Regular & Public Meeting
Friday, June 3, 1966
4 P. M. - City Hall
Presents Chairman Frederick, Members Niemeyer, Bung, Arnold,
Macon, Gates, Pitman
Absents Members Spader, Bagnell
Visitors: Mr, Bateman, Yohn, Dyson, and approximately thirty
property owners interested in rezoning application.
First order of business was public hearing on rezoning from B-3
to R-3 the following described propertys
Bounded on the West by Mobile Bay shore line, then
by a line running East between Atkinson Lane and Magnolia
Avenue to Summit Street, then South on Summit Street to
a point between Fairhope Avenue and St. James Street,
then West to a point approximately 400 feet East of
Mobile Avenue, then irregularly Southeast to Pier Street,
then West on Pier Street to the Bay shore.
Mr. Lacey,representing property owners desiring rezoning,plaeed on
file a petition with approximately 70 signatures favoring R-3 zoning
and stating that features of present B-3 zoning are objectionable
to this group. Mrs. Brownell and Mr. Wilder preferred R-1 for their
respective districts; Mrs. Melrose, Bennett and Parker spoke against
signs permitted in B-3 district.
Mr. Rickarby, representing Mr. Forsman, Overton, and Dr. Godard -
all three presently operating businesses in this B-3 area stated
that none of their immediate neighbors objected to these businesses
but that rezoning to R-3 would create hardships as non -conforming
uses.
Mr. Gaston, spokesman for Fairhope Single Tax Corporation, stated
that several leaseholds in area now used for business are not
suited to residential use; that beaches and access streets need to
have tourist accommodations. Dr. Godard stated that his building
on the.corner of Summit & Fairhope Avenue had been a drug store since
1916, was not suited for a residence but as a non -conforming use he
could make no changes in character or use of building. George
McKean, conducting business in old Klumpp Motor Co. building (Bayview
and Fairhope Avenue), thinks area being considered for rezoning too
large; that present zoning is desirable in some parts but not in all.
Mr. Lacey requested the Planning Commission to reconsider the entire
area in question to ascertain in just which sections rezoning is
desirable.
Amon Gates presented for preliminary approval Fairhaven #1 subdivi-
sion designed for R-3 area but located in R-2 zone. He was
instructed to file application for rezoning from R-2 to R-3 that
property involved in Fairhaven # 1.

Letter from Ack W. Moore, City Engineer, was read in which city
requested a variance in order to pave a cul-de-sac at east end of
Grand Avenue as per plans attached. Motion by Mr. Arnold, seconded
by Mr. Macon, that the Planning Commission notify the City Council
in writing, that variance requested is agreeable to Commission.
Motion carried unanimously.
Upon inspection of building applications presented by building
Inspector following action taken:
(a) George Fowler to build on Jansen property, Greeno
Road, meeting all requirements, approved.
(b Percy Pose, Jr. to enclose and add on to trailer,
Motion by Mr. Pitman, seconded by Mr. Macon, that application be
rejected as not in accordance with Sections 66.25 and 66.6 of
Zoning Ordinance. Motion carried.'
(a) Sunset Inn to make addition to existing building -
Motion by Mr. Macon, seconded by Mr. Pitman, that Sunset Inn be
instructed to resubmit application showing adequate off-street
parking. Motion carried unanimously.
Motion by Mr. Macon, seconded by Mr. Pitman, that application to
rezone from B-3 to R-3 the following described property:

be denied and that the Planning Commission study the area in smaller
sections with the view of rezoning as appropriate to neighborhood
usage. Motion carried unanimously.
Mr. Bateman displayed partially completed map showing sub -standard
housing and suggested that city needs a full-time building inspector
to expedite this survey. Motion by Mr. Bung, seconded by Mr. Gates,
that the Planning Commission recommend to the City Council that,
sing a present employee, a building inspector be appointed to give
full time service to housing survey map in order that it may be
completed by the July meeting. Motion carried unanimously.
Motion by Mr. Pitman, seconded by Mr. Arnold, that the Planning
Commission recommend to the City Council that all municipally owned
buildings be surveyed and dilapidated or sub -standard buildings be
repaired or removed. Motion carried unanimously.
Traffic conditions on Section Street were discussed but no action
taken.
