HomeMy WebLinkAbout11-02-1970 Regular and Public Meetingr FAIRHOPE PLANNING AND ZONING COMMISSION The Fairhope Planning and Zoning Commission met in regular and public session Monday, November 2; 1970 at 5:00 P.M., at City Hall in Fairhope. Present: Chairman Parker, members: Gates, Box, Frederick, Arnold, Pitman-W. Absent: Members Kirk and Bung. Visitors: Mr. Bateman, Dyson, Bailey rWade�tJerniganp Dial, Cummings, Brock, Earle. Mrs. Robinson. Minutes of previous regular meeting and special meeting approved as read. Old Business: Public hearing on request of J. Dudley Wade to rezone from R-2 to B-19 Lot 19, Block 16, Volanta. Mr. Bailey, attorney represented Mr. Wade, stated that Mr. Wade had operated the "Betterburger" at this location before the enactment of the zoning ordinance and that a Mr. McCue had operated a filling station there in 1946, that Mr. Wade wanted to install two coin -operated gas pumps on the N/m Corner of his property, while continuing his lunch stand business. Mrs. Robert @obinson, 415 Pensacola Avenue, owner of adjacent property questioned the desirability of increased traffic. especially at the right angle 44x4 intersection of Pensacola Avenue and Section St. Matt Dial seeking rezoning from R-2 to R-3 Lots 4, 5, 61 19, 20, 21, Block 129 Volanta returned as requested with Plat plan. Mr. Cummings and Mr. Block principals in proposed building stated that plan called for"34 two story rental units of which 24 were 3 bedroom, 10 were 2 bedroom apartments; 68 parking spaced and that this fell within den- sity requirement of ordinance. New business: Charles Earle resubmitted application or rezoning From R-2 to B-1, tith lots 20 and 21 of Block 16, Volanta, plat plan showing building location and parking attached. After discussion, motion by Mr.,Gates secorchd by Mr. Box that the application of Charles Earle as outlined above not be accepted for advertising for public hearing for the rea- sons listed below: 1. Future population growth will be on East side of Section St., consequen- tly this type of facility will increase traffic movements across Section S t . 2. Additional traffic movements into and out of Section St., will ag- gr#,vats traffic flow. 3. Lighted neon signs will antagonize and/or depreciate the adjoining residential structures. 4. Increased traffic movements from this tppe of traffic generator -or will cause traffic hazards and slow traffic flow into and out of the Central Business District. Motion carried. Application of J. Dudley Wade to rezone from R-2 to B-1, lot 19, 81. 16, Volanta, was considered next. motion by Mr. Gates seconded by Mr. Box that the Fairhope planning and Zoning Commission recommend to the City Cpuncil that this application be denied for the following reasons; 1. The site is not suitable for a service station because bf its size, the acute angle intersection at Pensacola Avenue and Section Street, in- sufficient parking space. 2. The addition of second business activity would create greater traffic density. 3. lighted neon sign would be objectionable to surrounding property ibrners . 4. Manned widening of Section Street would decrease further the site size and increase the objections listed in item (1). Motion carried unanimously. There being no further business, meeting adjourned.
