HomeMy WebLinkAbout01-07-1966 Regular and Public MeetingFAIRHOPE PLANNING AND ZONING COMMISSION REGULAR AND PUBLIC MEETING Friday January 7, 1966, 4:00 p.m. r The Fairhope Planning and Zoning Commission held their regular and Public meeting Friday January 7, 1966 with Chairman and all members present. Minutes of previous meeting approved as cor- rected changing "west side" to "east side" of South Mobile Ave., in Brown Tract description. Old Business: (1) Request of G. L. Kuhlman to rezone from R-1 to R-3, lots 19, 20, 21 block 2, Fairland Heights. Mrs, Cary Garner adjoining property owner stated that she had no objection to rezoning if all buildings had set -back line with her home to which Mr. Kuhlman was agreeable. •f� Request of T. H. Brown to rezone from R-2 to B-3 the ar,, t bf tct = b nq--3 present:, A large group of adjacent property owners appeared to pro- test; petition and letter of protest was placed on file. Mr. Richard Lacey, attorney, as spokesman for group argued that high - density usage of trailer court was not compatible with the neigh- boring land usage; that the original zoning of R-2 for the east portion of Parcel D was intended as buffer zone between highway B-3 zone and residential area. (3) Request of Donald Olds to rezone from R-2 to R-3 lot 3 and north 33.75 feet of lot 4, block 7, Volanta Subdivision. It was noted that the original application and advertisement description was in error. Property owners appearing to protest were zPapcg represented by Leo Keller who stained that tax wise some of the most valuable property in City is located in this area; that R-3 zoning will depreciate the property/ at proposed buildings will crowd the lot and that sanitary faLlities will not meet state health department requirements. 1k Mike Ford representative of owner said client wished to locate out of heavy -traffic district, that first class buildings will be erected and conventional financing will be used. NEW BUSINESS: (1) Claude Arnold presented Re -Subdivision of lot B of Subdivis- ion of Taylor Tract in William Patterson Grant, consisting of lot 1 a -53.1 feet to be acquired by adjoining property ownerk and lots 2 and 3 of 275 feet each. He stated that he had obtained percolations thst approval from Baldwin County Health Department, Mr. Bateman suggested that lot 1, being substandard in size, be sold on metes and bounds description and lots 2 and 3 be renumbered 1 and 2. Motion by Mr. Macon, seconded by Mr. Bung that prelimin- ary and final approval be given resubdivision of lot B in Taylor Tract in Wm Patterson�&.��� ubject to above mentioned changes. Motion carried, Mr. ArM1§ t' voting. (2) Kenneth Brister application to build on Lincoln Avenue, plat- ted but not open, in Bay View Subdivision presented; Planning Com- mission referred it to City Council. (3) Contract of .Mr. Bateman, planning consultant, expiring in February, motion by Mr. Bung, seconded by Mr. Pitman that the Planning and Zoning Commission recommend to the City Council that Robert Bateman and Associates be retained as Planning Consultants for the remainder of present administration, a period of two years and eight months, with thirty day cancellation priviledge for either party. Motion carried. (4) Following discussion on future plans and policies for the Commission the Chairman was instructed to arrange a special meet- ing with members of Council, Adjustment Board, Chairmen of Recrea- tion Board and Industrial Board and Planning Consultant on Monday, January 31, at 7:30.p.m. DECISIONS: (1) Motion by Mr. Arnold, seconded by Mr. Niemeyer that the Planning Commission recommend to the City Council the rezoning from R-1 to R-3 lots 19, 20, 21, block 2, Fairland Heights as re- quested by G. L. Kuhlman. Motion carried, It is the desire of the Commission that all buildings on this property have set back equi-distant to adjoining property and noted in minutes that Mr. Kuhlman has agreed. (2)Motion by Mr. Macon, seconded by Mr. max Bagnell that the requqr0E of T. H. Brown the rezoning part of Parcel D, Brown Tract from _ o be rejected. Motion carried unanimously. f a (3) Motion by Mr. Gates, seconded by Mr. Arnold that in the ap- plication of Donald Olds the applicant obtain approval from the Baldwin County Board of Health on sanitary requirements after which the Commi n will take action on his request to rezone from R-2 to R-3 as,.ha north 33.75 feet of lot 4, block 7, Volanta Sub vision, Motion carried.
