Visitors: Mr. Bailey, hr. anYMrs. Odom, Mr. Crass, Mr. Jones, Mr. and Mfrs. Eric Woods Mrs. Fred Woods. Mrs. Hedden, Mrs. Stimpson, Mr. and krs. Clay Mrs. Minuto, Mr. and Mrs. Schermer, Mr. and Mrs. henry appearing in opposition to McDonough rezoning request; Mrs. McDonough, Mrs. Stewart, Mr. Wilson, Mr. Cummings, Mr. Woodson, Mr. Smith in favor of McDonough rezoning; Mr. Mossholder, Dyson, Yohn, Warley, Rickarby, Todd. Action on appointing Chairman to replace Mr. Woolle having been tabled until this meeting, Mr. Pitman nominated and Mr. Gates seconded Dr. Pierce Frederick as Chairman. Mr. Macon moved nominations be closed, Mr. Stipes seconding the motion. The secretary was instructed to cast an unanimous vote for Dr. Pierce Frederick as Chairman. OLD BUSINESS Request of R. E. McDonough to rezone lots 14, 15, 16, block 4, Airey Heights, located on West side of North Section Street between Grand and Perdido, from R-2 to B-1. Petition containing approximately 44 signatures of area property owners objecting to rezoning was placed on file. Mr. Schermer acted as spokesman for the opposition. Mr. Wilson spoke in favor of rezoning. Visitors interested in this case were then dismissed. NEW BUSINESS Request of W. R. Todd to rezone from R-2 to B-2 the following described property "Land in SW 1/4 of tAV 1/4 Sec. 16 T6S R2E Baldwin County, Alabama and in the City of Fairhope, having a depth from Greeno Road of approximately 89 feet .`a DPP-i- . s89 if� , Motion by Mr. Stipes, seconded by Mr. Pitman that the above des- cribed rezoning request be accepted for advertising for public meeting. Motion carried unanimously. Question of subdivision control within the five mile limit set by ordinance but also within police urisdiction of Daphne discussed; decision was that while Fairhope Planning Commission would be glad to offer advice and assistance if desired by . subdivider, they will not assume control over such subdivision. 5.a Letter from Mr. Warley asking for written opinion on zoning status of beach property commonly known as 'Berglin Beach Property". Mr. Rickarby and Mr. Bailey, Attys. representing adjoining property owners also present. Mr. Mossholder pointed out that Sec. 13, P. 2 Zoning Ordinance reads "Questions con- cerning the exact location of district boundary lines shall be decided by the Board of Adjustment." Mr. Niemeyer was instructed to confer with City Attorney and engineers to determine what action should be taken by the City in regard to this property. Action of McDonough rezoning request. Motion by Mr. Gates, seconded by Mr. Pitman that the Fairhope Planning and Zoningg Commission recommend to the City Council the rezoning from R-2 to B-1 lots 14, 15, 16, block 4, Airey Heights with the stipu- lations that (1) a buffer zone either of planting or ornamental fence be placed on the west boundary and (2) that final plot plan for proposed land use be presented to Planning Commission for reviewal and acceptance before issuance of building permit.
