HomeMy WebLinkAbout10-03-1966 Regular and Public MeetingIs v FAIRHOPE PLANNING AND ZONING COMMISSION October 3, 1966, 7:00 P.M., City Hall Regular and Public Meeting Membe present: Chairman Frederick, Members Macon, Gates, BagneP, Bung, Niemeyer, Arnold and Spader. Member Absent: Pitman. Visitors, Bateman, Dyson, Yobn, Indilstrial Board Members and approximately fifty interested citizens. Minutes of regular and special meeting approved as read. No old business. 1. New business: Application of W. 0. Poser to rezone from R-1 to B-2 the following described property: Approximately the EAST Half of the following described property, to wit: South Half except the South 26 feet of the Kest 6451 ft., thereof of the North Half of the Sbutheast (Quarter of Section 17 of the land of the Fairhope Single Tax Corporation, in the Town of Fairhope, Alabama. W. 0. Poser, Jr., displayed sketch of proposed building and site plan, showing set back. John Robertson, Chairman of the Ind0strial Development Board reported that his board endorsed this application unanimously. Of the eight property owners within 300 feet notified, six appeared in protest, only Home Investment Corporation, and Corte Realty, not appearing. Objections voiced were that the entire area is residential in character and should remain so, that "spot" zoning is bad, and that long range planning and land use study of Greeno Blvd., is needed badly. Numerous other property owners in the general vicinity, fearful of the spread of rezoning, voiced similar objections. Mr. Phil Yoes, Mr. Robert Green, spoke in favor of rezoning. Mr. Poser Sr., stated that his firm has been offered land in other communities but he would like to keep his business with its large payroll and many home owners in Fairhope if possible. 2. Application of EugeQe Bosby to rezone from R-2 to B-1, lot 8 Denton Subdivision. It was pointed out that lot 5 and 6 were zoned B-1, that lot 89 which for many years has been location of a neighbor- hoo tore needs to be zoned B-1, to permit remodeling of store and that25' 9& lot 7 between, logically should be included in rezoning.. Charles Winston, tenant and part heir of lot 7 questioned how re- zoning would affect him and upon being assured of no adverse affects, stated he had no objections. 3 Clearing the room bf visitors, the Commission then discussed the applications. Motion by Mr. Arnold, seconded by Mr. Bung that the Fairhope Planning and Zoning Commission recommend to the City Council the rezoning from R-2 to B-1, lots 7 and 8, Denton's Subdivision . motion carried unanimously. Motion by Mr. Macon, seconded by Mr. Bung, that the application of Walter 0. poser Sr., to rezone,frpm R1 to B2 be taken under advisement before a definite disciL &on is reached. Motion carried unanimously. Mr. Bateman suggested delineation of long range code enforcement program be placed on agenda for next meeting and it was so agreed.
