Absent: Mr. Gates Visitors: Mr. Bateman, Rickarby, Rosenquist, Foster, Lacey, Mrs. Wood, Mr. and Mrs. Todd, Mr. and Mrs. H jellum, Mr. Berglin, Billie McGregor, Niles, Poser, Stroop, Wyllie and Green. Q ''.1 •.:fit Mr. Lacey spokesman for the opposition declared it is not to the best interest of the City nor neighborhood to rezone; Mr. Poser, Rickarby and djellum, nearest neighbors spoke against; Mr. Green, adjoining property owner was agreeable. Application of Dr. C. G. Godard to rezone from R-2 to R-3 lots 17, 18, 19, Block 31 Central Park Addition. No op- position appeared in this case. Application of C. W. Mr. Stroop of Michigan Avenue appreared to protest; Mr. and Mrs. Todd, adjoining property owners had no objection. Mr. Gable explained that he wished to establish restaurant on this property when the lease of his present business ex- pires. Application of M. 0. Berglin to rezone from R-2 to R-3, the following described property: Begin at the SE Cor. of NEa of SEa of Sec. 199 T6S, R2E; run thence E. 863.3 feet to point in the small gull; thence N 080 45' E, ;05.4 ft.; N 56 40' E, 90.7 ft.; N 06 401E up said gully 209.6 ft. to another small gully; thence N 740 25' W, 359.3ft; kind N 260 12' West, up said gully, 323.9 ft. to point in middle of Big Head Gully; thence up middle of Big Head Gully to a point on the South line of Block 53, Magnolia Beach Addition to the Town of Fairhope, Ala.; thence run N 560 34' W, 479.2 ftto pt. on North line of said NEa of SEa; thence West 696.6 feet; thence South 000 23' E, 1329 ft. to a Point of Beginning.24.7 acres more or less, in NEa of SEa of Sec. 19, T6S, R2E, lying partly within partly outside of, the Corporate Limits of the City of Fairhope. No opposition was present. New Business: Application of R. G. Ros enquist to rezone from R-2 to R-3 the North 80 feet of Lots 13, 14, 15, B1. 6 Mag- nolia Beach. Motion by Mr. Pitman, seconded by Mr. Bung that the above application be accepted for advertising for public hearing ' at next regular meeting. Motion carried. Application of Kenneth Brister for building permit in un- approved section of Bay View Subdivision on Lincoln Ave.: Motion by Mr. Pitman, Seconded by Mr. Arnold, that the building inspector be authorized to issue permits for Y CLI building 10t 34 of Block B, Bay View Subdivision on Lin- coln Rvenue with the requirement that the recipients un- derstands he will pay for his share of the paving if and when the City decides to pave Lincoln Avenue and that the City assumes no responsibility for the opening or the main- taining of Lincoln Avenue. motion carried. Plat of Fairhaven #1 Subdivision of A. M. Gates submitted by Mr. Niemeyer, motion by Mr. Frederick, seconded by Mr. Arnold that the approval be denied for the following reas- ons: (1) Subdivision should be redesigned connecting Fairhaven Place with Grand Ave., (2) evidence be given that full easements are available where only 71 feet ease- ments are shown on plat by reference to recorded plats or copies of recorded plats of adjoining subdivisions.(3) if Fairhaven Place, a cul de sac remains, a mai minimum radius of 50 feet be required. motion carried. Decisions: Motion by Mr. Arnold that T. E, Dyer's application to re- zone be granted. motion died for lack of a second. Motion by Mr. Bagnell, seconded by Dr. Stine that the ap- plication of T. E. Dyer to rezone property at the corner of Greeno Blvd., and Volanta Ave., be denied awaiting completion of land use analysis and plans of the section of the City. motion carrie d. Motion by Mr. Pitman, seconded by Mr. Bung that the Fairhope Planning and Zoning Commission recommend to the City Council that C. W. Gable's application to rezone be approved ab pre- sented on basis that this piece of property is touched by B-1 on three sides. motion carried. Motion by Mr. Arnold, seconded by Mr. Bung that the Fairhope Planning and Zoning Commission recommend to the City Council the rezoning from R-2 to R-3, lots 17, 18, 19, Bl. 3, Central Park as requested by Dr. Goddard. motion carrie d. Motion by Mr. Bung, seconded by Mr. Pitman that the Fairhope Planning and Zoning Commission recommend to the City Council the rezoning from R-2 to R-3 property described in U.
