CITY HALL Present: Chairman Woolley, members Dyson,Nelson, Kirk, Schneider, Frederick. Absent: Members Pitman, Malone, Gaston Visitors: Fred N. Smith of Bateman and Associates, A. W. Moore, C. W. Arnold, L.E. Boone, E.M. Megginson, and protestors listed below. Minutes of previous regular meeti,gg read and approved as read. Old Business: Application of E. M. Megginson to rezone from R-1 to B-2, lot 6, block 9, division 29 101 Fels Avenue, Fairhope, Ala., known as the # Bay View Apartments". Appearing to protest this rezoning were: Norvin DuBrock, W. H. Estoup, R.W. Wilder, Charles E. Bonnell, Mrs.M. Maudlin, Mrs. Don Hershberger, Mrs. Camilla Bonnelll�H. Rober ts, John Beas- ley,James Hathcock, Mr. and Mrs./R e ,Stephen Riggs, Mrs. L.K. Riggs, Mrs. H. A. Peters, C.f:Xa-^mold, T hos. D. Nevins, Mrs. W. F. Williams, Miss Cora B. Hunter, Mrs. Frances Durham, Mrs. Ruth Nevins,James Bucknall, Mrs. John Burns,Miss Carole Steppe. Letters in opposition were received from Jack Normand, Julius and Rebecca King, Mrs. E. T. Hoffman, 11rs. Earle G. Lee, Mrs. B. B. Baker, Miss Anna Braune,Mrs. Ada McDermott. Mr. Nevins, spokesman for the group, stated that no businesslof any kind, was wanted at this location. Mr. Megginson had not arrived at this time. Motion by Mr. Dyson, seconded by Mr.Nelson, that the application of E. M. Megginson for rezoning from R-1 to B-2-lot 6, block 9, division 2, be denied. Motion carried unanimously. On being informed of this decision upon his arrival later in the meeting, Mr. Megginson requested that he be notified in writing of the Commissionts action and the secretary wa-s so instructed. Letter from th Chamber of Commerce enclosing copy of report on Chamber's Committee on Parking Recommedations was read by the Chairman. Motion by Mr. Frederick,seconded by Mr. Schneider, that Robt. S. Bateman and Associates be requested to make prelim - &nary survey, estimate and/or recommendations for downtown park- ing. Motion carried unanimously. Chairman stated that the City Council had requested assistance from the Planning and Zoning Commission in planning for expect- ed improvements on Fairhope Avenue eas t of.Section Street. d 'd d 4-t ble thi re uest until the State reports on It was eci a o a s q its plans for future action in this area. Dyson Building "oe on behalf of John V. Duck, Attorney, DoctorsMullins and Yancey, and M. Dyson Bldg. Co. Following discussion, motion by Mr. Nelson, seconded by Mr. Kirk, that Ms. Arnold be given a letter from the Commission to the effect that the closing of the present driveway is inadvisable and that further study be given the subdivision so that the transfer of prop- erty can be made without the closing of the driveway. Motion carried unanimously. Mr. Boone spoke on the necessity of access streets to the colored sections both for the police and for the utility crews. Motion by Mr. Schneider, seconded by Mr. Nelson, that the Planning Commission recommend to the City Council that it turn over to Mr. Arnold the problem of working out a street along the youth boundary of N Jof NW f Sec. 20 T6S R2E or other streets sue t s Mershon Street or Valley Drive as it deems necessary. Claude Arnold presented in behalf of the F. S. T. C. replat of G&1f Course Subdivision Blocks 39 ato 44 and 46 to 57, Division 4, re- questing preliminary approval and as speedy a final approval as possible. Motion by Mr. Nelson, seconded by Mr. Kirk, that final approval be given the above plat if and when Robert 39 Bateman and Associates approves it. Motion carried unanimously. The plat with covering letter was turned over to Mr. Fred N. Smith , Bateman's representative at this meeting. The chairman was instructed to advertise for public hearing all revised zoning ordinances and maps. Motion by Mr. Schneider, seconded by Mr. Kirk, that the following resolution be adopted: BE IT RESOLVED that any member of the Fairhope Planning and Zoning Commission who misses as many as two consecutive meetings without a legitimate excuse be asked for his resignation immediately. four I Motion carried with the fire members then present, Mr. Kirk, Nelson, Schneider , and Frederick,vnting aye . The secretary was instructed to mail each member of thi//.:ommission a copy of this resolution. Garage Planning Committee reported on progress. Letterfrom Home Investment Corp. offering their engineering services was read. Motion by Mr. Kirk, seconded by Mr. Nelson, that the Garage Planning Committee proceed with their planning of and employ an engineer Then needed for the City Garage. oting aye: Kirk, 1�elson, Schneider, and Woolley.
