Mr.AgeeaskedMr.Schneiderifhehasthoughtaboutcontactinganengineer.Mr.Schneiderstatesthatheisaregisteredarchitectandisawareofthepotentialdifficultiesheisfacingwithbuildingonthislot.TherewasdiscussionregardingafencealongthebackofMr.SchneiderspropertysothatasyoudrivealongSectionStreetthecitizenswillnothavetoviewthebackofhishouse.Mr.ClarkaskedifMr.Schneiderwasagreeabletoconstructinga6privacyfencealongthebackofhisproperty.Mr.Schneideragrees.ChairmanBassettclosedthePublicHearingandrequestedStaffComments.STAFFINTERPRETATION:Thehardshipclause(ISdefinedinAlabamaStatelawstatesthattherehastobeaninherentcharacteristicoft/icpropertithatwillnotallowtheapplicanttofu/JIlltilerequirementsoft/icregulations.Thedranicigeditchrunningthelengthoft/icpropertycon/clbeconsideredsuch.TherearofthelotbacksliptoCreekDrive,thedriveii’aytoF/vCreekMarinaandRestaurant.Thereisonlyoneconnectionresidentiallot,locatedontheeastside.Mr.Schneiderwouldprovideaccessfrointhefrontofthelotcindbuildafootbridgeovertheditchtothehonie.Hedoesnotwanttocovertile(1/ic/Iorputina/li’oiliertypeofdrainagesi’s/em;liewantstoleaveitasis.TheBoardshouldtakeintoaccounttheirregularshapeoft/iclot,tileimpact,fani,totheneighboringproperties,andthecurrentamidfuti‘reproblemscissociatedwit/ithe(lrainageditch.Staffvisitedthesiteandyouareencouragedto(10i/icsame.Thephotosandsiteplanprovidedcianotprovideanaccuratedesci-iptionoft/iclot.Itwouldhei’en’helpfultohai’eseenthissitewhenmakingadecision.WeaskthattheBoardtakeintoaccountciiiofthesefactorsamiddeternunewhet/icrsubstantialjusticeiscloneingrantingvariancerequest.ThepropertybackstoCreekDriveandallowingrearyardextensionwillhave110impactonadjacentpropertyowners,butthedrainagec/itchcon/clcauseproblemsinthefutureforIvIr.Schneider.If(lieABAapprovesthevariance,staffadvisesthattheyshouldrequireMr.SchneidertosignaI-foldHarmless.ViceChairmanRayClarkmadeamotiontoapprovetherequesttoincludea6’fenceontheSouthlinetoshieldthehousefromtherodandaHoldHarmlesstobesignedbyMr.Schneider.Further,thehomemustbebuiltSouthoftheditch.BobMannichsecondedthemotion.Motioncarried.ViceChairmanRayClarkmadeamotiontoadjournandLouisAgeeseconded.ChairmanBassettadjournedmeetingat5:40.MinutesApprovedasNoted3/21/05.*t1il7.ItesRevised08/14/06.PerBF2
