FRIDAY, JANUARY 3, 1964
4:00 P. M. - CITY HALL
Present: Chairman Woolley, Members Gaston, Bagnell, Pitman, Kirk, Bung,
Spader, Schneider, and Frederick.
Minutes of previous meeting read and approved as read.
There was no old business.

Applications 4, 7, 12 & 13 of Dr. Stine, gain Hof fren, Mrs. Thos. B.
Montgomery, Corte Realty were withdrawn by written notice presented to
the secretary at this meeting.
A large group of interested property owners were present.
R. A. Malone,.speaking for residents of Ingleside Heights, said 96% were
against rezoning of any part of Ingleside. He placed a petition with 50
signatures on file.
Richard Lacey,, spokesman for Colonial Acres residents, requested no zoning
changes in adjacent areas.
Robert Schneider was against all rezoning on Greeno Boulevard.
Richard Macon was opposed to spot zoning on Greeno.
Clarke Taylor, one of original subdividers of Colonial Acres, stated that
Colonial Acres planners cooperated closely with the planning commission
and appealed to the commission to keep faith with them by maintaining
residential zoning in the area.
Mr. Pearson and Mr. Neal, both new property owners on Greeno stated they
located there because of residential zoning.

Mr..Rickarby was of the opinion that spot zoning would harm the thorofare,
the Communityy Park and the downtown business area.
` George Stejskal, Mr. Hjellum, Mrs. Underhill were against rezoning on
Greeno.
Mr. Robert Green speaking for his rezoning application stated that he
had been in the nursery business at that location for 30 years, the
character of the land is agricultural,, and needs to be rezoned so he can
continue and improve his business.
C. W. Crull stated he had been in business at his location since 1939,
before zoning ordinance was effective had sold parcels of property to two
others who had used the land commercially and thinks the property should
be zoned according to established use.
W. R. Todd said his property had been leased as desirable business
property prior to zoning ordinance and topography of land not suited for
residential use.
C. W. Gable requests rezoning in order to move his business to his
�ropperty on S/E corner Morphy and Greeno.
. Vi..Ingersoll stated he would abide by the will of the majority on
rezoning of Greeno; he further stated this was the decision of the Silver -
hill Farmers Association.
Mr. Bateman advised that each application be considered separately.
Mr. Poser thought that Mr. Bateman should make long range plans and
recommendations on rezonings with all applications tabled until this is
done.
Mr. Ray asked that action be taken today.
Visitors were then asked to withdraw.
Motion by Mr. Schneider, seconded by Mr. Birk that the Fairhope Planning
and Zoningg Commission recommend to the City Council that the applications
of Silverhill Farmers Association, J. V. Cummings,Vincent N. Klein, lot
17, lot 18, and lots 13-15, block 9, Ingleside Heights, for rezoning from
R-1 to B-1 be approved provided that a plat of a buffer zone on the south -
side and the west side of these properties be submitted to and approved
by this commission, and provided further, that this motion not be con-
strued as final approval of these applications.
Following discussion both the motion and the second were withdrawn.
Motion by Mr. Bagnell, seconded by Mr. Frederick, that the Fairhope
Planning and Zoning Commission recommend to the Fairhope City Council that
all applications for rezoning on Greeno Boulevard submitted at this
meeting be rejected. Motion carried unanimously.
Mr. Bateman reported that Mr. Nahrgang had recommended certain changes be
made in zoning ordinance which he would present to the next meetin#.
At Mr. Bateman's suggestion, Chairman appointed R. C. Yohn to set up card
file on all street names to check for similarity of names in any proposed
new streets.
Mr. Schneider requested advice from Planning Commission on licensing of
existing businesses in residential districts and was advised that this was
not within cognizance of Commission.
There being no further business the meeting adjourn Next regular meeting February 7, 1964.
