M. - City Hall Present: Chairman Woolley, members Frederick, Schneider, Poser, Gaston, Bung & Kirk. Absent: Members Pitman, Dyson. Visitors: Mr. Lacey, Dr. Yancey, Mr. Yohn, Dyson, Byrne, Rickarby. OLD BUSINESS: 9. Charbon Woods subdivision of Mr. Duck and Dr. Yancey: Motion by Mr. Frederick, seconded by Mr. Kirk, that the following resolution be adopted: BE IT RESOLVED by the Fairhope Planning and Zoning Commission that the plat of Charbon Woods Subdivision be approved when owners have furnished bond conditioned that concrete curb and gutters on Charbon Drive be installed in accordance with City specifications and in not more than three years from this date or within one year of annexation to the City. Motion carried. Motion by Mr. Frederick,.seconded by Mr. Poser, that the Fairhope Planning and Zoning Commission recommend to the City Council the adoption of B-3 regulations omitted from Ordinance #295. Motion carried. 2. Application of Robert Nahrgang to rezone from R-9 to R-2 a section of Fairwood Subdivision south of Gayfer Street, said rezoning recommended to the City Council by the Commission at their meeting of July 92, 1963, was returned to the Commission by the Council for reconsideration. Motion by Mr. Poser, seconded b Mr. Schneider, that in view of -^ the fact that the area is zonedyR-9 and in view of the feelings of residents of adjacent area, the Fairhope Planning & Zoning . Commission recommend to the City Council that the zoning be main- tained as platted - R-1. Following open discussion the motion and second was withdrawn. The Chairman instructed Mr. R. C. Yohn, assistant to the building inspector, to meet with Mr. Nahrgang to evolve an equitable solution to the problem and to report back to the Commission with recommendations. -2- Secretary was instructed to prepare copies for each member of Robert S. Bateman and Associates proposal for Land -Use Map, etc. Motion by Mr. Gaston, seconded by Mr. Bung, that meeting adjourn. Next meeting Friday, October 4, 1963. Eloise T. Witson, Secretary r 0 ORDINANCE #312 BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PAIRHOPIE, ALABAMA, as follows: .SECTION 1. No sign shall be erected or maintained in the residential districts! R-1. R-2 and R.-3, as established by the Zoning laws of the City of Fairhope, except those specifically allowed under the zoning laws of the City of Fairhope. SECTION 2. Any person who violates any of the pro. visions of this ordinance shall be deemed guilty of misdemeanor and upon conviction shall be fined in a sum not to exceed FIFTY DOLLARS ($50.00). SECTION 3. That eaoh day such signs or bill board is permitted or allowed to remain in such place in *blation of this ordinanoe shall constitute a separate and distinct offense on the part of the person, firm or corporation, who so ereoted, placed or installed such sign, and each such offense shall be punishable by a fine in the sum not to exceed FIFTY DOLLARS ($50.00). SECTION 4. This ordinance shall become effective 180 days after the date of its passage. Adopted this the 26th day of August, 1963.
