HomeMy WebLinkAbout08-03-1970 Regular and Public MeetingFAIRHOPE PLANNING AND ZONING COMMISSION The Fairhop.e-Planning_and Zoning Commission met in Regular and Public session, Monday, August 3, 1970'at_�s'30-P:M., at the City Hall. The following were g present` Members Macon, -Pitman, Parker, Box, Arnold and Gates. Absent: Members Bung, Kirk and Chairman Frederick. Visitors: Mr. and Mrs. Middleton, 'Mr. and Mrs. Dawson, Mr. Frye, Mr. Valentim, Mr. Earle, Mr. Wedey, Professor Boykin and Mr. Dyson. In absence of Chairman, Mr. Pitman presided. Minutes of previous meeting approved as read. Public hearing on application of•Charles Earle to rezone from R-2 to B-1, lots 20 and 21, Block 16, Volanta as recorded in Book 1, Page 341, Probate records of Baldwin County, Alabama. Mr. and, -'Mrs Middleton, Mr. and Mrs. Dawson, Mr. Frye, Mr. Valentim appeared in opposition with Mr. Valentim as spokeman: The neighbor wished to retain its residential zoning with no infringement of business. Mr. Earle explained that he was agent for 7-11 Food Stores, Jr. Food Stores of Alabama, who wished to erect an outlet at this location similar to store in Daphne. After questioning by Commission, the visitors were dismissed. Professor A. E. Boykin submitted application to rezone from R-2 to R-3 property on -Twin Beach Road at kk-South Section Street in the - Police Jurisdiction described as follows: Motion by Mr. Macon,�seconded by Mr. Gates that rezoning application submitted by A. E. Boykin be accepted for advertising for public hearing at the next rggular meeting. Motion carried. b Mr. Ed Warley, Realtor, appeared with rezoning application for the Northwest Corner of Greeno Road and Volanta Avenue, but when he explained to the Commission that he wanted a use variance he was directed to the Adjustment Board. DECISION: The application of rezoning of Charles -Earle was discussed in depth. It was agreed that the proposed widening of North Section Street did not automatically preclude rezoning but at the increased traffic generated by this type of business would ag§r vate the already hazardous vehicular conditions of this particular location, also, a business open until 11:00 P.M., was not desirable on a lot adjoining a residential lot. Motion by Mr. Arnold, seconded by°Mr. Gates, that for reasons listed above the Fairhope Planning and Zoning Commission recommended to the City Council that the application of Charles Earle to rezone from R-1 to B-1, lots 20 and 21, Block 16, Volanta be denied. Motion carried. A revised preliminary plat of Ed Niemeyer's Subdivision of Plat B was inspected and noted that of the four changes requested only the latter of approval from the Single Tax Corporation was lacking the Colony Cpuncil not meeting until August loth. motion by Mr. Macon, seconded by Mr. Parker that conditional preliminary approval given July 3rd still be in effect until letter from Colony is placed on file. Motion carried. Mr. Dyson, Building Inspector, displayed sketch of addition to rear of Fairhope Hardware, and approved by Commission. The problem of pri- vate alley behind this building was discussed briefly. Mr. Macon introduced the following Resolution: RESOLUTION WHEREAS, the City of Fairhope has applied for Federal assistance applicable to the provision of certain recreational facilities and im- provements which shall be provided for its citizens, and WHEREAS: Pursuant to the provisions of the Land and Water Con- servation Fund Act:;.effective January 1, 1965, which provides for Federal grants-in-aid in amounts up to 50 percent of the cost of develop- ing outdoor recreation areas and for the provision of certain recreation facilities, and WHEREAS; It has been determined that the City of Fairhope, a political subdivision of the State of Alabama, meets the qualifi- cations for acquisition and development grants-in-aid as authorized in the aforementioned act, and WHEREAS, the staff and members of the commission, in accordance with Circular A-95 United States Bureau of Budgets, have reviewed said application and submits its findings to wit: 1. The proposed acquisition meets the basic objectives as out- lined by the Bureau of 0 tdoor Recreation with regard to the Land and Water Conservation Fund Act, 1965; 2. The project is desirable and in the public interest as it has been demonstrated that this area is vitally needed for con- tinued use as a park, and is the access to Fairhope pier and its related facilities. 3. The project is consistent with and meets the goals and objective: of the State of Alabama Comprehensive Outdoor Recreational Plan, as well as, such plans developed by the South Alabama Regional Planning Commission and The Community Facilities ;plan, City of Fairhope, Fairhope Planning Commission; THEREFORE, BE IT RESOLVED by the South Alabama Regional Planning Com- mission this 3rd day of August, 1970, that it does the same and here- by endorse and recommends the above referenced 'c tion for funding inaccordance with the provisons applicable to t d and Water Con- servation Fund Act of 1965. Tract, exclusive of right-of-way uses, contains 3.121 acres, net, assessable land; in the Nutt of the NWf of Section 29, Township Six South, Range Two East, Baldwin County, Alabama. Land located at the Southeast corner ofSection Street and Twin Beach Road in the police jurisdictiori of the City of Fairhope.
