Special and Public meeting

Present: Chairman Fredericks, members Pitman, Macon, Niemeyer, Bung,
Arnold, Bagnell, Bishop. Mr. Bishop replaced Mr. Spader as council
representative.
Absent: Member Gates
Visitors -Mr. Rickarby, Bailey, Cummings, Mr. & Mrs. Sheldon, Mrs.
Walker, Mr.& Mrs. Fry, Mr. Valentim, Minuto, McCoy, Dyson, Mr. & Mrs.
MIddleton.
MInutes of previous meeting approved as read.
Mr. Macon read Ord. # 405 as explanation for this special meeting;
said ordinance giving Planning Commission authority to condider
appeal cases formerly acted on by the Board of Zoning Adjustments
and Appeals.
Case # 157 Appeal of Newman Industries, Inc. for use variance rel-
ative to property located at 109 S. Section Street and approval of
building application, eejected by building inspector under Sections
14 and 72, Article 7.
No opposition appeared. Mr. Cummings explained purpose and need of
variance, answered inquiries as to parking for additional employees.
Case #155 Appeal of Major Ray for permit to erect garage apart-
ment at 803 Coleman Avenue. Rejected by Building Inspector for inter-
pretation of Article 7, Sec. 71. Mr. Ray did not appear; no opposi-
tion present.
Case #156 Appeal of Mildred Patton for permit for atlerations to
building at 307 Perdido Avenue. Rejected by Building Inspector under
Article 11, Sections 14, 15, 17.
Mr. Bailey, Attorney, expained that Mrs. Patton wished to enclose
porch which if closer to property line than present ordinance requires
had been there for several years. Mr. and Mrs. Sheldon, Mr. Valen-
tim, Mrs. Walker, Mr. and Mrs. Fry, Mr. Minuto, Mr. and Mrs. Middle-
ton opposed this application. Discussion brought out facts that Mrs.
Patton was operating business in this residence which had outgrown',,
"Home Occupation" ad' defined in Ordinance 295 'Section 66 Article U.10,
that business parking created traffic congestion at times that any
increase in size of building might lead to increase in size of business.
A petition from Airy Hgts. Section concerning 28 names and requesting
that this section remain strictly residential and free from any type
of commercial activities was placed on file.
Decisions:
Case #157, Newman Industries, Inc. motion by Mr. .Macon, seconded by
Mr. Bagnell, that the planning Commission recommend to the City Coun-
cil that the appe al of Newman Industries, Inc., be approved provided
that vehicles of all personnel be parked other than on Section Street.
Motion carried unanimously.
Case #155 major Ray. motion by Mr. Bagnell, seconded by Mr. Bang that
application of Mr. Ray be declined until further information is avail-
able. Motion carried unanimously.
Case #156. Mildred Patton. Motion by Mr. Bagnell, seconded by Mr.
Arnold that the planning Commission recommend tb the City Council the
approval of the building permit to enclose porch and that the Secre-
tary be instructed to notify Mrs. Patton by letter that the building
now existing is in violation of the City Ordinance and that the re-
cords of this meeting show that this commission recommends the issuance
of no further building permits hereafter.

Voting Nay: Chairman Fredericks, members Bung, Niemeyer, pitman,
Bishop.
Motion defeated.
There being no further business meeting adjourned.
