S. Hwy. 98, bounded onthe North by hock Creek, bounded on the Etas t by Grant line, containing 28 acres more or less. Visitors interested in this application included: Yrs. Paul Bon- nell,Mrs. Connie Strenght, Connie Strenght , "r., J. V. Cummings, Mrs. Ora P.rjalcomb, Tags. Fred. Farwell, P.L. Wilson, Mr. Corte, I-rs. 1r1arvin $erglin, Firs. Olive Duff ill, Percy Whiting, Miss Ha- zel Council, Miss Lilla Simmons, H. E. Vtiarren, halter Wilson, G. C. Hifner. Richard. Lacey, representing Yr. Strickland, read letter from Mr. Strickland offering a restrictive covenant covering trailer parks; also letter from L.B. McKay, J. P. McLLay, and Lucille L. McKay, property owners in close proximity registering complete approval of the rezoning. TYiss Hazel Council, adjoining property owner, spoke in favor of rezoning. E. M. Bailey, representing the opposition to this rezoning pre-8 sented a petition signed by Nontrose residents and property own- ers and asked that it be placed on file. He putlined the oppo- sitions of these persons- mainly, that Montrose is a residential community and they yvish it to remain residential/. After general discussion, Chairman ivoolley announced that the Commission would reach a decision and notify the attorneys later. Motion by Mr. Pitr9an, seconded by 1--r. Schneider, that 'aterial S,-les, Inc. having complied with all requirements of the Fairhope Planning and. Zoning Commission as set forth in their meetings of Dec. 7, 1962 and Jan. 4, 1963, the Fairhope Planning and Zoni:g Commission recommend to the City Council the rezoning from R-2 to M-1 all of lots % and 8 and east four feat of lot 9, block 26, dxxixziaxx and all of lot 10 and west twentyone feet of lot 99 block 35, division 4, located on the North side of Johnson strw,:t between Brown and /qershon Streets. Motion carried unanimously. New Business retter from Y. Dyson Bldg. Co. read inviting the 1°•�yoAr and all others interested to meet with the post office department repre- sentative when he visits L`airho_ne. Application presented by Walter bilson and Yatt Dial requesting the rezoning from R-2 to B-1 all of blocs 1,2,and 3 , Hoyle - Worcester Addition to Fairhope, as recorded in Map Book 1, Page 1, Baldwin County records, this area being the Northwest and South- west corners of Nichols Street and Greeno Boulevard. ivlction by :.r. Votion by Mr. Dyson, seconded by :.:r. Schneider, that this application be accepted. for advertising for public rearing. Motion carried un- animously. Pitman, that the public hear- ings on the above applications be set for a special meeting as soon as possible after advertising. Lotion carried unanimously. Special meeting set for April 26, 1963. Claude Arnold submitted resubdivision plat, of part of N J of B1. 7, Div. 1, revising the leaseholds of j)r. H. C. Jordan, Sam Dyson, and M. Dyson and Sons, all being land of the F. S. T. C., and asked for approval of same with the understanding that if th&s­ proposed post office site is not accepted no leasehold changes will be made. Motion by 11r. Frederick, seconded by Er. Bung, that final appro- val be given to the above resubdivision as submitted. Potion car- ried unanimously. Claude Arnold presented plat of subdivision o2 one lot on Gayfer Street adjacent to the eas t boundary of the Deep Tree Forest Sub(ivisLon, land of Robert 11. Green. he stated that the uanal 30,day wait for approval would work a hardship on the owner and requested immedi to final approval if possible. Motion by "Ir. Pitman, seconded by W . Frederick, that the above subdivision plat be given final approval subject to all subdivision regulations. Motion carried unanimously. mr. Bateman and 14r. Bung reported on their talk with Mr. Robinson district highway engineer concerning the proposed 4 lane highway. Motion by Yr. Kirk, seconded by Mr. Schneider, that the Fairhope Planning and Zoning Commission recommend to the City Council the rezoning from R-1 to R-3, as requested by i7aul Strickland Jr., all the land in the John Forbes Grant, Secti n 7, T. 6 S, R 2 E, bounded on the South by Parker Road, bounded on the Vest by U. S. Hwy. 98, bounded on the North by Rock Creek, bounded on the East by grant line, containing 28 acres more ;r less, providing that a restrictive covenant eliminating mobile homes be attached to the deed and providing further that the -overall devebopment plans allow setbacks commensurate with the surrounding property.
