Present: Chairman Woolley, members Pitman, Bagnell, Niemeyer, Frederick,
Stipes, Gates, Bung.
Absent: Member Macon
Visitors: Idr. Dyson, Yohn, Bateman, Stewart, Arnold, Huffman, Lipscomb,
Todd, Parker, Cummings, Wilson, and a group of property owners
from Miller Street section.

OLD BUSINESS:
Request of John C. Glover to rezone from R-2 to B-1 lots 22, 239 24
Block 5, Volanta, located on Northeast corner of Section and Miller Streets.
Appearing to protest were A. H. Allen, H. W. Smith, George F. Johnson,
I•;rs. Charles Woodward, Mrs. A. E. Clements, each of whom identified
themselves by name, address and lots owned. Mr. Allen, spokesman for
group,' stated he was representing also Mrs. Foy, Firs. Hudson, Firs.
Keller, Mr. Brunson and Mr. Rice all unable to be present and that all
property owners objected to any business zoning as detrimental to the
residential area and dangerous for small children living on street.
Yx. Huffman, representing 141r. Glover, gave reasons for rezoning.
The question of restrictive covenants on block 5 having been introduced,
b;r. Bateman volunteered a title search, the results of which will be
reported at the March meeting at which time action will be taken on
rezoning request.

1Mx. Lipscomb, principal of high school was present as representative
of School Board but expressed no official opinion.
Kotion by Yx. Pitman, second by 1r1r. Stipes that the Fairhope Planning
and Zoning Commission recommend to the City Council the above requested
rezoning. Voting aye: I+Ir. Pitman, Bagnell, Niemeyer, Stipes, Gates,
Bung; Nay: None. Kr. Frederick abstained. Motion carried.
Planning Consultant, Mr. Bateman suggested that Planning Commission
write the local School Board and Principal offering assistance in off
street parking problem.

T-lotion by Mr. Stipes, second by •Gatdpw-that the Fairhope Planning and
Zoning Commission write the letter as suggested by Mr. Bateman. Notion
carried unanimously.
NEW BUSINESS:
,,rs. Tolora B. Robinson resubdivision of lot 6, block 4, Golf Course
Subdivision, Fairhope Single Tax Corporation lands presented by 0. 0.
Stewart surveyor for preliminary and final approval. Eotion by Mr.
Pitman, second by i-,r. Gates that preliminary and final approval be given
Tolora B. Robinson's resubdivision as per plat presented. Motion carried
unanimously. Mr. Stewart was comm ended or excellent plat.

The east 200 feet of property to be rezoned from R-2 to B-2 the balance
of property to be rezoned from R-2 to 14-1. I -lotion by Mr. Stipes, second
by Mx. Gates that the rezoning application of W. R. Todd be acdepted for
advertising. Motion carried unanimously.
Two rezoning requests of L. I. Boone. Upon examination of the two
applications both applications were returned to Mr. Boone for additional
information and corrections including vicinity maps.
Subdivision of Lyle Euler, represented by Claude Arnold, being a resub-
division of lot 1 and West 33' of block 45, Division 4, F.S.T.C. land,
located on Fairhope Avenue east of Fairwood Boulevard. Accompanying
letter from Mr. Euler was read. Motion by Mr. Bung, second by Mr.
Frederick that Mr. Euler's request for Subdivision be referred to the
Board of Zoning Adjustment and appeals as the subdivision plat as sub-
mitted is contrary to the intent of the subdivision regulations and
both lots as shown would be substandard. motion carried unanimously.
The Chairman announced that the City Council had appropriated �"'?1000.00
for the use of Planning Commission at the Council meeting on January 11,
1965- Motion by Mr. Pitman, second by I1Ir.'Frederick that the Fairhope
Planning and Zoning Commission continue the services of Robert S. Bateman
& Associates as Planning Consultant. Motion carried unanimously.
Mr. Pitman read letter from Highway Committee of the Chamber of Commerce
to be presented to the City Council with recommendations for access
streets and highways improvements. I+iotion by Nr. Frederick, secon y
INIr. Bung that the Fairhope Planning and Zoning Commission, having teet
with a representative of the Highway Committee of the Chamber of Commerce,
unanimously endorses the Highway Committee's proposals and offers the full
facilities of the planning commission in assisting in any way. Motion
carried unanimously.
