Absent: Chairman aVoolleyy, Alembers Spader, kirk, Gaston, Frederick. Visitors: Walter Wilson, P. J. Byrne, James Clarke. In absence of Chairman, P. J. Byrne served as acting Chairman. Minutes of special meeting were read and approved as read. OLD BUSINESS: Greeno Blvd. Committee - no report.Rezoning request of Claude Jansen filed June 16, 1964, withdrawn after advertising July 10, 1964 and reactivated by telephone request on August 3, 1964, delayed until later in meeting. NEW BUS / IVESS : Request of James Clark to rezone from R-1 to B-1 a tract of land approximately 9 acre in size located on East side of Young Street south of Middle Street in the police jurisdiction. Motion by Mr. Schneider, second by Mr. Pitman that the rezoning request of James Clark be accepted and advertised for public hearing for next regular meeting of September 4, 1964. Motion carried unanimously. Letter from ??alph Daughtry concerning approval of building permit on lots 3 and 4 of Gregor Subdivision on Blue Island Avenue, approved plat of said subdivision bearing this notation "The within Subdivision approved and accepted for recording, with the provision that lots 3 and 4 therein are not hereby approved for construction, and that building permits for said lots will be neither requested nor issued until the street improvements have been completed on Blue Island Avenue• this the 9st day of May, 1964. Signed: Fairhope City Planning Commission." Motion by Mr. Bung, seconded by Mr. Bagne l l that f i na l approval be given by the Fairhope Planning and Zoning Commission to lots 3 and 4, Gregor Subdivision, Lots 9 and 2 of said subdivision having been approved Ilay 1, 1964, subject to applicant for building permit posting bond in the amount of one thousand dollars with the City of Fairhope to cover required improvements. Notion carried unanimously. Jansen Rezoning: An opinion was placed on file from the City Attorney stating that re -advertising wqs not reqquired before considering Claude A. Jansen request to rezoning from R-2 to M-1 the following described property From the S.W. corner of Sec. 96 T6S, R2E, run N. 265 ft. and E. 40 ft. , for point of beginningg • thence run fJ. 398.4 ft. • thence run E. 250 ft.; thence run S. 398. 7 ft.- thence run W. 2t0 ft. to beginning; 2.286 acres in Sec. 16, t6S, R2E Baldwin Co., Alabama. e fA -2- Motion b Mr. Bung, seconded by Mr. Pitman that due to fact that Claude Jansen's request for rezoning was advertised for public hearin on July 10, 1964 when no one appeared in opposition and since the request was placed on the agenda for this meeting with no opposition appearing, the Fairhope Planning and Zoning commission recommend to the City Council the rezoning from R-2 to M-1 the above described property.
