FAIRHOPE ZONING AND PLANNING COMMISSION
:FRIDAY, NOVEMBER 5, 1965
4:00 p.m.- City Hall, Fairhope, Alabama
PRESENT: Members Niemeyer, Bung, Stine, Arnold, Pitman, Macon.
ABSENTS Chairman Frederick, Members Gates, Bagnell,
VISITORS: Mr.and Mrs, Kuhlman, Dyson, Yohn, Mr. and Mrs. Ed
Niemeyer, Mr, Peavy, Mr. Mossholder.
In absence of Chairman, Mr. Macon presided.
Claude Arnold was introduced as new member.
Minutes of October meeting approved as read. (/
Old businesss
Secretary reported no council action had been taken on the 1957
rezoning application of W. L. White at that time.
New Business:
G. L. Kuhlmans' application to resubdivide lots 19, 209 211, Block
29 Fairland Hights into two 70 foot lots.
Mr. Kuhlman explained that lots 20 and 21 were each 50 feet wide.
Lot 19 was only 40 feet; all 150 feet deep; his two new lots would
contain 10000 square feet, larger than the average lots in Fair -
land Heights but not large enough to satisfy requirements of the
R-1 Zoning. He was told to appear before the Adjustment Board to
request a variance in lot sizes.
The Secretary was instructed to inform the -Adjustment Board that in
the opinion of the Planning Commission that since this resubdivision
would up grade the lot sizes they strongly recommend the granting of
this variance, after which they will give final approval to the re -
subdivision.
Application of Lloyd Vick to rezone from R-2 to B-2 lot 6. East 3
feet of LOt 79 West 3* feet of alley in block 139 Division 19 Fair -
hope Single Tax Colony lands, totaling 54 feet wide and 167 feet
deep, located at 306 Delmar Street. Mr. Arnold speaking as member
of the Fairhope Single Tax Colony requested addition of all Colony
land on the South side of Delmar Street from the building presently
occupied by the Southern Bell Telephone office to Church Street.

Motion by Mr. Niemyer, 2nd by Mr. Bung, that the Fairhope Planning
and Zoning Commission accept for advertising the rezoning applica-
tion of Lloyd Vick and the Fairhope Single Tax Colony if the latter
is presented in proper form. Motion carried unanimously.
Ed Niemeyer requested permission to relocate small rental house
located on his property at Ingleside and Fairhope Avenue.
Motion by Mr. Pitman, secnded by Mr. Bung that Mr. Niemeyer be is-
sued a permit to accomplish the above under Article IV, Section F
Group Housing" of the Subdivision Regulations. Motion carried
unanimously.
Building inspector presented an application to locate a steel
storage shed on rear of lot 22, block 5. Volanta, corner of Section
and Miller Street. Following general disoussion, Mr. Dyson, Building
Inspector was authorized to refuse building permit on gro s that it
does not conform to the original plans approved by the P1 ing Com-
mission.
Application of Tom Brown to build storage shed at 211 South Mobile
Avenue in B-3 Zone was given Planning Commission approval as pre-
sented as conforming to all regulations of B-3 Zone.
There being no further business, meeting adjourned.
