearing:
Application of Mobile College to rezone from R-2 to R-3 lots
4 through 10, and 12 through 23, Gooden's S/D as recorded July
25, 1955, all on Northrop Street in Fairhope.
Jessie Rose Goodman owner of Lot 11, questioned location of
surveyor's stakes but was advised that the rezoning did not in-
clude her lot and that any question onlot lines should be refer-
red to a surveyor.
Motion by Mr. Pitman seconded by Mr. Gates that the Fairhope
Planning and Zoning Commission recommend to the City Council
the rezoning from R-2 to R-3 lots 4 through 10, and 12 through
23, Gooden's Subdivision as recorded July 25, 1955. Motion car-
ried unanimously.
Ack Moore pointed out changes made on plat of Rock Creek S/D as
requested at last meeting.
Walter Wilson, agent for Mobile College, resubmitted subdivision
of Azalea Woods, formerly part of Gooden's S,1D. Letter from Mr.
Kirk, City Superintendent stated that all untilities including
sewer were available but recommended installation of larger water
line on Northrop Street.
Motion by Mr. Pitman, seconded by Mr. Macon that preliminary
and final approval be given Azalea Woods S/D formerly lots 4
through 10 and 12 through 23 of Gooden's S/D without an increase
in size of water line, but with original restrictive covenants
still applicable.
Voting Aye: Mr. Parker, Arnold, Bung, Gates, Pitman, Macon, Kirk.
Voting Nay: Mr. Box. Motion carried.
NEW BUSINESS: &.
Application of George Martin to rezone from R-2 to R-3, lots
7 and 8, Block 11, Magnolia Beach. George Roberd, the developer
showed plan for proposed buildings with parking off of Kumquat
Street which he said City would open when construction began.

Mr. Macon proposed that Planning Commission omit its public hear-
ing, sending application directly to Council.
Motion by Mr. Arnold, seconded by Mr. Gates that the Planning Com-
mission waive public hearing on application of George Martin to re-
zone from R-2 to R-3, lots 7 and 8, Block 11, Magnolia Beach and
transmit without recommendations of any kind, this application to
the City Council to be processed in the minimum legal time by that
body.
Motion carried unanimously.
It was suggested that Planning Consultant and Commission Chairman
to confer on subject of public hearings by Commission and Council
with goal of streamlining proceedings.
Plat of Big Head Hummock, Unit 1, fronting on Fig Street in Magnolia
Beach was presented for final approval, letter from City Superin-
tendent stated all utilities available.
Motion by Mr. Bung, seconded by Mr. Macon that final approval be
given Unit 1, Big Head Hummock S/D. Motion carried unanimously.
Fairhope Single Tax Corporation Subdivision of West � of Block'47
Magnolia Beach delineating in part existing leasehold. Letter from
Consultant questioned 40' ROW on Church Street and Horton Lane and
substandard size of lots 5 and 6. Since streets in question already
are paved and guttered the width of ROUT waived but approved by
Adjustment Board of substandard lots required.
Motion by Mr. Macon, seconded by Mr. Bung that final approval be
given to FSTC S,'D of West � block 47 Magnolia Beach subject to ap-
proval of lots 5 and 6 by Board of Adjustments and Appleal. Motion
carried.
Motion by Mr. Macon, seconded by Mr. Pitman that final approval
be given A. M. Gates S/D Fairmont #1 subject to statement from
Planning Consultant that all requirements of preliminary approval
of July 3, 1967 have been met. Motion carried unanimously.
Letter from Mr. Dyson, Building Inspector, to Lawrence P. Thomas,
Saraland, Alabama, regarding construction in Saggin Oaks S/D before
final approval has been given to said subdivision, It was decided
that City Council should be apprised of this situation.
Mr. Forsman and Mr. Rickarby submitted preliminary plat of pro-
posed Subdivision of Lot 4, Block 2, Coleman Colored Homes S/D
for criticism of layout. Mr. Bateman agreed to confer with owners
on this subject.
Mr. Mitchell of Beasley Nursing Home requested advice on proposed
construction program and was instructed to confer with Building
Inspector and with Board of Zoning Adjustments.
Mr. Arnold introduced the following resolution and moved it adop-
tion:
WHEREAS the City of Fairhope has, as a so-called "Approved Major
Street Plan", a "plan" consisting of the then -in -use streets in
the City approved as a "Major Street Plan" in 1954; which said
"plan" was Re -adopted in 1963, without revision; and
WHEREAS this circumstance has the result of the FAIRHOPE CITY
PLANNING COMMISSION and property owners in and of the town of
Fairhope having no Actual, Comprehensive, Professionally Pre-
pared Major Street Plan to afford the necessary guidance in plan-
ning and executing new Subdivisions; and
WHEREAS recent Court Decisions, as reported._iin the American Ctiy
Magazine, incicate that the ECONOMIC STUDY and LAND USE PLAN pha-
ses of the usual planning process are practical l-bgal'pre-requi-
sites that of necessity must be carried out prior to the adop-
tion of a Major Street Plan; and
WHEREAS the Fairhope City Planning Commission is frequently in
need of a modern, professionally prepared, properly adopted Ma-
jor Street and Throughfare Plan;
IT IS HEREBY RESOLVED by the members present at the October 4,
1971 meetingoof the FAIRHOPE CITY PLANNING and ZONING COMMISSION
that said Commission request the Mayor and the Council of the
City of Fairhope to take the necessary actions to employ, and to
employ, ROBERT S. BATEMAN and ASSOCIATES, Inc., to carry out the
ECONOMIC STUDY, and LAND USE PLAN phases of a Comprehensive Pro-
gram for the City of Fairhope, AND to prepare a MAJOR STREET
PLAN for said City of Fairhope, Ala bama.

Building Inspector presented application of J. Dudley Wade to
install 2 gasoline pumps at Better Burger on North Section Street.
Motion by Mr. Macon, seconded by Mr. Gates that the Commission ap-
prove the installation of 2 gasoline pumps at this location. Mo-
tion carried.

It was decided to hold s-Hi-a+ meeting for discussion on revision
of S/D regulations on Thursday, October 21st at 6:00 P.M.
Chairman distributed copies of Article on Strip Zoning.
There being no further business meeting adjourned.

actions to employ, and to employ,ROBERT S. BATEI•!EN and
ASSOCIATES, Inc., to carry out the ECONOMIC STUDY, and
LAND USE PLAN phases of a Conprehensive Program for the
City of Fairhope, AND to prepare a MAJOR STREET PLAN for
said City of Fairhope, Alabama.
