Absent: Chairman Frederick. I — Visitors: Mrs. Murray, Dunham, Williams, Mr. Bateman, Dial, Guth1krie, Aust, Sanders, Taylor, Smith and Keene. Mr. Macon served as Chairman. Reading of the previous minutes 'was omitted. It was brought out that Mrs. Dunham's property had not been subdivided but that parcels were being, and had beenasold with metes and bounds description; that 10 feet easement was insufficient to provide either utility easements or access to back property; also, that 128 feet is less than minimum size recommended for filling station'*s. No opposition was present. Dan Valrie adjoining property owner on corner of Young and middle stated he favored rezoning. 4. Public hearing on Application of matt Dial Jr., to rezone from R-2 to R-3 lots 49 S, 6, 19, 209 21 „ Block 12 of Volanta. Mr. Dial, Don Smith, Andrew Taylor and Glen Keene were present for this case. The latter three were not necessarily opposed to multiple dwelling but wished more detailed information on the type of building. Mr. Dial stated that he had no finished plans at present but that the structure would be built on accordance with R-3 rggulations; that since the back yards of the Fairwood Blvd., lots were on Gayfer Avenue his Gayfer Avenue lots were not desirable R-1 property. NEW BUSINESS: Motion by Mr. Arnold, seconded by Mr. Kirk that the application of Douglas wade Dftft "Better Burger" to rezone from R-2 to B-1 lot 19, Block 16, Volanta Subdivision, a triangle bordered by North Section St., Pensacola Avenue and Perdido Avenuefbe accepted for advertising for public hearing at the next regular meeting, Motion carried. DECISIONS: 1. motion by Mr. Gates, seconded by Mr. Parker, that the Fair - hope Planning and Zoning Commission recommend to the City Council that the property of Mrs. Sadie R. Dunham on Greeno Blod., in the police jurisdiction not be rezoned from R-1 to B-1 as it is not properly subdivided, is not adequate in size for the intnnded use") the easement is not sufficient and the back property is land -locked. bask Motion carried unanimously. 2. Motion by Mr. Arnold, seconded by Mr. Kirk that the Fairhope Planning and Zoning Commission recommend to the City Council the rezoning from R-1 to R-3 the property of Mrs. Orphar E. Shepard located on Parker Road in the police jurisdiction in view of the tact that the property is ideally suited for the intended use and that no opposition was present. Motion carried unanimously. 3. Motion by Mr. Pitman, seconded by Mr. Arnold that the Fairhope Planning and Zoning Commission recommend to the City Council the rezoning from R-2 to B-1 the property of Herbert and Maggie Wil- liams located on Middle St. Motion carried unanimously. 4. Motion by Mr. Gates, that the Fairhope Planning and Zoning Commission recommend to the City Council that the rezoning ap- plication of Matt& Dial not be approved. Motion died for lack of a second. Boting Yes: -Members Macon, pitman, Box, Bung, Arnold, Kirk, Parker. Voting No: Member Gates. The Fiscal Year of the City of Fai rhope beginning on October 1, election of Chairman was in order. Mr. Pitman nominated Mr. John Parker, Mr. Gates seconded the nomination. The acting Chairman moved that the nominations be closed and Mr. Parker be elected by acclaim. Motion carried unanimously. A sppecial meeting was called for Wednesday, October 70 1970 at 5000 P.M.# to discuss revisions bf by-laws and to view a film of interest to Planning board members. There being no further business, meeting adjourned.
