Regular meeting, Monday Feb. 59 1968

Present: Chairman Fredericks, members Macon, Gates, Bung,
Arnold, Pitman, Niemeyer.�`��
Absent: member BAgnell
Visitors: George Dyson, Eugene Bosby.
Motion by Mr. Macon, seconded by Mr. Arnold that the minutes
of the previous meeting be approved as read.
There was no obd business.
New business. Application of Eugene Bosby to rezone ^g,
from R-1 to B-1 property descibed below, located on Young
Street —outside t.he—city-limits but within#ihe police juris-
diction: _ 11
Motion by Mr. Arnold, seconded by Mr. Bung, that the re-
zoning application of Eugene Bosby be accepted for adver-
tisin§ for public hearing on March 4, 1968. Motion carried.
S ugguested new forms for subdivision approval and rezon-
ing applications were discussed; it was agreed that Mr.
Macon, Mr. Niemeyer and Mr. Dyson would study the forms
and repoo`rt recomme"iations to the next meeting.
Mr. Arnold moved the adoption of the following resolution:
BE IT RESOLVED that the Fairhope Planning and Zoning
Commission request the City Council to direct the city at-
torney to prepare appropriate ordinance to prevent the
paving of streets in subdivisions which have not been ap
proved by the Planning Commission and/or in which utility
lines have not been installed.
BE iT FURTHER RESOLVED that the ordinance prepared be
submitted to the Planning Commission for consideration
before being referrred to the City Council for action.
Mr. Macon seconded the motion. Motion carried unanimously.
There being no further business meeting adjourned.

PROCEDURE FOR RE -ZONING
1. Copy of Zoning Ordinance application to:

2. Application should contain:
(a) corl ect legal description (attach copy of deed)

(b) vicinity map to enable Planning Commission to readily
identify property
(c) anticipated time of construction to begin
(d) type of business if "C" zone; type of industry if "I" zone
(e) preliminary sketch of "C" and "I" zone property showing
drawings, street parking

Cost for: (a) advertising public hearing by Planning Commission
(b) if Planning Commission recommends re -zoning
(c) advertisement by Mayor -Council in newspaper

5. Mayor -Council have subject property advertised in newspaper and 'Zoning Inspector
posts the property.
6. After public hearing by Mayor -Council, they can:
»� (a) approve application which means an amendment to the
Zoning Map,

(b) disapprove application
7. If application is disapproved, the applicant can take the case to the Circuit Court,
then to the Supreme Court.
