WebLinkAboutMinutesTheCityofFairhopeBoardofAdjustmentsandAppealsmetonMonday,March21,2005at5:00PMintheCityAdministrationBuilding,161N.SectionStreet.MembersPresent:Chairman;CharlieBassett,ViceChairman;RayClark,LouisAgee,BernieFogarty,andCathySlagle.SummerWoodson,PlannerandKelleyChastain,PermitTech.At5:00P.M.themeetingwascalledtoorderbyChairmanBassett.MemberswereaskedtoreviewtheJanuary2005andMarch14,2005minutesforconsiderationandmakeamotiontoapprove.ChairmanCharlieBassettaskedthattheminutesbeapprovedasnoted.ZBA05.05PublicHearingtoconsidertherequestofMr.AllenHiresforavariancetoreducethefrontortherearsetbackby4feet.Thepropertyislocatedat107RonforthDrive,Fairhope,Alabama.Mr.Allencameforwardandexplainedthatthehouseplansthatheandhiswifehadchosenwouldrequirethevariancetothesetbacksinordertobebuiltonthelot.ChairmanBassettopenedthePublichearingforcomments.Noonewaspresenttospeak.Thepublichearingportionofthecasewasclosed.ChairmanBassettaskedforthestaffcomments.STAFFINTERPRETATION:ThelotinquestionisconformingtoR-2zoningrequirements.Ithasa130’frontageandtotallotsizeisapproximately15,600sf.MaximumlandcoveragebybuildingsforanR-2lotis37%oftotallotarea,andforthislotthatisapproximately5772sf.Ifthisvarianceweregranted,thebuildableareawouldbelessthanthatnumberatapproximately5670sf.Thereisnohardshipassociatedwiththiscase,itisanissueofpreferenceofthepropertyowner.However,theZBAdoeshavetheauthoritytoapprovetherequest,shouldsubstantialjusticebedoneanditisfoundtobeinthebestinterestoftheCity.Basedonthefactorsinvolved,wedonotrecommendapprovaloftheapplicationaspresented.LouisAgeemadeamotiontodenythisrequest.RayClarksecondedthemotion.Motionwascarriedunanimously.L ZBA05.06PublicHearingtoconsidertherequestofMs.JanetPitzfora7footrearsetbackvarianceforherpropertylocatedat144VivianLoop,Fairhope,Alabama.Ms.Pitzcameforwardandexplainedthatshewastryingtoreplace/rebuildasunroomthatwaslocatedintherearofherproperty.Theoriginalsunroomroomwasconstructedwithoutapermitanddidnotconformtotherearsetbackfortheproperty.Ms.PitzexplainedthatthesunroomwaspresentwhenshepurchasedthemodelhousefromAdamHomes(builder).ThesunroomhadbeendamagedbyIvan.Shewasunawarethesunroomdidnotmeetcityregulationsuntilshewastoldbyhercontractorthatapermittorepaircouldnotbeissued.ChairmanBassettopenedthePublichearingforcomments.Ms.PatsyAllenof137VivianLoopcameforwardandsaidthatshehadheardofnodissentionintheneighborhoodregardingthismatterandthatshepersonallyhadnoproblemwithit.Mr.RayJohnsonof158VivianLoopalsocameforwardandsayhehadnoproblemwiththerequest.ChairmanBassettclosedthePublichearingandrequestedStaffComments.STAFFINTERPRETATION:Kool-AircametotheBuildingDepartmentinNovember2004forapermitinordertodemolishtheexistingsunroomandthentobuilda14x12Kool-Airsunroomontheexistingslab.Apermitcouldnotbeissuedbecausetheexistingsunroomwasnotconstructedwithapermitoriginallyandsitsovertherequiredrearsetback.InorderforMs.Pitztorebuildasunroominthesameplace,shewillneedthe7’variance.Ifsheisnotgrantedthevariance,shewouldhave5’6”inwhichtoworkwithintherequiredsetback.TheBoardshouldtakeintoconsiderationthatMs.Pitzdidnotbuildthenon-conforming,non-permittedstructure,butalsorememberthatonceitisremoveditmustbebuilttoregulationsunlessthisvarianceisgranted.ChairmanBassettaskedforquestionsandcomments.Mr.RayClarkexpressedconcernsandirritationregardingAdamHomes,abuilderdoingasubstantialamountofworkintheCityofFairhope,knowinglysteppingoutsidethescopeoftheirhousepermitandblueprintstoconstructthesunroom.Mr.ClarkwentontosaythatsincetheCertificateofOccupancywasissuedforthehousewiththeadditionalscreenporchonthehousethattheCityofFairhopeinspectorsshould considerchangingstandardoperatingproceduresinordertocarrythepermittedblueprintswiththemoninspections.Thiswouldfurtherlimitabuildersabilitytoincludeworkonprojectsthatthepermitdidnotcover.ChairmanBassettaskedforamotion.ViceChairRayClarkmadeamotiontoapprovetherequest,andCathySlaglesecondedthemotion.Motionpassedunanimously.ZBA05.07PublicHearingtoconsidertherequestofMr.TonyMartino(representedbyMr.CraigDyas)foravariancetoallowa4’2”intrusionintothestreetsideyardsetback.ThepropertyislocatedontheNEcornerofPierAvenueandKumquatStreet,Fairhope,Alabama.Mr.Dyascameforwardandprovidedaproposedsiteplan.Theplanshowedtheintrusionoftheproposedhouseonthestreetsidesetbackinsteadoftheinteriorsidesetbackallowingtheproperseparationbetweenneighbors.ChairmanBassettopenedthePublichearingforcomments.JamesandJudithWallaceof407Kumquatcameforwardexpressingconcernaboutthelocationofthegarageandtheaccess.FredHirzof375Kumquatcameforwardexpressingconcernaboutthelocationofthegarage.BennieJordanof117Piercameforwardexpressingconcernsaboutthesetbacksfromthestreettothegarage.ChairmanBassettredirectedthecommentstothehouse.Thevarianceisregardingthesetbackonthestreetsidetothehouse.Mr.TonyMartinocameforwardandexplainedthatthelocationofthegaragewasstillveryflexibleandthathewaswillingtoworkwiththesurroundingneighborstotrytofindalocationthatwasacceptabletoallparties.Explainingthatthisvariancewasonlyforthehouse.ChairmanBassettclosedthePublichearingandrequestedStaffComments.STAFFINTERPRETATION:ThelotinquestiondoesnotmeettheminimumrequirementsofR-2zoningbecauselotfrontageis60’andaminimumof75’isrequired.Thetotalsquarefootageofthelotisapproximately10,140sfandR-2requiresaminimumof10,500sf.3 F.MaximumlandcoveragebybuildingsforanR-2lotis37%oftotallotarea,andforthislotthatisapproximately3751sf.Ifthisvarianceweregranted,thebuildableareawouldbelessthanthatnumberatapproximately3420sf.TheBoardshouldtakeintoaccounttheirregularityofthelotandifsubstantialjusticeisdoneingrantingthisvariancerequest.Basedonthefactorsinvolved,wedonotopposeapprovaloftheapplicationaspresented.LouisAgeemadeamotiontoapprovethisrequest,andCathySlaglesecondedthemotion.Motionwascarriedunanimously.RayClarkmadeamotiontoadjourn.CathySlagleseconded.ChairmanBassettadjournedmeetingat6:00pm.Approvedasnoted04/18/05.4
