Present: Chairman Parker, Members: Gates, Bung, Box, Arnold, Pitman, Fredericks. Absent: Members Macon and Kirk. Visitors: Mr. Bateman, Mr. Dyson, Dr. Stine, Mr. Berglin, Mr. Taylor, Mr. Hartman, Mr. Dial, Mr. Moore, Mr. Clark and Mr. and Mrs. Whitacre. Reading of minutes of previous meeting omitted. Old Business: Application of Mr. M. P. Dial, Jr., to rezone from R-1 to B-1, Lot 21, block 12, Volanta. Mr. Dial explained the pro- posed use of building an�.,office, and size and type of same. Mr. Taylor inquired if the B-1 Zoning would remain if Mr. Dial discontinued his use. No other persons were present for this case. Application of Mr. Byrd L. Moore to rezone from R-2 to R-3 the following described property: Mr. and Mrs. Wlitacre owners of property on SW corner of Fig and Church inquired as to access road to property mould re- quire footage taken from their lot. Mr. Moore replied that he had several attorati on alternatives for acquiring i mm access to property; Chairman informed the Whitacres that any recommendations on rezoning made by the Zoning Commission did not involve the opening of new streets. Mr. Hartman stated that he was paying taxes on land he thought included in description. He was advised to contact either the tax assessor's office or the Single Tax Colony to locate his land. No other persons present for this case. Action o f? Application of C. A. Curtis to rezone from R-1 to R-3, Lots 3-8 block 1, B Ingleside was withheld due to absence of Mr. Curtis and lack of accurate plat plan. 60 Chairman read letter from Rickarby and Benton which stated that there were no restrictive covenants on Christian Church Deed; also letter from Carl Booth, Attorney, re- questing information on action taken on Douglas Wade rezoning application of 11/2/70. Robert Berglin, through Engineer Claude Arnoldrpresented plat of Deep Tree Forest Subdivision 3rd Addition for final approval. motion by Mr. Pitman seconded by Mr. Gates that final approval be given Deep Tree Forest S/D 3rd Addition upon verification that Mr. Berglin will be responsible for installation of utilities and paving. motion carried unani- mously. R. Dial to rezone from R-1 to B-11 lot 21, Block 129 Volanta. Voting Aye: Mr. Gates, Bung, Box, Frederick, • Voting Nay: Mr. Arnold, Pit- man. motion carried. Motion by Mr. Frederick seconded by Mr. Pitman that the Fair - hope Planning Commission recommend to the City Council the rezoning from R-2 to R-3 the land described in the application of Byrd L. Moore. motion carried unanimously. Motion by Mr. Gates, seconded by Mr. Arnold, that the Council be requested to pay all members of the Zoning and Planning Commission and the Board of Zoning Adjustment ten ($10.00) dollars for each meeting attended, retroactive to January 1, 1971. Following id discussion the motion and second were withdrawn to give time for consideration by the members. Mr. Parker proposed that the Commission work toward in- forming citizens, especially realtors and developers, that the Planning Commission is striving for the betterment of our cmmmunity and stands ready to aid them in any way. Means of accomplishing this were discussed. Mr. Gates volunteered to contact owners of 65 Acres on S. Greeno advertised for sale with view of possible commercial rezoning.
