HomeMy WebLinkAboutMinutesTheCityofFairhopeBoardofAdjustmentsandAppealsmetonMonday,June20,2005at5:00PMintheCityAdministrationBuilding,161N.SectionStreet.MembersPresent:Chairman;CharlieBassett,ViceChairman;RayClark,BobMannich,CathySlagle;BeckyLundberg,alternate;ChristopherBaker,AICP,DirectorofPlanning&BuildingandKelleyChastain,PermitTech.,absent:LouisAgee.At5:00P.M.themeetingwascalledtoorderbyChairmanBassett.MemberswereaskedtoreviewtheApril18,2005minutesforconsiderationandmakeamotiontoapprove.AmotiontoapproveasnotedwasmadebyRayClark,andasecondbyBeckyLundberg.Allapproved.ZBA05-10PublicHearingtoconsidertherequestofTiffanyMeekfora17’sideyardsetbackvarianceat100OrangeStreet.Ms.Meekcameforwardstatingherdesiretohaveasideyardsetbackvariancegrantedonthelotlocated100OrangeStreetthatsheisconsideringpurchasing.Althougha17’streetsidesetbackvariancewasrequestedsheindicatedthatanystreetsideorsideyardsetbackvariancetothe50’lotwouldbeappreciated.ChairmanBassettopenedthePublichearingforcomments.Mr.LewisAbronskiof31OrangeStreetcameforwardprovidingtheBoardwithapetitionwith26namesofresidentsopposingthevariancerequest.Mr.Abronskiindicatedthestructurepreviouslyonthelotburneddowninthe1990’s,assuchwouldnotbeacandidateforutilizinganypreviousfootprinttorebuild.Mr.DickSchneiderof113OrangecameforwardandrequestedthecriteriatheBoardutilizestodetermineifavarianceshouldbegranted.CharlieBassettexplainedtheapplicationprocessandtheBoardsroleinrulingonsuchrequests.Mr.JamesHigginsof21Orangecameforwardtoexpresshisopposition.Heindicatedthatthisvariancewouldnotbegoodfortheneighborhood.Helikenedthesetbacktothatofacommercialdistrictasopposedtoaresidentialarea.Mr.MikeFord,realtor,cameforwardandsaidhehashadthepropertylistedforsometimeandhadmaybe10differentpotentialbuyersandastheylearnaboutthesetbackslimitingthebuildableareaonthissmallloteachhasmovedontootherproperties. Mr.Schneiderof113Orangeagaincameforwardtoclarifythatthevariancewouldallowbuilding3’offtherightofwayonSatsuma.Inaddition2lettersofoppositionwerereceivedbythePlanningDepartmentpriortothemeeting.Ms.CarolynBootheprovidedalettertothePlanningDepartmenton6/15forhermotherMs.MaryEstridSmithof106Orange.Theletterexplainsthatalthoughthelotissmallitisbuildableasitstandsforasmallhouse.Itisherdesirethatnovariancebegranted.Thepotentialownersbuildaccordingtotheregulationsordecidenottobuild/buytheproperty.Mr.RalphPetersonof102Orangeprovidedaletterdated6/7inoppositiontotherequestedvariance.Mr.Petersonrecountsspeakingwithapotentialbuyerabouta5’varianceallowingforaporchintothestreetsidesetback.Mr.Petersonwasnotopposedtothisvariance.Howeverthecurrentrequestis“waytoomuch—surelythislotcanbeproperlydevelopedwhileleavingsomemoresetback.”ChairmanBassettclosedthepublichearingandaskedforthestaffcomments.STAFFINTERPRETATION:Thereisnonaturalhardshipassociatedwiththiscase.However,thelotisarecordedlotofrecord.Ifthelotwereaninteriorlotwithasideyardof10’amore“normaltype”ofhomecouldbeconstructed.However,a20’homeisverychallenging.AsideyardvariancerequestseemsreasonableandintheinterestoftheCitybecauseanewhome,withassociatedtaxesandutilityusewouldbegenerated.Staffhasnoissuewiththegrantingofavariance,althoughthehouseonly3’fromthepropertylinedoesseemclose.BobMannichaskedMs.Meekifshehadhouseplansinmindthatrequiredthe37’huildableareashewasrequesting.Sheindicatedthatshedidnot.Shewaswaitinguntilshefoundouthowmuchroomshewouldhavebeforelookingforplans.Mr.MannichaskedMs.Meekifshefeltshecouldlimitherbuildingareato30’.Ms.MeekindicatedshewouldbeappreciativeofanyvariancetheBoardsawfittoallow.RayClarkaskedabouttherightofwayinthatarea.HewantedtoknowhowmuchspacetherewasfromtheedgeoftheroadatSatsumatothepropertyline.Commentingthatiftheareawassignificantitwouldatleast givetheappearanceofalargersideyardsetback.Howeverasurveyshowingthisinformationwasnotavailable.CathySlagleaskediftheBoardcouldonlyvoteofthespecificoftherequest.CharlieBassettexplainedthattheBoardcouldgrantlessthattherequestedvariance.BobMannichmadeamotiontoallowa10’streetsidevariance,settingthestreetsidesetbackat10’.CathySlaglesecondedthemotion.Themotioncarriedunanimously.Arequestwasmadeforamotiontoadjourn.MotionmadebyRayClarkandasecondbyCathySlagle.Meetingadjournedat6:30.MinuteswereapprovedbytheBoardofAdjustmentMembersattheJuly18,2005meeting.
